Vet Alimony Award Question Settled.
Alimony award of disability question settled. It has been indicated that Michigan 19th District Circuit Court Judge James M. Batzer has, because of the United States Supreme Court veterans' disability benefits, child support ruling in Rose v. Rose, he was re-thinking his Murphy v. Murphy court order (1/4/06) “..concluding that it could not consider the Veterans’ Administration (VA) [disability] benefits of the defendant”. While doing research, discovered something that was right there all the time, specifically 38 USC 5301. Contrary to the conclusion reached in Rose v. Rose by the U.S. Supreme Court (1987) in the question of congressional intent. Here are just three re…

ptsd Iom Ptsd Review
Here's a link and the IOM's summery on their web page. Institute Of Medicine At the request of the Department of Veterans Affairs, the Institute of Medicine conducted a study on Post-Traumatic Stress Disorder (PTSD). The committee reviewed and commented on the diagnosis and assessment of PTSD and known risk factors for its development. The committee found that PTSD is a well characterized medical disorder and that the Diagnostic and Statistical Manual of Mental Disorders (DSM-IV) criteria for diagnosing PTSD are evidence-based, widely accepted, and widely used. According to the committee’s report, PTSD should be diagnosed and assessed by a health professiona…

ptsd Va Compensation Increase
I guess this can be considered a "good news story". I was just increased from 30% to 50% for PTSD. However, I would like to know, what should I do next? Should I wait awhile before I re-apply for another increase? My condition is getting worse as time goes. Does anyone have an idea? Thanks, Healer

Witness
Hi Everyone, My husband got his envelope denying him earlier effective date of 1958. They claim that there is no 1958 application and the only application they have is his 1983 application he filed in Connecticut. He asked that they decide under the Reasonable Doubt Doctrine as well as Relative Equipose. Well they did it only under the Reasonable Doubt Doctrine and not Relative Equipose. Naturally he wants to appeal. He has a friend whom he thought was dead, until he recently went to another friends funeral in South Carolina and saw him there. This friend went with him to Tazwell, VA and witness that he did file application with VA representative for benefits i…

I Would Not Fell Better Giving Up My Claim
I do not see the relationship between seeking compensation from the VA and the need to free oneself from the dependence of the govt. This thought contradicts the entire purpose of compensation. An individual can get compensation and work at the same time. I know several people who have plenty of money to support themselves and still pursue their VA compensation. If you want to have wars or make widgets you better have enough money in the budget to pay your employees and warriors a salary that will allow them to get medical insurance that covers them that while doing their job or pay for it from your own budget. This is the law of our great land. People who want …

Bva--how Long On Average For A Decision?
I finally got my husband to call the VA to find out the status of his appeal. The lady was shocked, because it is listed as with the Decision Officer and it has been for two years! She didn't want to have it pulled, because you know what happens then, you go down to the bottom of the pile. But she made a note (at least she said she did) in the computer about it. On average, how long does it take for the BVA to come down with a decision? I finally got a copy of a letter from our primary doctor saying that my husband's condition is chronic and it started while he was on active duty. It was faxed to our State VA Rep. who is suppose to represent us and send this info …

ptsd Need To Service Connect Recent Diagnosis
I have been receiving 40% for lower and upper back pain and ringing in the ears since my discharge in 1997. I have a claim pending for PTSD, the VA tells me my claim is in review (they are awaiting records) from somewhere to prove I was in Somalia. Anyways, back in May 06, I was diagnosed with congestive heart failure with ejection fraction of 20%, my civilian doctor placed me on 7 different meds and last month, I had an I.C.D./Pacemaker implanted. If I can get this condition service connected, it is automatic 100% according to the schedule of ratings. Should I wait on my ruling for PTSD, or submit a claim for CHF right away? I'm concerned that if I mail my C…

hypertension Ao Question
I am getting a headache looking for info on my husband and uncle, so I thought I would ask you all the question. You are more experienced then I am!! :) On the VBA site they mention deadlines for conditions for AO, but the links they give to Title 38 don't work, so I looked under Title 38 in the section they made you think it was in and found nothing. On DMII with AO exposure (even casual), is there a deadline that you have to file by or a deadline that you had to have contracted the disease? Also, what can he use (besides his word), that he was boots on the ground in Vietnam (couple of hours). He was stationed in Okinawa at the time, but went to the Phillipi…
