  1. never "assume" anything you get your feelings hurt that way and then you have a tendency to get mad, if you asked for a raise because your symptoms have gotten worse since you were rated at 70% then they can leave the rating of 70% to the date you filed and asked for an increase just the way it is, and only pay you the TDIU or 100% rate from the date of the new request, if on the other hand you filed a NOD to the 70% then yes they would go back to the original filing date, not every claim is automatically raised to the original file date for retro, it all depends on how the request was made by the vet or their VSO. remember how assume breaks down ass/ u/ me expect nothing so anything is a win and don't spend it before you see it......

Carlie that was a forwarded message from one of the lead plaintiffs Eric Muth I was a middle man for putting the other test vets in touch with Eric and the lawyers, I was not one of the plaintiffs, I was already SC at 100% for PTSD and I could see no gain in the lawsuit, except for them to publicly admit they did it, but that was never going to really happen where they would accept liability for damages. The Ferris Doctrine has them protected nine ways from Sunday and they know it, until Ferris is put out of it's misery the government will never be held liable for damage done to veterans and active duty personnel. Yes my birthday is still August 25th I hope to be blowing out birthday candles for years yet to come

Berta, you do remember that I put most of the veterans together that were used as the 6 plaitfiffs, I was posting stuff everywhere back in 2005 and 2006, most of them would see the posts here, VBN, and Daily Kos and some of the magazine articlles, and I would send them to Eric Muth. I was just as satisfied using my PTSD to get SC and to 100%, some of these guys were determined to make the govt admit they had abused us, and looked at PTSD as the easy "cop out" me I had enough stressors besides being used as a human lab rat that I had no feelings of being "weak" . I have spent the past decade telling myself I should not have "sucked it up" from 1982 when I left active duty to Jan 2003 denying I even had PTSD. My ex wives and kids paid for me "sucking it up" I seem to have ruined everyone's life around me before 2003. I did not make the same mistakes with Dori, she has been to every mental health appointment I have had except the C&Ps when they would not let her in. She goes to all my doctor appts and she has been a 24/7 care giver since I was put out on disability for my heart problems in Oct 2002. Her dad was also a Nam Vet and Korean War veteran so she has lived around PTSD her entire life so she knew what she was getting into, she knows when to pull the rug out from under me and when to let me blow up and vent. I am afraid a lot of the vets who refused to admit they have PTSD from being used as a lab rat will now see their claims denied for mental health reasons related to the human experiemnts at Edgewood Arsenal, Alaska, Alabama, Fort Bragg, and every where else the military did them. They will deny them as being filed only for compensation gains and nothing more, forget all the known toxins they were exposed to, as the VA stated we veterans can NOT prove we had any exposure to a specific toxin at a level high enough to cause a specific medical issue, who cares what the EPA found in the drinking water. I think "pride" will have cost them any shot at compensation. This will probably be the last heard from these veterans, there are no more avenues of attack, the lawyers went down rabbit holes I am amazed they even found,. Paper files at Dugway, into the paer files at Edgewood and Aberdeen, the SOD office files at Fort Detrick, CIA paper files, VA records on tests and substances that was done on VA grounds or the VA provided the substances for the experiments to other agencies. These lawyers went the "extra mile" good thing they had real jobs that paid them while the case meandered thru the system. I think it's time for me to enjoy what few days I have left, my wife is dealing with the VARO trying to get the housing grant so we can expand the bathroom and bedroom. If they grant the housing award then we will finally be able to get mortgage insurance which we would be more than willing to pay for, since we can not buy any type of insurance, life, medical or mortgage because of pre-existing conditions, some of them SC and some not but the SC ones are the only relevant part of this, because of the PTSD and cardiac issues I can't buy any insurance so now we see if we can't get it from the VA. It is sad that once we become SC we can not buy insurance on the "free market" and the VA severly limits what is available from them to purchase. Me I am enjoying the days I wake up still breathing. The estimate was 5-6 months after my diagnosis for end stage congestive heart failure. They made that diagnosis in April 2011, I am way past that esttimate now, so I have come to the realization that the doctors don't know any more about how long I have left than I do, the VA raters do etc. I will push myself to keep doing what I want and not what anyone else wants. I hope the house passes the caregivers bill that the Senate just passed that will allow all era veterans to be eligible for the monthly stipend, my wife will qualify for it, she has EARNED it.
  4. Our case was about Moral Bankruptcy and anyone, other than the legal system, could see its validity. It appears we are not going to trial because most of the case has been disposed of in the attached judgment. We prevailed in the Duty to Warn issue, but will they faithfully follow-up? Today is my birthday and it is not a happy one. However, we all need to put this these issues aside now, as there can be no resolution, just bitterness, and that is not good for any of us so I advise that you let it go. I believe the plaintiffs did their best as did the lawyers in this uphill battle. I do not know how long it will take them to post it, to the website where they post the legal documents about the case. It was supposed to start the trial next week, but this was published yesterday. Pretty much it ends that we can now talk about the tests and they promise if they learn in the future that we were harmed by any of the substances they will "notify" us so we can seek treatment. No one did anything wrong, no one will be held accountable, and the vets can go pound sand. Please go back to dying and be quiet while you do it. Thank You

