Helpppppppppp Advice Needed, Michigan Vso Needed,
I need the name of a good VSO in michigan. DAV is representing me and I am not happy with the service I have received from my rep. I am 50SC and getting SC 0% for two herniated disc in my neck. VA's DRO review was just completed and DRO says 0% SC for herniated disk, even though (non VA) neurosurgeon recommends surgery. I cant beleive they are denying this. SOC states "the evidence does not show any clinical evidence of limitation of motion or painfull motion characteristic of a cervical strain to warrant a 10 percent evaluation. The evidence shows only light, subjective symptoms consistent with a noncompensable evaluation." In my VA health record there are s…

Help Beyond Voc Rehab
I am currently in the Voc Rehab Program and am due to graduate Dec 2008. My current program of study leads into a Doctorate program or a DM in Management. I paid a lump sum of 2700.00 when I retired in Jan 2002 to eligible for the full 27,000 college tuition benifits. After being rated by the VA and found qualified for the Voc Rehab program I was enrolled in the Voc Rehab program. My question is what type of tuition assistance is available beyond the voc rehab program? I understand that you lose your tuition assistance - dollar for dollar - or month for month while in the voc rehab program. Is there anyone out there that knows of any Vet programs that will assist a 100% d…

Evidence For Claim?
While in the Navy, I went to sickcall quite a few times for joint and lower back pain. However the docs & corpsmen would send me on my way with no diagnosis. Does this mean I can't file a claim with VA without a diagnosis while on active duty even though I went to sick call on numerous occassions? Liz

St. Petersburg, Fl. Disability Commission
Ladies & Gentlemen, 1st I'd like to take just a moment to commend you on par-taking in this commission. With the price the taxpayers are spending on this, it's sure to be financially rewarding for you -- but mostly I'm in hopes of it's rewards to our current and future disabled veterans. May the guidance of this commission be always in the best interest of those that have served our country. My name is Carla --- I am an American -- and I am proud to be a Veteran of the United States Army. While on active duty I sustained first a contussion -- and not long after that a mild traumatic brain injury. After these injuries I began having strange mental and …

Important Statement To Include In Substantive Appeal
I found this Web site for VA legal representation and they posted an excellent description of the claims process, with helpful advice. It included this comment: The purpose of the Substantive Appeal is for the claimant to set out in writing his or her "contentions" or arguments for why the VARO's denial of benefits is in error. In theory, the Substantive Appeal is supposed to identify specific items in the SOC that are in error. However, such specificity often is not possible because the SOC is poorly written, ignores issues or arguments, and contains irrelevant information. Therefore, especially if the claimant is unsure about providing a detailed response to the SOC…

Question On Rebuting The Diagnosis And/or Evidence?
In light of a diagnosis of a cerebral concusion, as having occured during time in service, it is stated on the decision of the claim as such. "Residuals of cerebral concussion as it was not found on your last examination. At the time of the Cerebral concusion, an Xray, which evidences a fractured nasal bone, an EEG, which evidence a slow frontal lobe wave form, and along with physical finding at the time, to come to the conclusion of a cerebral concusion. Is it neccessary then, to conduct similiar test and exams to rebut the findings, as not in evidence, at a subseqate VA C&P exam, when that exam only contained a cursery physical cordination test as evidence.? …

diabetes Panic Disorder With Agoraphobia
I was thinking of trying to get my panic disorder with agoraphobia riased to a higher percentage, but don't know if it can be done. Prior to Dec 16, 2003, I was 70% for PTSD, 20% for diabetes, and a couple of zero %, with TDIU P&T. On Dec 16, 2003, I put in a claim for panic disorder with agoraphobia, secondary to my PTSD, then on a rating decision on July 16, 2004, I was granted a increase. this is how the VA wrote it, Evaluation of PTSD and panic disorder with agoraphobia, which is currently 70% disabling is increased to 100% effective Dec 16, 2003. there is no mention of my 20% diabetes, and I was never service connected for panic disorder with agoraphobia pri…

tinnitus Quick Check Of Va Math
Please look this over, do you get 95% rounded up to 100%? Because our VARO here sure doesn't. I used the VA Inquiry System and got a response yesterday from the VA Service Center Manager here that my husband's not at 100% he's at 90%. If I'm right and the VA is wrong, how do I get them to listen to me? I've been at this since last October, after the Board gave my husband 10% for sinusitis, which I think put him over the top. Thank you. Pituitary Adenoma 60% Lumbar Spine Condition 40% Organic Mental Disorder 30% Bilateral Field Vision Cuts 30% Adrenal Condition 20% Spinal Disc Condition 20% Tinnitus 10% Scar - Excision of Pilonidal Cyst …

Interesting Statements From The Disability Commission
These are statements from the Disability Commission's approved research questions. Be sure to see the footnotes to connect the dots to the source. The VARO's highest call seems to be to displace the Government's intention as they deny, deny, deny. SMC at different levels is in place, but few veterans can get that; many don't even know about benefits beyond the 100% compensation. I am convinced that far more veterans are eligible for these benefits, but few VA and VSO representatives understand SMC enough to appropriately and successfully assist the veteran. I have spent months studying SMC and cases related to it. I have gleaned a lot of information about it, but sub…

Arthritis Thanks To All
This is my first post so please be patent. I have been reading this board for over a year and the information supplied here has allowed me to submit a claim for a secondary service connection for hips and knee related to my back (DDD 40%). I had planed to fight the VA for a few years in order to get the service connection but because of the information all of you have shared has allowed me to win my claim the first time. I won in a little over a year start to finish code 5003 10% R hip 10% L hip and 10% knee. Still hard to believe it was that fast. I can not thank you all enough. As I was not prepared to win that quick I may have made mistakes when I filed my NOD to in…
