ptsd Cue Help Needed Please
I WAS DIAGNOSED WITH WHAT THE V.A. CALLED SC CHRONIC COMBAT STRESS DISORDER IN 1980 JUST BEFORE THE PTSD LABEL CAME ABOUT. I WAS AWARDED 0%. I SAW APPROXIMATELY 150 DAYS OF COMBAT IN VIETNAM/CAMBODIA AND AWARDED 2 PURPLE HEARTS.COMBAT INFANTRY ETC ETC. I WAS NEVER TOLD OF AN APPEAL OPTION AND ALMOST POSITIVE I NEVER RECEIVED THE ANSWER FROM THE V.A. AT THAT TIME. I JUST FOUND OUT ABOUT ME DOING THIS WHEN I WENT FOR A C&P EXAM IN JUNE FOR A PTSD CLAIM I FILED IN NOVEMBER OF 05 AND JUST GOT AWARDED 50%. C&p Dirty Trick
In July I had a non formal DRO hearing at the VARO in detroit. The DRO said that he was going to schedule more C&P's. 45 days later I got my letter in the mail telling me to report today at 130 to the Detroit VAMC (what a zoo). Last friday I called the C&P Clinic and asked the woman what I was going to be examined for, she told me neck arm, hand and shoulder. So I spent the weekend preparing for this. Today I get in there and its head, Neck, Shoulder, hip, kness, TMJ and foot. Cue Claim And Claim For Secondary Condition
I filed a CUE claim today at the St. Petersburg Regional Office and a claim for a secondary condition for DMII. I just found out via a CT scan that I arteriosclerosis in my legs. I have read the DMII traning letter, and it says that cardiovascular complications like peripheral arterial disease are common complications. I already have perhipheral neuropathy in my legs and now I have PAD it looks like. It this something I should claim as a secondary condition to DMII. I am getting exactly no special follow-up for this stuff from the VA and I only find out by accident about the PAD. My relatieves on both sides of my family have lost limbs due to amputations so I am …

Ao And Combat Disability
Is an Agent Orange disability considered a combat related injury? I know it is considered an instrumentality of war for the purpose of concurrent receipt for 20 year retired disabled vets. If I was not in Vietnam I would not have been exposed to AO in all probability.

Cue Legal Beagles-
http://www.va.gov/vetapp92/files3/9222216.txt I found this case to make a point to Angela's post - and it is interesting-for anyone with a CUE claim- The BVA got the case in 1992 and due to finding of CUE the veteran was awarded 10% by the BVA for over 20 years retro back to the 1972 erroneous VA decision. This is a good example of a successful collateral attack on a past ,final VA decision. There are many successful CUEs awarded at ROs, BVA, and even the CAVC. Often the BVA might dismiss a CUE without prejudice as the veteran has not been specific enough in it- yet that gives the veteran another chance for CUE. CUES on BVA decision-I suggest getting …

Finally Going To Get A C&p For The Low Back
My son was finally scheduled for a C&P exam on the Low Spine for Oct 4th. What can he expect to happen at the exam ?? Anything he should look for and be prepared for?? He had an exam about 3 weeks ago at the PM&S Clinic which he took it upon hisself to go in to see what they could do about his pain, Since he was already a patient in the VA hospital going through withdraw and treatment from 13 months on high doses of pain killers he wanted out of that cycle. The Dr. in the PM&R clinic told him that he was in a H*** of a mess. He was going to have a lot of pain in his back for the rest of his life [ he's only 35] and to have an addiction to pain killer…

2 Social Security Numbers
When I recieved my 201 files the first time, I recieved 13 pages. My social security number had been hand changed by one number on all my pages but 2. Where a 8 had been typed it had been hand changed to a 6. I have sent for my 201 files 3 times, and each time I only get a few more pages. I do not understand why they can't just send me everything they have instead of a few more pages each time. My SSN on the new pages have been hand changed to from and 8 to a 6 also. In other words I am missing almost all my 201 files. Should I really tell the doc how I think and feel about Nam combat and what happened. I don`t want to be commited. Should I tell him on the first visit I am filing an NOD and need a letter about unemploability or when should I ask him for it. I want to set up a treatment schedule and don`t want him to think I only want a letter from him. Cavman

Got My Response Denied Of Course
They denied all of my claims based on no evidence in my service record. All of these conditions were properly diagnosed by group health care physicians within one year of active duty seperation. Many of the conditions were treated in service but were never given a proper diagnostic or were not named correctly. I was treated in service specifiacally for psychiatric conditions which was diagnosed as a anxiety disorder by a psychologist. Less than a year after seperation a psychiatrist diagnosed Bipolar II along with anxiety issues. Remand Update
The Buffalo VARO is in physical possession of my files, remanded from the BVA in less than 51 days- This is now an "open appeal action" and in "active status". Since my POA would not support this remand request at all- and they were sticking to the erroneous SSOC I got as their way of not giving me support, I have sent a five page complaint letter to their director and their training officer as to the lack of knowledge of even basic VA regs and case law exhibited by 3 individuals at my POA in regards to my claim. What is good for my position (but bad for these veterans) is that their Remands at BVA show this lack of knowledge that has adversely affected others …
