tdiu Effective Date Of Tdiu
I was awarded TDIU in March 2010......paid retro to the date of my TDIU application from Sep 2009. I haven't worked since Dec 2005......with that being said, I need to know the CFR with the sub-paragraph for my NOD that states that I can go back from one year of the date of the IU application. I hope you can understand what I'm asking for! Thanks for the help and advice! B6

Iu Denied, Some Help
I was not fit for voc rehab, have a gaf in the 30s, cannot return to work. Applied for IU but it was denied because i am received 50% pay through short/long term disability. No one mentioned this was a show stopper while applying. The company I work for has replaced my position. I am awaiting SSD, and provided letters that were never reviewed stating. 1. that I should have been medically retired due to my condition. 2 that i am unemployable. Is there anything I can do? I cannot stop one payment and hope to receive another. I am 70% right now. The reasoning was that my company still condsiders me an employee, so the va considers me fit for employment.

Dean Please Read
I happen to come across Dean's post, and part C2 interest me very much. This may really help me as I had a pre-existing condition when I was invited to join the military. I always thought that I had to prove the military aggravated the condition, which to me is extremely hard to do. Now, the VA must provide evidence that it was not aggravated by the service. My condition is Hereditary Angioedema, but I did not know the name of the condition prior to my military service entrance exams.But, stated very clearly that I had a medical problem. ptsd Retro Pay Question
I filed for TDIU on Dec 9, 2008. It was denied on Oct. 26th 2009. Towards the end of last month I put in a new claim for reconsideration for TDIU and TBI. Am I correct to assume that the retro pay will go back to the date of Dec 9,2008? Or will it go back to the date of when I had to quit my job because of my PTSD, which was in November of 2008? Also, will the VA see that I applied for TDIU in 2008 or will they only see the new date of file for reconsideration which is August 25,2010? I was also awarded SSDI on Jan 5,2009 because of my PTSD. They only list it as "anxiety and mood disorder" but my records clearly show that its PTSD that I was complaining about, from bein…

tdiu Va Needs Vaf21-8940
My last post got kinda long, so I decided to post a new topic/thread, even though my previous situation still continues [i already meet the SC requirement of TDIU]... Here is the lastest in my struggle: Last week I received a letter from the Seattle VARO stating they needed VAF 21-8940 [TDIU form] to be completed and returned if I wanted to be considered for TDIU. Problem is, I sent it to them with my original claim back in October 2009. I even called my POA [the DAV] and they verified that the form was in my file and was date stamped October 29,2009. ptsd Tdiu ?
I've been reading all the TDIU info in this forum, and I know the importance on filing, but my question is this. I just recently was granted SC for PTSD by the BVA and I am waiting now for my rating from the RO. Should I wait to see what my rating is going to be? I have heard that it could interfere with the process, is this true? I am hoping for a rating no less than 50% and 70% would be nice. I do have employer documentation to be used for unemployability. So confused! I've seen on the forums that while waiting for my rating, since I'm not working, that I should go ahead and apply for TDIU, as it hurts nothing. But I dug into too many specific and personal stories here on the forums and got myself confused. So this is all hypothetical...let's say that I met the medical criteria for these benefits at some point...here are my questions? 1. ptsd Ssdi Granted, But Not On Appealed Tdiu
This week we received confirmation, approval on getting SSDI going back to last summer. (ss approval letter arrived yesterday) Lots happening this week. According to ebenefits,va,gov, a decision was made too. We believe we are getting a rejection for TDiU from the VA this week or early next week. (we filed for ptsd increase and also filed for tdiu, Jan, 2010.) Today, VA, according to (ebenefits,va,gov access) said a decision was made. We phoned and no more info is available and we have to wait for the mail. They said no more info on phone is available and we just have to wait for mail. argggghhhh. tdiu Filing For Individual Unemployability
Filed July 29, 2010 we received their reply August 5, 2010. Question, Regional Office called this morning and said they needed additional information? I thought that all they needed was a Form 21-8940 which I have a copy of. I did however send a cover letter stating his recent increases from 70% to 90%. What else is needed? Tried to call but you all know the routine, press 1, wait, press whatever. She's supposed to call back this afternoon. I need to bale hay and e does not do well over the phone. I met a vet via emails on the old hadit board in the days when I could handle email claims. He dealt with the same capricious and arbitrary RO I did. His claim was at the VARO for NINE YEARS!!! I thought my seven years there was awful but 9 years passed and he was transferred to the BVA. I just heard from him. He was granted TDIU by the BVA and they also deferred some other issues which I think had been previously granted but he went after a better EED.They are considering 1991 EED.and maybe even 1985.