I was rated 100% for PTSD I still appealed the denial of my CAD claim, I have had a stroke and 11 heart attacks since 1992, a failed 3 vessel CABG, 3 failed stents, and denied the heart and lung transplant I need and am on a medicate only regimen. I am on Oxygen 24/7 and am in end stage heart failure. I stayed in appeal on the heart issues from Dec 2002 until BVA granted the claim in April 2009 and I was awarded SMC S effective back to my effective date of my PTSD claim as they finally determined the heart issues were secondary to my PTSD. It ensured my wife would get her DIC benefits and keep her CHAMPVA it is my 2 cents that veterans should make sure that they get their medical problems SC if they can if they can be a cause of death, if they are already 100% and the issue they are fighting for is a 10 -50% issue and will not be a cause of death they are wasting the VA's time and their own and putting at risk the 100% they already have, because every time they open the file, the VA can review all issues. They don't need to open the file unless it is possible to help themselves or their families. Do not just file a claim because you can when it will really not change anything.

  7. even denials have to be approved and need a "signature" do not get your hopes up and when they break your heart you won't have far to fall expect little don't spend anything that is not deposited and wait for the letter or the deposit to be made I have seen to many people hurt by expectations
  8. you have PTSD other than that we can't begin to make a guess on anything from one doctors visits notes if they send you for a C&P you could get a rating anywhere from 30% - 70% if all your other treatment records are similar to that one note stay in treatment take the meds and keep waiting but you should expect to have a C&P exam before they decide your case and then it will be a month or 6 after that before you will see an award letter and any cash
  9. sorry military retirement pay is not tax free I don't know anything about Tricare but I think as long as YOU PAY YOUR FAMILY DEDUCTIBLES then that will stay in effect you still would have that medical care for yourself and your family they don't take away your military IDs you still get to fly Space A the one benefit 100% VA disabled is denied access to your are talking thousands of dollars annually you need to talk to a tax professional before you rashly sign some papers keeping the VA check is in your best interest

