Service Officer Called...wow!

Question

I sent many emails over the past few months and have never got an email, call or anything back. Today the SO evidently received my letter terminating his POA and representation and guess what........My wife informed me when I got home from my PTSD treatment that my SO called and said he is doing all he can on my appeal and it is urgent I call him back. Wow, I wonder what he wants?! I`ll never know.

My wife said he sounded desparate and like he wasn`t giving up the claim. I sent him a letter terminating his services and I sent a letter to the VARO telling them. They are just down the hall from the SO. That should terminate the deal right?

A Rescind notice takes time-maybe few days- to get on the books at the VARO-

I learned -if you put the squeeze on a vet rep or SO -you might get better help from them-

what I mean-in your case- this guy was unresponsive to you- you have email documentation of that-

Yesterday I used the fact that I have email documentation from my POA at every level- that shows lack of knowledge basic VA case law and an inference that Dr. Bash's opinion was ignored as it was somehow inappropriate- forget what it said-

No POA has the right to make that determination-

I sent this email to Dr. Bash- his credentials have never been in question-and the VA itself has never "received" his opinions. per Iris response yesterday-

I dont think NYSDVA even knew who he was-they are really far out of the loop on a lot of information.

I have emails to prove I have sent them the latest on numerous VA claims issues -like Haas etc-

The reality is- yesterday the VARO confirmed that none of my IMOs are in my c file-

they have been submitted by me since 2004, and also by my POA-so they say-

My POA is worried now because -as frustrated as I have been over getting all of my evidence ignored-(filed claim in Feb 2003)- there is much more evidence ignored in addition to 3 IMOS-

the VARO itself confirmed -in hard copy-that this POA org did NOT do what they told me they would and it looks like they have lied to me.Many times-

I asked them on their main office letterhead for their version of all this- and told them it will be sent to NVLSP.

I learned that- when you drop a big dime on a SO or vet rep org- they start covering their butts- and this time they have a lot of butt to cover-

I have documented proof from the VA itself that not only has my evidentiary mail to them "disappeared" over the last 4 years, nor has it ever been acknowledged in any SOC, but that it appears my POA is making sure they never see the evidence either.

Your rep sounds scared- I wonder how many other vets dumped him-maybe you should give him another chance- your evidence is solid-

but some orgs like mine and the DAV do have direct access to the VARO-in the same building- and this is a plus-unless they are incompetent wimps or have sticky fingers-

Sometimes it takes a digit up a rectum- from a vet -to get these vet reps and Sos to remove their own thumbs from their rear ends.

Copy their Mission Statement from their web site and make sure if they don't follow it- you will contact their main office.

PS CAVMAN- I ask for email responses (or letterhead snail mail)to everything from my POA-

When I was called by the rep with the latest as to my evidence being presented to the DRO in 2005-by himself personally- the resulting SSOC bears out that this was a lie-as well as the recent IRIS response.

Even his main office boss cannot back up his statement to me.

I always ask for hard copy-from my new rep.

I would really like to be a service officer (unpaid) for some service organization just for something to do and for a place to hang out. The thing is I am embarassed by the organizations in my driving area. VVA is 25 miles away and the AL, DAV, and VFW all have their offices at the VARO. I don't want to go over there since I am IU and it is also 25 miles away. As an unpaid volunteer I would probably be doing the unskilled labor for the lazy VSO's. I have been looking for some volunteer activity to do and have been treated like a dog so far. I can't do the physical stuff. My brain and experience is all I have to offer.

I think you would be great helping in on of the service centers. Unfortunately even those with best intensions get srewed over. There you would be helping out, and someone would get pissy and decide that if you can volunteer you can work. The next thing is your back fighting claims for yourself because they decided to try and take away your TDIU and lower your rating. It's not worth it.

Maybe you could do some type of in home work over the internet for a not for profit organization. But I'd stay away from giving time to the VA if I were you. I hear Tbird is needing some help here at Hadit.com.

Anybody have a DAV rep and correspond to them via email. I have asked my DAV rep repeatidly for his email address and he has never given it to me, same guy who said (listen to attachment). I think he doesnt want any record of our conversations that why there is no email correspondence.............

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
