wife condition!!!

Yes I know this is not the correct forum to post this stuff but I am posting it anyway  if you don't like it you don't have to read it...

Anyway my wife condition has improved some of the gangrene is just about all gone and her ruptured gallbladder will be removed as soon as she regains enough strength to have the surgery, target date sometimes in 2 weeks from today.

I have her mother here with me she 84 and blind totally blind and has 3 rd stage of dementia    ...I have to do everything for her  and my spouse will not be able to help her until she fully recovers from being in the hospital for 6 weeks straight she has trouble walking  just not enough strength in her legs...so I have my hands full along with taking care of myself and doing my MH Sessions with my VA therapists  Thank God there on VA VIEDIO  so I can do those here at the house  if my darn computer don't give out...

Anyway I wanted to thank everyone that sent in prayers and especially Ms Berta and broncovet , jbasser and Gerald cook , Ms Tbird and Hamslice, GB Army, Shrek,  Pacman1,Brokensolider 244th, Vync, and any more that I can't remember  we both appreciate you guys more than you will know  God Is Good  Friendships and commirodiery is excellent here on Hadit

ANYONE KNOW IF I CAN ADD MY MOTHER-IN-LAW  AS A DEPENDENT?TO MY VA COMP?

SHE GETS SSDI, ABOUT 1,700 MONTHLY, WE ARE NOT TAKING ANY $$ FROM HER WHILE SHE STAYS HERE ,WE HAVE A EXTRA BEDROOM AND MEALS AND LAUNDRY AND HER WELL BEING WE CAN TAKE CARE OF..BUT THE DEPENDENT PART MAY HELP US  IN BUYING EXTRA THINGS AND SEEING SHE MAKES HER DR'S APPOINTMENTS  ECT,,,ECT,,,

Anyone know?..  brokensolider?

If you have any specific computer questions or concerns, let me know. I was an IT guy up to a few years ago, and Im pretty good at keeping older systems running and making suggestions to help to that end. I had computer waste and, while there are some physical and OS limitations you can't really fix (like stuff not always being compatible with XP or Win 7 anymore, or trying to run most things on only 4GB of RAM) in general you can keep systems running a good long time. I just 'gifted' my youngest daughter a Macbook Pro that I upgraded last weekend to 8 GB RAM and the most recent OS that it will run. My other daughter had it for about 5 yrs, it was 5 yrs old before that, and I anticipate my youngest daughter will have it for a few years with no problems, too.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

I don't think I will have computer problems  other than my ISP  keep getting knock off line during my VA SESSION And anything I play like games  ect,,ect,,  I have to fix this  but I really do think its my ISP...

So we may change providers. (RIGHT NOW WERE WITH AT&T) 

I have windows 10 right now but may upgrade to the newest one...but not just yet  to many other things to do first. 

my son is a COMPUTER GEEK OR I.T. MAN, he is very good at what he does  for the city of Dallas 911 SYSTEMS  HE IS THEIR SENIOR  SYSTEM ANALYST  FOR THE EMERGENCY SYSTEM AND ALL THE FIRE AND POLICE CAR RADIO'S

Buck That is encouraging news on your wife, and we hope she can get that corrective surgery soon. You are a good man bringing in your mother-in-law with all her disabilities on top of what you are already handling. I don't know if you can pick her up as an additional dependant, but that should be easy enough to get an answer. How about contacting the patient advocate's office at your RO. They also may have some advice on SSI/social services to contact. Because of your disabilities, I would expect there might be additional in-house assistance available, like a part time home care assistant or ??? Continue with your updates; we are all interested.

I dont know if a mother in law would qualify and there is an income limit as well.

I was just wondering about my mother-in-law being one of my dependents  being she changed her address to our address and lives with us at no charge.

she has a separate Bank Account  but moved it to our city, all her checks go to her Bank Account.  she really has nothing to pay for  other than her medications she takes which is just two and there fairly cheap.

I had read one time about parents living with the Veteran  and could possibly be a dependent  but unfortunately  many things stand in the way,  mostly her income I think?

 but I am going to check it out, she is here to stay with us until her last days.  but that could be years  she seems to be in good physical health  her mind is completely gone and she is totally blind.

it will get harder for us to cope with her...but that's what my wife wants...its just comes at a bad time for us.... but  my wife had this planed out before she got so sick.

Yes, its great news about your wife.  

Berta has been praying for you.  

As far as dependent parents, read the rules, here: https://www.vba.va.gov/pubs/forms/VBA-21P-509-ARE.pdf

It does use the term "step parent", and it sounds like a step parent is still a parent but decide for yourself after reading the above, carefully.

It would appear, if you provide more than half her support, she is eligible, but read it for yourself to see if it applies  to you.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