You have to be aware that Congress is also complaining about elderly veterans that have heard situations similar to yours and feel that the veterans are attempting to use the TDIU benefit to increase their retirement benefits as nothing more than financial gain, as you stated you had already taken early retirement, and your PTSD appears to be the highest rated issue you have and it is at 50%, so your mental health doctors are probably not making statements that your PTSD symptoms are preventing you from working in your treatment notes. They will look at how long you were employed before you retired, were you having many absences from your job and were they related to your SC medical issues? I know there is not supposed to be age discrimination but people are getting mad across the nation, government employees across all levels are taking it in the wallet and benefit area especially in the past few years, feds have not had a pay raise in what 3 years and it doesn't look good for them for next year either. Veteran benefits have more than doubled in the past 10 years from a little over 20 billion annually in 2000 to over 52 billion in 2013, a lot of it in the sleep apnea issue and PTSD compensation issues. Other than deciding to file for TDIU have you attempted to find gainful employment? I know jobs are hard to find especially for anyone over age 45, Wal Mart can only hire so many door greeters and most vets with PTSD do not make the very best "greeters" and having to smile and welcome people all shift, let alone even having to be around so many people. Most of us shop at Wal Mart at 3 am to avoid people. Are you wanting to return to work and can't because of your disabilities related to service, or are you just trying to improve your financial picture? Only you can answer that, and then file the claim if you really want to work but can't and feel that you have tried and companies are ignoring you due to your health that are SC related and that is what is preventing you from being able to return to work if you had treatment nottes from a mental health doc stating it is a bad idea for you to return to work because of your PTSD symptoms and they support your increase for PTSD and or TDIU. Treatment notes help at tiimes like this if however you quit treatment years ago, meds, counseling etc, then you should not be surprised in the VARO denies a request for TDIU sometimes I wonder who my shrink is writing about when I see my treatment notes some of the statements do not even match what we talked about, I quit smoking 1 Jan 2012 last month he wrote he does not know when I quit just that he thinks it was sometime last year he wrote that I was well groomed and neat, I shave about once every 6 months might get a haircut every year if I think about it and I wear a T shirt, shorts and flip flops, I am on oxygen and spend 23 hours a day either in bed or a wheel chair, so well groomed is not exactly how I would describe me. I believe all vets should file a claim if they think it is legitimate, are some people playing the system of course there are but it is far less than people assume, it is less than 2% most govt programs have some really bad numbers for fraud medicare mostly billing companies not medicare users, food stamps, going to the debit cards has slowed that fraud down though, when they were the monopoly colored coupons, the fraud rate was high. As a mailman I watched people get the coupons in the mail and sell them to someone at the cluster boxes for 50 cents on the dollar. It was disgusting I was told by postal inspectors it wasn't my job to report them. What they did when I filed the report I don't know but I never saw anyone's food stamps cut off. you are the only one who can decide if you have a legit claim if you think it is the right thing to do, then there is years of advice here to process claims thru the VARO, most of us came here out of frustration because the VA was denying claims and the VSOs are mostly useless there are some good ones but most are just wasting chair space. and can do more harm than good for veterans.there are some excellent lawyers that specialize in VA claim appeals after the regional office denies the initial claim and they can get 20% of the award similar to what SSD lawyers can get except VA lawyers have no cap on fee. But 80% back pay of something is a lot better than 100% of nothing, and be prepared to appeal the claim to BVA but I would use a experienced VA lawyer most of them will look at the claim and if they feel they can help you they will, it also helps if they feel they can be paid, or if it is a tilting at the windmills casing and hoping, then most won't take the file, like most people they like to have an income and VA claims is not a quick churn rate, most appeals are taking 3-4 years If I sound rough and am telling you NOT to file a claim I am not I almost started to ignore this like many of the others, sometimes it is best to say nothing but as you see I have posted a lot of times here and knew nothing when I came here over ten years ago I have seen a lot in the past 13 years Philip is one of the best, Berta, Pete 53, Carlie, T Bird has created a great place here I like to think this is the best veterans advice site on the internet, because you will hear the truth here, the good the bad and the ugly and I can say I have never seen anyone here condone a fraudulent claim. Be yourself and tell the truth when dealing with the VA but keep it real and don't volunteer information that can be misconstrued and twisted and used against you, as far as I know and I feel I had a "normal" childhood no I can't explain why my little brother bit me in the azz when he was 4 and I was 6, I was wearing red shorts, he was asleep we were on the road moving between campgrounds and for no apparent reason when he woke up he was hungry and he told mom he thought it was a tomato, now I don't know if that is normal or not but it still hurt but what would a VA shrink do with that? I don't wanna know know so I never volunteered that tid bit from child hood, with my luck they would claim I had a PDO from childhood, but then that does not explain how I could take and give orders as a NCO for almost 20 years does it.   11. some of the C&P docs are okay and it sounds like you got one of the great ones QTC is the company that is run by EX VA Sec Anthony Principi who got the contract to provide C&P exams to veterans, they supposedly provide other services to other companies but I imagine most of their billing is the VA. This is at the same time that Principi is stating that to many veterans are being paid for issues related to old age and not their military service (he is against the presumptives that Shinseki granted for AO) he objects to the damage caused by AO that takes decades to show up and feels that if it was caused by AO it should have showed up decades ago ignoring the fact that for many it did, except that it was the VA ignoring the issue because they wanted to even after Admiral Zumwalt asked them to years ago. the Ranchhand study that much of the IOMs determination for service connection totally ignored cardiac issues from the beginning and never looked at it. Many Nam vets had cardiac issues in their late 20s and 30s and 40s many died Shinkseki was to late to help them or their families are some veterans abusing some of their old age ailments on VA claims rules yes the newest rage seems to be sleep apnea and it's automatic 50% rating if they can get a CPAP machine issued to them many of them never had a problem in service 20 or 30 years ago and have nothing in their SMRs to indicate it but the number of vets SC for it has been exploding for the past ten years with no reasonable explanation for it. Yes there are many things that need to be fixed and the VA claims and compensations needs a major overhaul but not the way Principi wants to do it.
  12. it appears that you are being paid SMC S at this point and time, I am married and get 3661 and am SMC L when I was getting SMC S it was about 3300 a month, to qualify for aid and attendance you basically are wheel chair bound and bedridden and need someone to do assistance with all aspects of daily life, getting you food, bathing, full time care, pretty much, I filed for A&A in Nov 2011 and it was approved in Nov 2012 after a thorough C&P exam that lasted about 2 hours I am in and out of ICU it seems on average about once a month due to congestive heart failure for the past 3 months I have had a home nurse that comes in weekly and assesses me and sends the VA a report the first 2 months it went to medicare and then it transferred to VA pay in the 3rd month you do not appear to be rated at SMC L but at the S rate

