Question About Percentage
Hi all, does anyone know why a veteran rated at 90% is paid at the 100% rate? Calling the CDVA would be an excercise in futility, same with the VSO. Thank you. H.G.

Very Important Information For Gov. Employees W/30%
DVAAP.Document.pdf Find out all you can about the DISABLED VETERAN AFFIRMATIVE PROGRAM PLAN! Each and every agency is required by law to comply with this program, yet each agency needs not to submit a report. It is the responsibility of OFFICE OF CIVILIAN HUMAN RESOURCES to insure this program is implemented properly through each agency. Read the documents thoroughly! Each and every agency must comply, implement and carry out the intent of the program, just like Upward Mobility, Affirmative Action, and EEO. No implementation or action of this program has ever been conducted by my agency in anyone's recollection. It is law that the program is fully implemen…

ptsd Bell V Derwinski
Terry- I have a CUE that I had to support under the Constructive Rule of Bell V. Derwinski. I sure appreciate your past insight regarding that case. This is regarding documents in VA's possession in 1995. Internal Documents that VARO claimed had never existed. (But they were in my c file -much to my astonishment---and I have them here). It seems that the VA is asking the regional counsel to support this evidence,as this is where the documents were requested and then went-in 1995. This was an internal Peer review report on my husband's VA medical care and it supported my Sec 1151 /FTCA claim. But the RO denied knowledge of this report and both the VA coun…

Do I Have Enough Now To Prove My Sc Claim
I promise to let this claim rest soon. I called the medical center today and my file has been with the male psychiatrist that refused to sign the C&P of April 2005. He has been asked by the AMC, for a complete rationale of the decision rendered by him and the lady psychiatrist. The lady shrink authored the C&P with a decision, " nothing bothered her in service. " I am so nervous to know that he is making a decision and I am not allowed to speak to him or be ask any questions. If he didn't agree and wouldn't sign the original C&P , there has to be a reason why? Since that C&P: Letter from my Military treating doctor, of 40 years back. ( t…

How To File For Temp100% After Surgery?
I searched for this and what I found Im not sure if its right. I had back surgery in April. My doctor wrote a note that my recovery period would be three months. I was told I can file to receive temp 100% for the recovery period. Now, what I found says that all I have to do is type up a letter stating I had surgery and am requesting a temporary 100% rating for my recovery period and include the letter from the dr. Is that all I need to do? My back is service connected and the surgery was performed by a civilian dr through insurance. All the documentation from my surgery is in my c-file. It just doesnt seem like it would be that simple. Thanks.

tdiu Two Recent Cues Granted By Bva
"FINDINGS OF FACT 1. A November 1983 Board decision denied service connection for residuals of a postoperative discectomy at L3-L4. 2. In January 1986, the Board found that the previously denied claim of service connection for a low back disability had been reopened by submission of new and material evidence but determined that the evidence of record did not establish a new factual basis for granting service connection. 3. Of record before the Board in January 1986 was a March 1985 service department investigation report which determined that the veteran sustained a back injury on May 1, 1982, in the line of duty. 4. Evidence on file at the…

ptsd Another Question On C&p
I had a bad fall while in the service and have a buddy statement saying just that. The VA used a Statement of Fact. A. As evidence in the decision dated April 5, 2005 Tinnitus. They accepted his word. B. And enough weight of the Statement of Fact to warrant the CT of the head for evidence dated 11-28-05 for a 50% rating for PTSD (slip and fall) statement of fact. I have applied for benefits for lower back pain and injury. I recently had a MRI of the lower back and the first two words were, "Osteocartilaginous exostosis". The word "exostosis" is defined as, "A non cancerous growth on the surface of a bone, usually with a cartilage cap, that is due to long-term irritat…
