Sleep Apnea Secondary to PTSD

Question

I recently did a home study from the VA, and my results are as follows (see attached):

 

Min SpO2: 78.0%

Total RDI: 50.2

Findings: Snoring & Obstructive apneas/hypoapneas

Impression: OSA (G47.33) ("severe" is handwritten next to this).

They set me up with a CPAP machine to wear each night.

I am currently 30% rated for PTSD.  Based on this, can anyone tell what my rating would be filing sleep apnea as secondary to PTSD?

That's what I'm shooting for is 50%.  70% would be nice but I don't think I fit that criteria.  I will of course keep this post updated.  I am supposed to get my actual nexus letter today.  I hope he uses the "at least as likely as not"/"more likely than not" lingo.  I told him that's what it needed to have, along with a rationale.  

 

I sent my denial letter to the attorney and am waiting to hear back from them, as well.  I'm using Kenneth Carpenter, as I have read good stuff about him on here.  His office charges 30% of your retroactive if they win....nothing otherwise, so really nothing to lose.

Jonathan AF You're doing the right stuff. If the wording isn't quit right, go back and have the doc correct it; it's important. As for Ken Carpenter, he does have a very high rating from a lot of us. If he takes you case, be assured that in his opinion, you have a very good chance of winning. The fact that he doesn't charge anything if he loses, is however, is pretty common. If you lose your claim there is nothing for the lawyer to get a percentage of. That said, he is good. Good luck.

I had my Doctors appointment today and he said that he will write a IMO. He still want to read more of my records, but he said that the Meds the VA has me on, more than likely caused my weight gain which in turn caused my Sleep Apnea. We also talked about GERD and Insomnia. He is also going to do another sleep study, to see if he can help me with some of my sleep issues. Hopefully he will have the IMO done in 2 weeks, when I see him for the sleep study.

Just heard from attorney's office:

 

"Jonathan:  I had my meeting with Mr. Carpenter earlier this morning,  he reviewed your information and determined he is willing to represent you.  I then checked my e-mail and received your Rating Decision.  We are sending you forms to complete, including the fee contract, this will probably be mailed out to you sometime next week.  Are you agreeable to proceeding with us? If so, we will also wait for you to e-mail  the doctor's opinion letter.

He should, Most Dr's That are Veteran Friendly  knows to use that type of lingo.

Ken Carpenter is good attorney, if they charge you 30%  that's a little pricey  ,but if you agree then that's between the  you the Veteran and the Attorney ,.... HOWEVER YOU MAY HAVE A DIFFICULT CLAIM? SO WELL WORTH IT.

  Normal price is 20%...but like everything else  prices are on the rise  no matter what it is.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
