  1. To answer your question, your files are computerized and stored by date. The C and P docs can look at them at any time after he receives notice of exam. Mnay times they know what you are going to get before you walk in the room. I had a BP exam and the Examiner did his homework. It was done before I went in. Sc for HTN and heart disease. J
  2. Cumulative evidence is something that repeats or is the exact same as evidence in the file and is not new and material. For example, Doc 1 states that Vet has had headaches from 1975. Doc 2 states the same thing. That is the cumulative part. New and material is evidence that has not been considered or is new, C and P exam, or an MD opinion with an etiology for a condition.

  4. I have never had a problem with the system. It takes people to apply the system. As far as Health care and other benefits like Home Loans, Life insurance the people will bend over backwards to help. When it comes to claims adjudication on how I can help Veterans, but no. It has evolved into a negative system and people administer it. J
  5. Be Careful my friend. You are correct in your assumptions but they will never admit it. Dont gave Hill an opportunity to take off on the date you will be there. I walked in once. I felt like I was being persecuted. Almost got a free ride in a ford with Lights on top. What they are doing is rediculous. Hang in there. J
  6. Yoggie, you have a 20 day notice period for your court date. Your attoeney should call you for a sit down meeting to discuss your case. It is imparative that Social security has every shred of evidence. J
  7. Ron, is this over your Heart Disease? If it is, can you give me the details of current sc and what you filed for. J
  8. If the insurance company is paying, why are you even going to the VA. Go outside. You will be treated better. J

Ron, if you are SC'd for heart disease and you have a electro shocking device, then look at this: 7011 Ventricular arrhythmias (sustained): For indefinite period from date of hospital admission for initial evaluation and medical therapy for a sustained ventricular arrhythmia, or; for indefinite period from date of hospital admission for ventricular aneurysmectomy, or; with an automatic implantable Cardioverter-Defibrillator (AICD) in place 100 Dont just ask for the increase, demand it per the regs. J
  10. I have a different view. We can be politically correct and be nice to him. Personally If he gave me bad advice I would be nice until I got the POA letter to revoke turned in. Then I would call him and tell him he is fired for giving bad advice. It is not his job to quote percentages. It is his job to assist a Veteran seeking an increase. It is not his job to discourage anyone seeking assistance. How can you trust anyone like that to handle something as important as a persons livlyhood. I have 2 initials for you AL. J

  12. The loan was the VA's idea trying to help you out and keep you from getting your power shut off. The request will not speed up an appeal or a claim but these folks are showing a little bit of humanity by offering the loan. Belle, I have seen Veterans have to take Bankruptcy, lose their homes, lose everything. I have seen them go from being suicidal to being on top of the world in a days time. This game is without a doubt the most stressful event you will ever encounter. J
  13. At that time, you had been married for over 20 years. You get along well with your spouse and two children, and had a number of friends. By your own account, you had quit working in a public place in 1983 in favor of working from home. A treatment record of Dr. Pxxx dated August 31, 1983, noted you worked at a high stress job at English Mxxxx. However, there is no indication that you were having trouble handling that stress, several personal events occurred over the years, causing acute increase in anxiety. Dr. Payxx treatment record states: I was working at a high stress job and under a great deal of stress and strain. Activity level low and is working at home. Betty, I believe the VA is hung up on one statement. Working at home. Were you holding down a job at home back then. I believe the Doc meant Housework. You can question that and have the Doc clarify it in your NOD with a statement from him. I believe that is the only thing that you need to succeed. John
  14. The most important aspect of your examination will be your Range of motion and incapacitating episodes. The Range of motion is your ability to bend forward, backward, side to side. The VA calls it flexion, extension. Incapicitating episodes is Doctors prescribed bed rest or hospitilizations. Spinal fusion is considered an Incapacitating episode. The Lower the degree you are able to bend the higher the rating. Be sure to show any radicular signs. Pain radiating to another extremity, Sciatica, Leg numbness, weakness. Be sure to get a copy of the exam about a week to 2 weeks after it is done at the medical records department. You will get a good idea of how it went when you get the copy. Also be advised that the VA will spacifically ask the Doc in leading question format about your issues. A good Doc wont play that game. Also look for the following terminology. Was not due to: 100 percent against less likely than not: 75 percent against At least as likely as not: 50/50 More likely than not: 75 percent sure Was due to: 100 percent sure. Good luck.   17. It is still based ont he CPI and we will know the exact amount in less than 3 weeks. It will be considerbally higher than 2.5 percent. 6 percent or a couple of points lower. J
  18. You may be tetering on the edge of needing it. You need to get it treated before you damage your heart. Sleep Apnea can cause deadly things to occur.
  19. Get an appt with your DOC. 02 sats at 88 percent can be severe. J
  20. From What I have read, ALS is a presumptive condition not restricted by any time limitations after discharge. If a person needs to file a DIC claim now is the time to file. It is very sad but there will be several DIC claims filed. J

  24. I was prescribed Zomig by VA Neurology. I am also Sc for Heart Disease and HTN. I started to take one and I glanced at the Box. It said do not take if you have heart disease or Severe HTN. I looked it up and it has been known to cause fatal MI's. Why would they prescribe this med to someone with the risk factors? J
