  1. An employment handicap is a medical condition that you have that will hinder you in the Job Market. For example, you have a bad back. You cannot work carrying blocks but you can be a doll stuffer. J
  2. You might not need IU if your heart and Spine are severe enough. You may get 100 percent. Goo dluck. I hope all goes well. J

  5. The DAV and the American Legion both have a records keeping policy and each Veteran has a folder that they put the info inside. That is their policy. Now we know they have a policy my question would be to them: Are you following that policy. Some do and some dont. It would be worth our time to dig some policies as record retention up. Ths entire mess is like trying to boil Nitro. As soon as it starts to expand, Look out. J
  6. Tom, if you did nit appeal all these years the only recourse is to find a CUE in thr otiginal decision. A Cue is a hard thing to prove but it can be done. Good luck. If you find a way to get the crickets ut of your ears let me know. J
  7. That is a tossup. The BVA has the options of: 1 Remand back to RO. 3.Decide the Appeal. Reverse a RO decision. 3.Remand to the AMC in Washington. 4.Concurring with the RO. Deny the appeal. Personally I think the board remands way too much. J
  8. Stretch, Good Idea. Here is a Sad case from My hometown. Breathitt couple sentenced in baby's death Herald-Leader Staff Report A Breathitt County couple were found guilty of second-degree manslaughter Wednesday in the 2007 death of their baby. Ten-month-old Braxton Miller died of a methadone overdose on June 6, 2007. Karen R. Miller, 25, was sentenced to eight years. Robert Miller, 34, received a 10-year sentence. After the baby's death, Robert Miller told authorities that he had been cleaning a couch and that a pill came out of the couch while he was cleaning. He said the pill fell to the floor and he turned away momentarily and the pill was gone. He said he assumed it had fallen down a vent. The baby was fed and put to bed about 9:30 or 10 that night. The parents took the child to the hospital after they found him not breathing about 2 a.m. --------------------------------------------------------------------------------

  11. Another important point is to get a good IMO from an Occupational Doc. A good doc will tell you that there are things you can do, You just cant do them them over and over again. Point number 2: SSA is very good and treats prople a lot better than the VA. The Bad part of Social Security is not even Federal Employees. It is your own states DDS department where the denials come from. J
  12. I wonder if the VSO's know what is really going on? They only have offices in the same place? Really makes you speculate about it. I am interestes in the scope of thi sproblem. Of course the biggest question is how long has it been going on. I think for several years. You Vets with active claims, It would be wise to be redundant and send in more than 1 copy of anything. This has the potential to really get ugly in the next couple of weeks. J
  13. The way they look at it is this. If your check comes from a DFAS center and you are medically retired from service then you can fly. If you have the blue id CARD. The Tan Card looks just like the issued dependant ID card and SPACE A will not allow it. J
  14. You can fly space available on Coast Guard flights only. Perhaps someday, you can fly regular space available. 0. May 100% DAV use TML? Most military lodging units accept 100% DAV (Disabled American Veterans) on a Space-A basis if it is possible. In fact the Hale Koa Hotel, AFRC specifically mentions 100% DAV in their brochure as being eligible. One problem that 100% DAV have encountered has been caused by the color of their ID Card (DD-1173). It is the same color (buff or butterscotch) as carried by family members. Many times 100% DAV are turned away from facilities which require family members to be accompanied by their sponsor. The "ID card-checking authority" assumes this 100% DAV is not a military member but a "dependent" or family member. The DoD is now issuing a new card, DD Form 2765, Uniformed Services Identification and Privilege Card to 100% DAVs in lieu of the older DD Form 1173. The new card is issued to sponsors, other than active duty military members, who are entitled to uniformed services benefits and privileges. Editor's Note: This new card, DD Form 2765 does not change the fact that 100% DAVs are not entitled to fly Space-A air on DoD aircraft. They may fly Space-A on DoT (U.S. Coast Guard) aircraft.

  17. News reports a new stimulus package may be introduced in the comming weeks. The Fed Secretary has stated it needed to be a substantial one in order to jump start the sluggish economy. Report says 150 billion but I think it will be substantially larger. They may attempt to do it before thge end of the year as the economy needs immediate relief from the stress of the financial crisis. Democrats in Congress are also pushing efforts to assemble a second economic stimulus program that could total $150 billion or more. On Monday, Fed Chairman Ben Bernanke said a "significant" stimulus package is appropriate. The White House has yet to endorse the idea, but has said President Bush was at least willing to consider a second stimulus measure.
  18. William, did you get the entire exam? On the next to the last page is the Requested opinion. Did you get a copy of that? The opinion should say your conditions are as least as likely as not related to an incident in service. That is the 50/50 threshold. Most likely is 75 percent and was due to means the doc is 100 percent sure. I would challenge the Tatoo issue now. They are setting you up to fail on the Hep claim. The RO may have even came up with that one in the Exam request. The RO went as far as to say I fractured my Clavicle as a child that caused all of my cervical and thoracic problems. Keep on top of this one. J
  19. Call your local VA and talk to billing. Ask them to Audit your account. Sshow them the award letter and the effective date to the folks who do the means test. You need to update and make sure your in the system at 50 percent anyway.. The check will be slow in getting there but it will come.
  20. Berta is as uaual correct. Kris, march those fine folks to the nearest SS office and take a copy of the death certificate along. She should start to draw that rather quickly. J
  21. Dont forget that 50 puts you inthe Pri group 1 and wout can ask for refunds of all med copays and ect back to the effective date. J
  22. She can call the VA herself to find out what is available. If she can prove the Veterans heart condition was a result or secondary result of a disability from a disease in Service then she can file for DIC. I strongly you get her onboard Hadit. There are some folks who have been through it and can help. For example, The Veteran was diagnosed or had High Blood Pressure in service. She should start by getting her Husbands service medical record and VA treatment records if any. I assume She has been determined the executor of his estate.   23. Do you have a POA at huntington? DAV. AL or someone else. If you do get them onthe horn and insist they check into your claim. All they have to do is walk down the hall. I had a claim decided by them several years ago. They were fairly good but still lowballed the rating which is BAU. (Business as usual) One of our members just received a very large award through the Huntington Office. Maybe she will chime in and give you some contact information.
