Sleep Apnea/cpap
I am active duty and was just recently diagnosed with sleep apnea and am currently on a CPAP machine. My question is: Will the VA require me to get another sleep study through their system or do they accept the results as is since it is obviously SC? I read someone's post where they had sleep apnea documented in their records (while on active duty), along with using a CPAP machine for a couple of years, but the VA had them redo a sleep study (through the VA) when this person retired. That doesn't make sense to me, so I'm just trying to find out if they can really do that.

Copd,hyperthyroidism, Gerd
I received a call from the VSR or someone similar asking me if I would like to file a claim for COPD,GERD and Hyperthroidism. I have two claims pending and she was reviewing my medical files and saw these three items. I asked how does this relate to my service 40 years ago. I never thought that these things were caused by my service in the army. I don't want to waste the VBA's time and my time with frivolous claims. If there is a nexus, that is fine but if there isn't a nexus than forget it. Bill

Diskectomy In 1989
First, great to find this site. I had this posted elsewhere, but I didn't know if was in the right place. My question is regarding my back. In 1989, while in the USAF (1987-1991), I had an L4-L5 diskectomy (right side) and 20 years later I am currently recovering post-op for a micro-laminectomy/diskectomy on the left side along with removal of a bone spur...the imaging (MRI, myleogram w/ C-T scan) also showed additional protrusion on the right at L4-L5 and mild protusion at L5-S1 with possible nerve displacement. The private neurosurgen was only concerned with the l4-l5 issue and only does micro. He said that it would add a couple of hours to the surgery to reconstruc…

Hearing Loss/hearing Aids
I have a question and I need to know how to proceed to file for service conected for hearing loss now I have Hearing Aids issued by the VA. My Question is I was turned down by the VA for service connected hearing loss even having spent 22 years in the marines as a Tank Crewman. My C&P exam stated that I was 1 decibel Off during my exam in order to be service conected for bi-laderal hearing loss. C&P has noted that and is stated in my letter that they (C&P) does state I do have hearing loss due to military service. So I had my outpatient VA Doctor give me a consult for another hearing exam which I did see a ear, nose and throat Doctor at the VA and from reading…

Court Of Appeals Rules In Favor Of Veteran - New Legal Precedent
From the ruling, and I believe this says it all (which is what veterans have been arguing all along): Veteran's disability benefits are nondiscretionary, statutorily mandated benefits. A veteran is entitled to disability benefits upon a showing that he meets the eligibility requirements set forth in the governing statutes and regulations. We conclude that such entitlement to benefits is a property interest protected by the Due Process Clause of the Fifth Amendment to the United States Constitution. Sometimes it takes years to win a claim, but as proven here it is well worth it to continue that fight and never give up, never surrender to the incompetence and gross m…

Mrvets Cp Leg Doctor Called After His Exam
Heres an update to the saga:MrVet went for his CP leg exam- which I guess because they verified his stressors after 12 years-anywoo-the doctor called the house the next day to tell him he has "arthuritis" in his knee and ankle- and he should have his pc doc-take a look(the same one who thought he had bladder cancer)when we asked him how his leg exam is he said he couldnt comment on that because it is for CP-so do they consider the mid-leg part of the leg? because the knee disorder has already been dropped-and is the ankle considered part of the leg? to us it is but to them I'm not sure of the lingo? Danke Schoen!

ptsd Has Anyone Noticed This Before?
Mrvet had his left leg CP exam which we believe went ok-the examiner was very thorough-perhaps we are thinking is there a difference in what could be a exam for a rating?(claim is 12 years old next week) the examiner said he was there to rate Mrvet --also the past CP PTSD exams were scheduled for a least 4 hours-this one is 60 mins, as was the leg exam-for some reason the attys. wish to attend the PTSD/exam next week-never heard of that before/could this finally be over?- have they finally realized everything has been proven? and maybe they finally realize he's been disabled due to PTSD with SS and hasnt been able to work since 01'--which didnt seem to surface much during…
