I received my decision. We must confirm our previous decision which denies your claim for service connection for hypertension as secondary to diabetes mellitus, type II with organic erictile dysfunction. The medical report you submitted does not provide a link between your hypertension and military service. Is The Va Legally Bound By Its Own Regulations?
We often quote the M21-1 in claims research, but is the VA bound by all statements in its published circulars, pamphlets, manuals, etc? What about its own adjudication procedure manual? While the VA is bound by its own regulations, that doesn't necessarily apply to all statements in the M21-1. So what part of the M21-1 is legally binding? tdiu Question On Rating Of Hearing.
Ok here we go, husband is 100% TDIU & P&T. Went for a hearing test in 2003 and was rated by the Cleveland Regional Office, SC at 0%. Went for a hearing test today and was told that he had a paper that said he was denied for SC and showed him where he was not rated at all for his hearing. He also had Jim's services records from when he was discharged where it stated that he had significant hearing loss. His hearing tested fine before entering the service. Jim has never seen these records. Now where do you think we should go with this? The guy that gave the hearing test seems to think that Jim should have been SC all of these years for his hearing. Help
Need a little help I am putting My request for a for DRO to look at my claim. I was low balled on 4 separate claims plus denied on my right shoulder pain where the VA on C+P exam with there own erays said it was bad. I had a few samples on my old computer that I Got from Berta before that computer crashed and burned does anybody have a sample letter. Thanks in advance for any help Jim

File One Claim, Or For Each Symptom
With my brain injury there are a lot of symptoms that can be rated as illness's by themselves, if SC. I had in the past filed on fatigue and am rated at 20%, undiagnosed. I have a claim for depression, secondary to SC denied and appealed. My C&P examiner for the depression said my depression is caused by the brain injury and it is likely my fatigue and other problems as well. So, with no hospital records on file, -accident in Gulf War- they said sorry. literally. Being rather slow, thinking ability and whatnot, it took the brain damaged guy a while to find the records. The day they came in I filed on the brain. Am I going to have to file a claim for each of my symptom…

ptsd Va Regional Office New Orleans?
The VA medical center in new Orleanns was particaly flooded as I saw on Tv. Believe it or not there was a basement that houesed some of the mental heath offices. The VA regional office is just down the street a few blocks.From what I saw on television the highrise buildings had windows blow out everywhere. Just curious how many claims were lost in the wind from that disaster?My cousin had a claim for PTSd and had been rejected even thou he had diganois 2 purple hearts and CIB . diabetes Odd Update On My Review
VARO assured my vet rep the claims folder went to a VA doctor in Buffalo last Wednesday for Expeditious review- Two strong IMOS and also additional probative med evidence, from the veteran's medical records, VACO etc-to suuport the claims- Today the 800 # vet rep- who has helped me track this stuff said it was all in transit yesterday and today it was received bu a doctor at the local VAMC in Bath. tinnitus Informal Claims And Inextricably Intertwined
Question # 1 If in 1978, a vet had an Audiology C&P, requested by a VARO adjudicator and listed as "Special Ear Examination" -- and the C&P examiner list's under findings Tinnitus alledged -- would this be an official (if there is such a thing) informal claim ? FYI - 20 something years later Otitis Media and Tinnitus were both granted. In going over ALL records I've just realized that at the time of the Ear C&P, I was taking VA Rx'ed antibiotics for Otitis Media and this is why the ear canal showed no effusion. Claims Format,
No one ever sees the claim as it is written and leads to a winning claim. We always get bits and pieces letting us know of the win and that is about it. I'm wondering if their is some form or steps or something that allows one to put in writing a well thought out claim that even the VARO would have a hard time finding flaws, in which to deny the claim.
