Can I add Additional Denial Rebuttable While In NOD?
Filed for ankle and knee problems that both are documented in my SMR. I was denied with a reason stating that both were acute problems. I filed a NOD. I requested my c-file, received it on Monday. Had a c&p from a contracted VA doctor so was not in my medical file as it was a contractor. The c&p doctor that did the ankle and knee exam opined the claimed condition was at least as likely as not (50 percent or greater probability) incurred in or caused by the claimed in-service injury, event, or illness. Long story, Advice Please! EED or Nothing?
My claims have been incredibly jacked up since 2012, when I was medically retired for Ptsd/Tbi from the military for injuries that awarded me a purple heart. Granted (50) Percent PTSD from VA when i was medically retired which is grossly underrated back then, I mean at (50) Percent for PTSD, if those were my symptoms, I would have never even been recommended for a medboard. Keep in mind that i was AWARDED Social Security Benefits based only my military medical records and the SSDI granted the Disabilities of : TBI With Migraines,PTSD,Adjustment Disorder with Effective Date : 02/22/2010 the so SSDI made the my Effective Date the same day as my Purple Heart date!…

"Is NOT near-contemporaneous"
Hello Everyone. I received my decision letter on 1/10/20 for addition claims pertaining to my knees, which were denied back in 2010. I went to a doctor that wrote a nexus statement that connected my previously denied knee condition with military service (paratrooper and vehicle accident). My claims were approved but stated that an earlier effective date is not warranted because the claim to the right and left knees are not near-contemporaneous. I had never heard of this. Can anyone explain what is meant by this and if I can file an NOD for effective date? Thank you.

I finally got a BVA hearing date, end of February. I and my VSO feel confident we have submitted sufficient evidence for service connection. Appealing Decision
Veteran Group member was awarded 10% (MODERATE) left foot (painful motion). He wants to appeal for higher 20% (MODERATE SEVERE) or 30% (SEVERE). He wants to preserve his effective date of August 15, 2019. The VSO told him this: 1. The HLR would probably be another denial and add six months on the process. Retro pay
Good Morning, Can someone with knowledge of supplemental claims for retroactive VA disability help me? I want to make sure I have all the right forms and would like to talk with someone who has had success. I am a caregiver to a nephew who has waited 15 years for his rating for severe PTSD and TBI, which he just received in November but has repeatedly tried in the past since 2004 after leaving the war. I'm new to your forum and a little unsure how all this works.

LEGACY NOD Process
Howdy all, Due to my last VA decisions being just prior to the Feb 2019 cut off date I had to file my NOD (notice of disagreement) via the legacy process. I filed it in June 2019 and the VA received it on 10 Jun 2019. They ignored it for about three months or so telling me I used the wrong forms. After several emails, phone calls, with VA personnel they conceded I used the correct forms and sent it to my new regional DRO based on my new address in South Dakota. VA.Gov says it is currently being reviewed. The new screens don't give any estimated completion date now. It does say it will take 10 months to 2 years for them to complete the review. Supplemental Claim question
Hello everyone, I was denied a secondary service connection for Acid reflex/GERD. I made it secondary to Asthma (medications). The nexus letter from my private doctor kinda screwed things up along with the VA examiner saying that my Asthma was not the cause of my Acid reflex/GERD (I was basing it off of medications not Asthma).