It's what I need. the problem with that statement is that the VARO does NOT care what you "want" rather they deal with what can your your medical evidence support in granting your award, they do not care about a spouse or kids that need healthcare thru CHAMPVA or college benefits thru DEA benefits. You state all of your training has been in law enforcement, the VA does not care about that, is there any job that you can hold and earn a living at regardless of the income level, nothing guaranteed a job of your choice and the income level of it. Like everything else that deals with the fickle finger of fate, it has tapped you and you are now a disabled veteran, the finger has moved on to tap someone else and screw them, leaving you to pick the pieces up, some of us lost families, homes, vehicles, all of our possessions, etc, and started over, some of us more than once, they win when you get so frustrated you quit, you need patience and persaverance in dealing with the VAROs some of us took a decade to finally get the final rulings in our appeals. my claim started on Dec 2002 I got the back pay and final award letter in June 2009. My claim for A&A went like a freight train Nov 2011 and deposit and grant to SMC L in 11 months. Granted I am now on oxygen 24/7 and either in a wheelchair or bedridden 23 and 1/2 hours a day and my CHF is now in stage 4 end stage and quickly getting worse. But I have lived a lot longer than the doctors at MUSC led me to think back in April 2-11 when they ruled out a VLAD device, heart and lung transplant or another CABG, medications only at some point you get to is just grateful you are still waking up in the next day be it morning or afternoon, there is no schedule anymore, the nightmares and the health don't adjust to normal schedules. Work more on your medical evidence the benefits will fall into place but you need the med records to justify them.
  14. given the fact that you knew more than a decade ago that they ordered a CPAP machine and then cancelled it and didn't do anything about it until now opens a whole can of worms abandonment for one, the thought I have a 100% I can't get any more it's not worth it now you see why it is worth it, the CPAP will keep your oxygen levels up while you are asleep, I have a BIPAP because of carbon dioxide because of CHF and a very low ejection fraction of 10% I have periods where my O2 is down to 77 that is while I am awake if I don't have an air line hooked up I have been on oxygen 24/7 for more than 2 years if you have any other sc issues you might be eligible for SMC S is you had added the SA back in 2002 a lawyer might see a legal argument for it and an extra 300 a month for 11 or 12 years will add up to a nice little retro sometimes just giving up is not the right answer you might be mad at the VA right now but you are the one who made the decision to quit the issue in 2002

