Bva Remand
I am awaiting more confirmation-the BVA just emailed me with this information- July 18th BVA received appeal August 29 I made Remand Request to BVA based on VCAA violation and Procedural Error,prejudicial to my claim. Also I asked the VARO to CUE the appeal decisions which were erroneous. Asked vet reps on my POA to support- they are still looking up "procedural and prejudicial error" I think. Or passing the hat to buy the VBM. Remanded per BVA recently- If I can confirm this info from the BVA I will be overwhelmed with JOY!!!!! And then I can reconnoiter-this was a big mountain to move-Berta

tdiu Denied Now Nod Time?
I called the 800# for VA, and was told that my claim for TDIU was denied and that all ratings are to stay at present rating. I am planning on continueing my appeal, is this the time for writing a NOD notice of disagreement? After the writing of the NOD what's next? What is it called when you ask for someone else to review your case? Do I ask for that in the NOD letter? What is the quickest way to get to the BVA? I appreciate any and all comments. Steve

ptsd Ptsd Claim Thoughts
This is my first post and would really appreciate some thoughts on my situation. I am a Vietnam vet from 69/70. My M.O.S. was recon. I received 2 purple hearts and a c.i.b. badge. I filed for PTSD on Nov. 29, 2005 along with claims for the purple hearts, 3 times malaria and agent orange. I filed for the agent orange because I was diagnosed with stage 4 throat cancer that had spread into the lymph nodes in Sept. of last year. My U of Michigan surgeon says he thinks it was caused by agent orange sprayed in III corp/Nam/Cambodia and I was also sprayed on the DMZ in Korea in 69. ptsd Got Mail Went To The So
Hello everyone, We have a few questions, we would appreciate your responses so we can make a determination of what we should do over the next few weeks or months while we fiqure out where we are going to move. In the mail today my husband got his very first ever letter for a C&P exam. We needed to go to the SO, we took the letter with us. These are the things discussed and the questions. 1. The C&P exam is schedule in 11 days. According to the SO it is with a very nice person. This person can do the exam for everything but the PTSD portion of the claim. The person is an NP. Attention Hadit Members. Rin 2900-am15 Is Final Rule
I have been tracking this proposal since its inception. It is effective October 6, 2006. This Rule amends effective dates for claims. There will be a change in the wording for effective dates based on this criteria. My take on this is: If a Veteran files a claim and is denied due to the unavailability of service record or part of the record, and re-opens the claim and gets an award, Then The Veteran can ask for an earlier effective date based on this rule. This is list on the federal register 09/06/2006.

Agent Orange Vets
This is the most recent doc. (pdf) at the NVLSP web site.(June 2006) http://nvlsp.org/images/DMZUnitsExposedtoAgentOrange.pdf As the PDF states (NVLSP) this could change and more units and brigades could be added. ANY Korean vet who served in the area as defined in these regs during the time periods defined and who has a AO presumptive disability should file a SC claim.

hypertension Help Needed
Filed for disability last year after returning from Iraq. Received 40% rating: 20% right shoulder strain, 10% left knee (medial meniscus tear), 10% right knee (medial meniscus tear), 10% degenerative disk disease, 0% diabetes, 0% hypertension, all SC. I also filed on left wrist sprain, tinnitus and sinuses. I asked my local VSO about filing a NOD because they didn't give me a bilateral for my knees. She said that they combined the 10's for 19 and the take the bilateral factor against the 19 for a 1.9% increase. I assumed that it would be added to the rest for a rating of 47.5, rounded to 50%. Any opinions on what to do? Any advise is greatly appreciated.

Bva Hearing Notice
I received a letter today from thr VA, Manila, telling me i will have a videoconference hearing on OCT,13,2006. it also states that the BVA has adopted a "trailing docket" method of scheduling their hearings.rather than assigning a specific appointment for each claiment to meet the board member, a group of claimants will be ask to assemble at a cetain time and each will be taken in turn for their hearingas soon as the preceding person's hearing concludes, they are allowing only [15] minutes to [45] minutes per hearing, this sounds fishing to me, what if you need more time, like me i have one claim that goes back [9] years. tdiu What Is Gainful Employment?
I was just denied for TDIU, and the VA's reson was that my last employer stated that I had missed no time from work, I worked 2 (two) hours per day that was compensated with a free apartment, and during that 2 hours I did routine maintenance and made a whole $400-450 per MONTH for a family of four! The VA reasons that since I left such a wonderful job I am able to maintain gainful employment. I quit a full year before moving, and my wife took over for me. I have my IRS tax papers to prove it...if that would be considered proof. They didn't address my failing Vocational Rehab because of my missing classes and being terminated from the program. Stessor Letter
Does it have to been in his own hand writing or can he type it out. He has started to write the letter, but needed to stop cause it was really bothering him to write down things and dates. his hand writting and spelling is terrible and know one can read it. He even has a H of a time reading it.

I have asked so many questions concerning my claim for 100% Service Connected " Psychiatric Disorder". I was in the Navy for a little over a year and was referred by my military treating physician, Dr. C. to Dr. J Psychiatrist, to see if he had me on the correct treatment. I later saw another Psychaitrist who felt that discharge was best for me. Dr. C. was treating me with librium and caffergot for my nerves and headaches.
