Probably not.  The effective date is the later of the date you applied or facts found. Its rare when you could get military compensation and disability compensation at the same time.  

However, if you apply with in a year of discharge, you should get retro back to the date of discharge, so apply.

I have a favorable findings disease and injury primary condition migrains service conected while on duity July 1989. Shouldn't it be binding I'm now 50 percent migrains varient Concushions service conected. Also have a favorable findings concushions while on duity 1998 shouldn't I get my saved effective date for back pay

William  I'm not sure what your conditions are but...How long ago did you receive your service connections. Date. It kinda depends on how long you have had your grant. If you applied and won back in 1989, yes that's a long time. But I'm guessing you received the disability award from the VA much later. If it has been a long time, the next time you go for a C&P, you can ask them to make it permanent. Static. If I understand you, you had a separate disability for concussions. Was it from the same event? Did you apply for that disability also? Or, did you submit recently? You don't get separate disability for the same symptoms. For example, if you have headaches from a TBI , you don't get another disability for migraines. That would be considered pyramiding.

No not if you were paid from 1998 for whatever you were service connected for  to present..unless your meaning  back pay for increase?  if you got it back then? 

OR YOU MIGHT TRY RE-ASKING  YOUR QUESTION IN BETTER DETAIL (MORE INFORMATION)

  OR MAYBE YOU NEED TO REQUEST A HISTORICAL ADUIT ON WHAT THE VA HAS PAID YOU FROM JULY 1989/ AND FROM 1998?

but in General I Agree with what  broncovet mention above.

TRY TO DEFINE WHAT YOU MEAN BY ''FAVORABLE FINDINGS''  YOU NEED TO GO BY WHAT DATES YOU WERE SERVICE CONNECTED FOR AND WHAT THE CONDITION WAS/IS?

EXAMPLE  ''I Was service connected on such and such date for? & depending on your rating and what the criteria was for that particular condition at the time you were rated? ...what did the VA pay you at the time they rated you? a lot of factors & dates  here to consider.

I suggest that you start a new separate thread and please give as much information as possible.  I agree that it would be rare, but it is not impossible. It really depends on many different variables.  Example: If you filed a claim for migraines back in 1998 and was denied and later was granted service connection for migraines then yes it is possible if your  medical records/evidence proves that you met that criteria back in 1998 then you will have to file a claim/CUE claim to request an earlier effective date.  Back in 1998 VA was denying claims as NOT WELL GROUNDED (NWG) but failed to review the veteran's entire file both SMRs and VAMC/PRIVATE records. Search 38 CFR 3.156 and or 3.157 and go from there.  As stated above, it would be rare but it is not impossible but you better know that VA will not roll over easy to grant this claim because the retro would be a pretty hefty size, so be prepare to file a claim to BVA and or CAVC and get a lawyer. We really need more information from you  to better advise you.  

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
