ptsd 100% Temporary
I'M ON TEMPORARY 100% DISABILITY FOR PROSTATE CANCER, PTSD 50%, TINNITIS 10% AND HEARING LOSS 0%. PROSTATE CANCER LONGER THAN FIVE YEARS. VA PROPOSED A REDUCTION TO 60% FOR RESIDUALS, BRINGING THE PROPOSED TOTAL TO 80%. I'M FIGHTING THE PROPOSED REDUCTION. IF I DO NOT WIN THE REDUCTION, WHEN WILL I BE ABLE TO FILE FOR IU? WILL IT AUTOMATICALLY BE CONSIDERED WITH THE REDUCTION, OR WILL I HAVE TO WAIT AND FILE AFTER THE NOTIFICATION. HOPEFULLY I WILL WIN AND DON'T HAVE TO FILE, BUT I WOULD LIKE TO BE PREPARED.

ptsd This Is My Evidence So Far. Is It Good?
I've read here that the more evidence the better. I just wanted to get an idea of how my evidence looks so far. I'm rated 50% for major depression and I'm also trying to get that raised. I recently had a C&P for PTSD with a contract doctor. In her report she said, "He is enrolled in school; he is struggling to perform adequately in his academics in order to complete this program. Personally, I am impressed he can complete academic tasks in his current psychological state. He is unemployed because he could not meet the demands and responsibilities required by his work situation. He resigned his last position before he was fired." She alsomentioned bad memory, conc…

ptsd Ptsd 70% Paying 100% Iu
Hello folks- Hoping all is well. RE: TDIU PT. I recently filed a 21-8940 in request of a TDIU PT rating (against my VSO'S advice) to get an early efective date and maybe approval. I also applied for AA for my disabled wife. long story short- I was approved for AA for my wife and denied TDIU PT. YEA!!!! Reason ( their words verbatum) IU award was denied. reason being a review of your file shows that you were granted and awarded IU effective 12/01/08. therefore, the request you submitted on VA form21-8940 Veteran's application for increased compensation based on unemployability reieved on 08/20/10 is not considered a valid claim. You are being paid at the 100…

tdiu Bva Explanation Of Iu
http://www4.va.gov/vetapp09/files6/0947986.txt Finally, the service-connected disabilities must be so severe as to produce unemployability, in and of themselves, without regard to unemployability attributable to age of the veteran or to other disabilities for which service connection has not been granted. 38 C.F.R. § 3.341. That is, TDIU may not be assigned if unemployability is a product of advanced age, or of other nonservice-connected disabilities, rather than a result of functional impairment due solely to service-connected disabilities. 38 C.F.R. § 4.19.

tdiu On Tdiu-Just Got Employment Questionnaire
I started receiving TDIU about two years ago. Now 65, on Social Security(intially social security disabled at age 64).Just got Employment Questionnaire from VA.I was self employed before getting TDIU .I have picked up a little work the past two years,VERY limited, part time, odd jobs on my own.I might have made @ 6000$ doing odd jobs for cash.(1) Is it normal to have a questionnaire sent after @ two years time from getting TDIU.Has this happened to any of you?(2) My understanding is that it is ok to do VERY limited work,as long as the $ earned is very limited and below a certain level.Need some reassurance.I am a little paranoid. It was so difficult getting TDIU and took so…

ptsd Time For A New Vso?
Hi Everyone Once Again, I am currently going through the process for TDIU with the VA. (If you want to catch up to where I'm at, you can check my older posts, a lot of info) My problem I believe is my VSO as of lately. When I first began the C&P Process about roughly 2 years ago, he was awesome, he had great advice, and seemed to really know his stuff. (He was new to the office, and I didn't know what I know now) Anyways, the first mistake he seems to have made was telling me I HAD to wait to file for TDIU until I have recieved at least a 70% rating. I know this is incorrect due to other posts on this site. The second mistake, and most recent as I just found out…

Va Is In Denial Mode What Should I Do
Where to begin? I was originally injured on the flight deck of the USS John F. Kennedy august of 1980, In the accident I was struck just above the buttocks by a 8 inch x 8 inch by 9 foot long oak wooden beam traveling about 50 miles per hour slamming me to the deck so hard that it shattered my protective helmet as well as striking me flat on my heel causing a compound fracture of my right tibia / fibula my toe hit my knee. The only reason it didn't break my back was that I was leaning into the jet blast of 2 f-14's that were taking off at the time. I was rated at 10% disabled for the fracture and nothing else, although they operated on my knee to install a tibia nail and …

tdiu Should I File An Appeal For Tdiu
OK, in 2001 I was deemed to be in such poor shape my employer asked me to file for SSI. At the time I filed I had a broken leg, and sever back problems. I was imediatly awarded SSDI, and have not worked since 10/30/01. In 2003 I filed with the VA because my back injury was SC, I was awarded 20%. I appealed in 2005 was awarded 40%. I then asked for an increase, and now (2010) I am 50% for back 10% ridiculopathy for each leg, 10% for tinnitus, and 30% for depression from injuries and inability to work. Total combined SC of 70%. There was even a statement from my last examining Dr. stating it is unlikely that I could obtain or hold any type of employment. My IU was denied, b…

Frustrated
I received my employment questionaire from the VA back in August. This was the first year that I had to fill it out since I was just granted IU last year in Feb O9. I mailed it in and made a copy for my records. Then I got to thinking about what some have said on this site, about the VA claiming they never got it. I then made another copy and sent it certified, thinking that was the best way. Well last week I get a letter from the VA stating since they did not receive my questionaire; they were going to reduce my award back to the 80% instead of the IU. I couldn't believe it. So I took the copy that I had with the certified label, and printed out when it was received by …
