  1. Did you have a Veteran Service Officer or VSO. id you used the AL or DAV, they have an office at Regional office and had to see the decision for it is procedure for them to see it. Call them up and ask them to dig it out of your file. J

  3. A Vso has no reason to agree with a VA decision. You are not filing a claim to Amvets. So many Service Officers do things like this and totally screw up a Veterans claim. If I were you I would tell this AMVET rep that if any action he has done has effected the outcome of your claim that you can and will sue them. We have a member here who has actually sued a VSO for their actions. J
  4. Just ask your Primary Doc for a Neurosurgury consult. The Neurosurgeon will order the test. How long has it been since your last MRI? Was it done at the VA? I had to go around with them too. Be straight up with them. Tell them something is wrong. Do read Rentalguy1's Spine Repository. This man has but a lot of time into it and it is a great tool for a Vet to use. Good luck. J
  5. An easier way is to find a Attorney who does nothing but Social Security claims and ask them who they use for Independant medical Opinions or examinations. They usually use Occupational Doctors. These Docs know how to put your disability into perspective. J
  6. In your condition with the GAF score and having to use a walker, I think the ALJ will make a on the spot decision (Bench) on your case. If he or she does not then there is something wrong with them.

  8. That is the norm for a 48 year old in Kentucky. This is not SSA making a decision, It is the Disibility Determination Service in Frankfort. These folks will deny any claim. This happened to me. I was denied twice before I got an attorney. I still had to wait to get an ALJ hearing. It is time to get an attorney as your road to retirement has just became laiden with pot holes and land mines. My attorney told me that he has seen Ky DDS deny several people who had terminal cancer. He has even seen Judges apologize for the actions of these people. The reason for the denial is that you are in your forties and to them It does not matter what is wrong with you. Good Luck. John
  9. Yes sir, your DAV rep actually is doing his job. He has seen your award. It has to be viewed by him so they can get up and do the look what I did for this guy boogie. Expect the money to hit the bank before the letter arrives. Believe me, a when a 60 K check slapped my account I was floored. Congrats. You deserve it. J

  11. This sounds like he has an inferred issue and they already are aware of it. I have seen so me lightning fast responses. Just today with 2 Vets I am helping. One actully called last week and got his stressor verified within 5 days. They actually verified this other Vet's info. I think the heat is on and whome it is cooking they will be on t h eball until the heat is turned off. Then it is back to BAU. Business as usual. Maybe things are looking up. J

  15. Wouldnt it be nice if congress would make the VA go back and compare effetive dates of claims VS the filing dates. Ensure t hey pay retro according to the date the original claims were filed based on a Nationwide Cue and VA perejudice for either misleading, Shredding, or bypassing evidence. Some cases would go back to the discharge of a Veteran. That would fix this problem. Hit them in the pocket book. Jmho. J
  16. Steve, from the looks of these replys, I dont think these folks like the idea of presenting for interview. The main reasons are well posted. I know for a fact that the News headlines state Iraqui Freeedom this and that. I am not opposed to that. In World War 2 we lost 400,000 souls to battle along with millions injured. In Viet Nam we lost 40 thousand souls and around 200,000 injured. I dont know how many were lost in GW1, GW2 we have lost around 4000 souls with thousands more injured. Why single out a spacific group? War is deadly and we all have made sacrifices on one way or the other. We deal with it on a daily basis. Everyone on this board has made sacrafices. Most do not want to talk about it. Now if you ask them for a funny story from their service days then you may get some replies. I believe you would be better off soliciting the Verteran Service Organizations for some Gung Ho folks to talk. J
  17. They did a wave off but t he pilot ws new. Instead of using the rudder the pilot inverted the plane and slammed into the tower. One of our members was actually on the flight deck working a catapult when this occurred. Ironically this pilot's younger brother also went into the Navy and was killed 9-11-01 while working at the Pentagon. J

  19. I get mine on the 2nd wed of each month. It does depend onthe Birthday (day of the month) It was implemented to relieve the rush when all checks were sent out at once. J
  20. Iu can be either P and T or not P and T also. I would be pressed to get P and T. on the upside, with IU one cannot work. If you are 100 percent schedular, you can still work. One step to getting P and T is for the Vet to be awarded SSDI for Sc issues. That ties the VA's hands most of the time. Good Luck J
  21. Johnson, you are currently 100 percent. It appears to me you were paid from the day after separation from the Navy. Do you know what the 100 percent rating is for? If you have other issues that can be attributed to service, then you may be able to pursue additional benefits like Special monthly compensation for serious disabilities. You should get your records and also get an Idependant medical opinion for the Heart issue. Sone infections are known to lead to heart diseases. You can directly ask for them from Saint Louis and bypass the VA. Hope this helps. J
  22. Step 1: The VA takes your medical over the day after discharge. There is no compensation for any disability while on active duty. They will pay you from the date of separation. Did you have the issue when you went into service? Help us to understand this question a little more. Thanks J

  24. Rich, I think they will apply a 30 percent ratingto the foot and add the 10 percent for the scar. I also think they rate your back at 60, then the foot at 30 and scar at 10.
