Just Curious
If a veteran files a claim and is denied and then files an appeal and VA never addresses/processes it, is it a Cue or an open Appeal Claim?

Advice
I filed for compensation in August 2004. I was denied with the reason being that I failed to show up for my c & p exam. I filed an appeal in November of 2004 but I haven't heard anything since. I went back to the VA in October 2009 and since October I have been receiving/going to my exams. In reviewing my paperwork for my appointments I discovered that I had a Perisan Gulf Compansation and Pension exam in August 2004. I thought this might be the exam the VA said I missed. I called the DAV who told me that it did not matter because I only had 1 year when I got denied to address it. What mattered now is when I re-applied in October 2009. Does the original appeal matt…

Question - Disability Compensation And Marriage
I am a disabled Vet who posted here several times and you guys have a been a great help to me. My question is: My boyfriend is also a disabled Vet receiving 50% and I currently receive 70%. If we got married how does that affect the compensation other than it possibly being increased? Could it negatively affect the amount as we are both disabled? Also, as a dependent to a disabled vet receiving comp benefits, what happens if that person were to die? I have a 5 yr old daughter and wonder what will happen if I died - would she receive any monetary allowance or compensation on my behalf? AND if I were married would my widowed husband receive anything and visa versa…

Depression
I got out of active duty on the 15april09. I made a claim for my back, bladder and some other things. I recieved a decision and everything was rated at 80%. I had a fusion on 1 Jan 08. I am now expiriencing some depression and have been seeing a phyc for a couple months now through the VA. My doc from the VA say's and knows I also suffer from chronic pain. I am taking narcotics to help control that. My doc put me on depression meds about 6 months ago. Not being able to do the things I once did and having bladder issues have cuased my depression. I did not add that to my original claim becuase i did not have that much depression then but now do. So can I now claim depressi…

ptsd Question On 100% And Still Working
I had read on here on numerous occassions that you can be 100% and still work as long as that 100% is not for a mental condition. Is that in some VA Title or document? I have a vet friend who is 70%, but 30% is for PTSD. He just had a C&P for an increase in 3 other conditions (not PTSD), but is afraid he won't be able to continue to work if granted 100%. He wants his 100%, but wants to continue working. I have told him that he should be fine as long as his 100% is not all mental. But, he doesn't believe me. :D Is there some documentation somewhere that I can show this vet that can prove to him he can continue working?

C&p
Greetings All, I am scheduled for a C&P on Feb. 10, 10 in Winston-Salem, N.C. This is my 3rd C&P for basically the same conditions (back thoracic and lumbar, and right hip). New conditions added to my reconsideration are my knees (chondromalacia patella) and flat feet. These are seemingly clear cut to me because they were diagnosed while in service. My last C&P was in March of 2009 and I was seen by a Dr. the 1st time and a NP the 2nd time. This time, I will see a NP and luckily not the same one. Claim At Bva ( Kinda Long)
I am new to alot of the words used here on this message board, and I dont have that much experience in all this paper work. I was medically retired from the Army May 06. I currently have a rating of 80% on a couple of different problems. I filed a claim to the VA about having stomach problems that started when I was in Iraq. My medical records show that I was treated while in Iraq, and also from the VA starting Dec 05. In December of 05, I was given an upper GI showing their was a problem, put on meds for it. Continuous Medication
I read in another forum that if you are on a continuous medication for life, let's say atenolol for BP, does that get you a rating of 10%. You can only receive this rating once, no matter how many different meds you are on. This would be a nice compensation if it is actually true. Thank you all and continue with the great support.

How Is An 1151 Claim Decided, By Whom?
I had an emergency appendectomy by a private surgeon in a private hospital. Two days later, I went to VA clinic for a previously scheduled exam. I complained to the PA of painful cough and coughing up a bit of blood. He sent me for a chest X-ray, and they did routine blood labs, supposedly checked OK. My painful cough with blood got worse. Two days after the VA visit, the PA called to tell me the lab results and X-ray checked good. Three hours later, I was in the Emergency Room of the local hospital with severe chest pain, extremely painful shallow breathing, and blood pressure that was like 200/120 or something crazy. Another Fusion Question
Hello I had a meeting with My nuero surgeon at VA today and the surgeon told me he wanted an answer would I consider having 4 disc replaced and screws and bars in my back and fused I have really bad artheritis also. I just had a stimulator in Nov and after all of that now the Surgeon opts out for this. Me I told him I owuld have to think about it as the surgery is going to be a minimum of 6 hours and I am wondering who has had this with 4 disc being replaced? I know everyone is different but I am at my wits end with pain and the VA is not the greatest at pain managment. Any thoughts shoot me an e-mail. Lumbar Fusion - One Level
I just want to see if I understand the regs properly - please correct me if I am reading it wrong. I had a diskectomy just over three months ago and never got better. Recent post-op Myleogram showed same disk reruptured again on both sides so I had a fusion at the L4-L5 level. If I am reading the regs correctly... the compensation is still based on range of motion (pain of motion) and not ankylosis since the entire lumbar section is not fused. Is this correct? Doesn't the fusion automatically limit ROM (two weeks post-op- definately does)? Any back fusion people on the site- how are you doing long- term? Thanks for any replies. 81150 CAFB

Conflict Of Interest
:) Well bad news for me for my C&P exam, the regional office said that since I work for the VA I can not be seen at the VA hospital where I work for any service connected related issues. The regional office stated that "It is a conflict of intrest" so my current C&P exam is no longer valed and I will be given a new appointment at the nearest VA Hospital. Also I can not been seen as an outpatient for any service connected injuries, letter stated the same thing again so I can be seen as an outpatient but it can not be service connected, (Non Service Connected). what is the VA coming too? :)