John look on the bright side SSD is usually more money than either the VA Pension or SSI which a friend of my wife's gets that is 661 a month she manages to exist on that amount only because she has a paid off piece of land and a single wide. I couldn't imagine living on that little bit of money

Veterans eligible for this program must also be in need of personal care services because of an inability to perform one or more activities of daily living and/or need supervision or protection based on symptoms or residuals of neurological impairment or injury. To be eligible for the Program of Comprehensive Assistance for Family Caregivers, Veterans must first be enrolled for VA health services, if not enrolled previously. Services Available to Family Caregivers through this Program The law will provide additional assistance to primary Family Caregivers of eligible post-9/11 Veterans and Servicemembers. Services for this group include: Monthly stipend Travel expenses (including lodging and per diem while accompanying Veterans undergoing care) Access to health care insurance (if the Caregiver is not already entitled to care or services under a health care plan) Mental health services and counseling Comprehensive VA Caregiver training provided by Easter Seals Respite care (not less than 30 days per year) If you think you fit the criteria for these services, please follow the link to answer some preliminary questions and download an application. The application enables Veterans to designate one primary Family Caregiver and up to two secondary Family Caregivers, if desired. Like I stated above they have created a two tier compensation issue and it will cause a lot of heartburn think of all of the WW2 veterans whose spouses have been taking care of them for years rather than put them in a nursing home, my own wife has been a full time care giver since June 2002 we just started getting the regular A&A in Dec 2011 I should have filed for it earlier at least April 2011 when that heart attack damaged my heart to the point I now have an ejection fraction of 10% and can no longer walk and am either in bed or a wheelchair I am glad that congress did approve caregiver funds but they should have done it for all veterans and families that need a full time caregiver regardless of when they served. You should be eligible for SMCL but that means someone basically has to do everything for you or assist you in doing it.

SSD has many variables and few of us get the same amount, it is based on your income over the years we have heard of people getting 800 and others getting 2200 and then spouse and kids will qualify for additional benefits, When I first became disabled and got a check for 1600 and my kids got a check for 800 for a total in 2400 family benefits. Sine my ex wife and I were divorced she got the kids monthly check and the court accepted it as my child support payment, it made life a lot easier with my ex basically I never heard from her again lol VA is fixed amounts SSD varies
  18. meg this new benefit is ONLY for veterans who entered the military after 9/11/01 veterans from peace time, Desert Storm, Vietnam, Vietnam Era, Panama, Korean War and WW2 do not qualify for this benefit at the most we get SMC L which is where my level is now my wife has been turned into a full time aide and caretaker, it's either that or put me in a nursing home, and that is not acceptable to either one of us, I was getting SMC S before I filed the A&A claim and they granted it, it adds about 300 extra a month, better than nothing but it does not replace a paycheck she did it without the A&A since they found me disabled back in Oct 2002 we did not file for A&A until Dec 2011 when I became wheel chair bound or bed ridden, I spend a lot of time in ICU units due to CHF now and it is rough on her, she is obviously here because of love it sure isn't for the extra 300 a month. having a two tier benefit system is wrong, the vet agencies all agreed to it, I guess hoping they would be able to later ask to make us all eligible for the newer benefits, but with all this austerity calls I don't see it while I am alive, if ever.
  19. there is a major difference between a lotto win which is not "earned income" but passive and veteran benefits are not welfare, the lady in Michigan was required by law to report all monies coming into her home as her food stamps was based on needs and is welfare, just like a VA "pension" must also notify the VA of all "income" if a person is receiving a needs based |pension" they would get in trouble for not reporting a lottery win where as a veteran om TDIU or 100% is not required to report any lottery winnings.

