Tricare Prime And Medicare A & B
Good morning all; I called Tricare yesterday with a question. I was told something I did not know and thought it was worth sharing here. I was told by all the representatives at Tricare that I had called that when my Medicare A& B started I was automatically moved to Tricare For Life whether I was 65 or younger. Well, I found out yesterday that is not correct. The representative I spoke to yesterday was new and not sure of this and put me on hold while she called the higher ups. She came back on the phone and told me that a person can stay on Tricare Prime up til the age of 65 even if they have Medicare A & B with NO Tricare Prime monthly fees. When…

Dic Question
Berta, I'm 100% P/T. On the new (12-1-11)DIC rate sheet it shows my spouse can get this compensation if I've been 100-p/t for at least 8 yrs.even though I didn't die from the S/C. Is that a change from the 10 yr. deal? Also, would she get my whole 100% or the lesser rate they show in the table of $1,195 + $254 ? If she had to fill out the DIC forms, who would she go to in order to do that? Jeff

Vcaa Errors And Dic Denials
Hupp V Nicholson was a very important decision regarding DIC claims, filed since 2007. It caused VCAA letters for DIC claims to contain certain specifics as found in this BVA remand: “In addition, the Board observes that in Hupp v. Nicholson, 21 Vet App 342 (2007) the United States Court of Appeals for Veterans Claims (Court) expanded the Veterans Claims Assistance Act of 2000 (VCAA) notice requirements for a DIC claim. In Hupp, the Court held that, when adjudicating a claim for DIC, VA must perform a different analysis depending upon whether a Veteran was service-connected for a disability during his or her lifetime. The Court concluded that, in gene…

http://www.tampabay.com/news/military/veterans/st-petersburg-woman-solves-mystery-of-dads-1958-death/1207773 This story and an award to the widow from VA is a testament to the fact that Nothing is impossible regarding VA claims. Almost 53 years after her husband's death, the widow with her daughter's help, filed for DIC. The retro was based on the date of the January 2010 claim. The daughter did considerable research as well as access old papers her father had saved. She contacted an expert in the field as well. The widow's DIC award letter came this past Friday.

Common Law And Deemed Valid Marriages And
In some cases VA will recognize a common law surviving spouse for DIC purposes. "The laws dictate that to be recognized as the veteran's surviving spouse for the purpose of establishing entitlement to VA benefits, the appellant must be a person of the opposite sex who was the spouse of a veteran at the time of the veteran's death, and who lived with the veteran continuously from the date of marriage to the date of the veteran's death (except where there was a separation which was due to the misconduct of, or procured by, the veteran without the fault of the spouse) and has not remarried." 38 U.S.C.A. § 101(3); 38 C.F.R. § 3.50(b)(1). Cautious Optimism Re: Sbp/dic Offset?
The 2012 Defense Authorization Act (HR 1540) passed the House way earlier this year. The Senate version, with amendments, passed on December 1. One amendment struck down the offset between Dependents Indemnity Compensation (DIC) and Survivors Benefit Plan (SBP) payments . The bill was returned to the House for reconciliation between the two versions. Reconciliation was completed yesterday. Without my commenting on some disturbing aspects of the 2012 Defense Bill, the bill is going to President Obama. Recent indications are that the Administration will not veto the bill. Here is a link to the text of HR 1540, Title VI Subtitle C Section 635 : http://…

The Reps Benefit To
This benefit is often misunderstood by our vet reps. My former reps didn't have a single clue of what it was when I mentioned it to them. The application for REPS is at the back of the formal 21-534 DIC claim form. Many widows/widowers may not think they are eligible for this and disregard the form. Other survivors - to include some student children as explained on the REPS application form might be getting their first DIC award ever due to the 3 new AO presumptives under Nehmer for deaths that VA has service connected many many years after the veteran has died. They could be eligible for REPS if they meet the SSA criteria as in the "Who is eligible" state…