Authorities say he was, in fact, working for a wreath manufacturer and as a fisherman and painter during that time it appears he had 70% for PTSD and another rating for his back and got caught working for more than poverty level wages it's the only scenario that seems to fit or he lied on the annual reports he will have a hard time getting TDIU granted in the future after he gets out of prison. I wonder how they do that will he get his compensation back at the earliest levels before they granted the TDIU and he pays back the restitution? or will the fraud keep him from getting any compensation in the future he still has the physical issues, and mental issues, but I am sure those will be re-examined and he might even get the percentage lowered. I have never heard what happens in cases like this when they are actually disabled before they commit the fraud. The title meant to read THIS IS WHAT GREED WILL GET YOU, I AM GLAD TO SEE HIM GET PRISON TIME
  21. when you are filing a claim for compensation holding information back only hurts you, "being a man and keeping a stiff upper lip" will not assist you in this process, you need to tell them exactly how you felt and how you continue to feel about it, exactly how it is affecting all aspects of your life, they take all medical evidence from your doctors and hospitals, MRI's. XRAYS, test results etc that pertain to the medical conditions that you are claiming that are service connected. Since you only got out of the military a year ago, why aren't you using the VA for all of your health care veterans now get 5 years of care after they ETS for all conditions wether they are service connected or not.

John when they have to combine a bunch lower ratings to get to 80% I don't think they have to infer TDIU I don't know what the 60% rating is for but we know it is not a mental health rating all mental health ratings are odd numbers except the 100% P&T rating the ratings are 70%, 50%, 30% and 10%. the GAF of 41 and a 10% rating would be galaxies apart there is nothing that would justify that rating and the other percentages you listed in your first post do not match known awards for PTSD, if your life matches a 41 GAF troubled home life, work, flashbacks, sleeplessness, there are a lot of factors that go into a PTSD rating but you obviously should be rated higher than 10% which is the only rating you posted that matched the ratings the VA grants for PTSD. Is your mental health doctor made any notes supporting your inability to return to any type of employment? Mine does it annually and he started it in Feb 2004 and continues to this date and I have been rated 100% for PTSD since Dec 2003. I have had a few other issues added since things 100% ICD and CAD, 10% hypertension and get paid at SMC l level.
  23. life memberships do NOT get you any better service, some states and counties have service officers that are paid positions and most of these people will take their jobs seriously, ask vets in the waiting room at your treatment facility if they can recommend a VSO, if your claim has already been denied at the VARO level you may want to consider letting a attorney handle it that specializes in VA law,

Tonio 100% P&T vets do not have to file any annual forms that is for vets who are awarded 70% TDIU which is paid at the 100% rate if your 100% is a rating for a mental health condition part of the 100% level is the fact that the veterans are not employable, it is r you not work, earned income is the problem there are some vets who own rental property that others maintain for them that is called passive income and does not cause problems there are some that say you can earn just under the poverty level and keep the TDIU or 100% mental health ratings, most of us feel it is not worth the fight, if we could have stayed employed we would have and risking losing the rating for a few dollars more does not seem worth the stress if they review me and then propose to reduce me I have too many other health problems besides my 100% PTSD, I have heart and lung problems, bad back etc there is something to be said for security. I think all of us would trade these checks to have our old lives back and never had these medical issues, but we have them and we can't go back and re-live our lives.
  25. the doc can "say" any percentage they want, but bottom line they don't have a LOT of say, a bad C&P can and will hurt you but from what you posted there is not enough to make a SWAG so I will guess a WAG 50% rating and depending on your treatment notes and work history and home life you may get 70% SWAG = scientific wild azz guess WAG = Wild azz guess
