I JUST GOT HOME FROM WORK AND READ THE POSTS.

I AM SOOOOO SORRY FOR THE WAY I ACTED.

I WAS HAVING A BAD DAY.

NOT THAT IT MAKES IT ALRIGHT TO TAKE IT OUT ON THE PEOPLE WHO ARE TRYING TO HELP ME.

Many here have PTSD & other problems that we have fought with the VA for years. When we ended up at Hadit, we found a home. Even after 100%, not a lot changes except the money. We all need someone to bounce our ideas & problems off. The meds & groups can help, but I don't miss a day at Hadit. Even if I don't post for days it is reassuring to have this site & the many veterans & Fambly members to back you. Not one of us can take credit for winning our claims or dealing with the VA without help from someone. The knowledge at this board would put the VARO to shame. This is great place to get help, also to blow off steam. That saves many of us from raising hell with the VA, which is not a good idea.

I could not have said it any better. It's true about the part where Don says that the knowledge here would put the VARO to shame. I had to tell the lady at the AMC in DC to wait on sending my file to the rater last week. She said it was ready, I knew better. I have been able to effect what is in my file just from the advice from people here. It turns out that they don't have the info I sent in recently certified mail, and they did not have the info from the foot and ankle center that did my surgery which is enroute to them. So they were ready to rate without the information that even they requested. You have to be proactive, and remember that this is not a spectator sport. I have been fighting this claim going on 11 years in 2009 and I am now light years ahead of where I was due to the people at this board.

Again, Welcome aboard Tankerjoeo. Now drop and pump out 20...LOL.

Obsessing about an upcoming C&P exam, especially during the time between the notice of the exam and when you finally get the C&P exam, appears to be a normal reaction to such an event. I've been there and done that. I felt relief immediately after the exam, on the way home from the VAMC. It was amazing how I felt a weight lifted off my shoulders, to have that part of the process over. That was November 29th. No matter if the exam was good, bad or ugly, you will have some relief just to have it over. Well, that was my experience, anyway. ( note: Rule #1, don't yell at the C&P examiner )

You write well here, and should be able to relate that to the PTSD C&P examiner. Have you already submitted copies of all the USMC records of your stressor & event, to the VARO??? I even submitted my Brigade daily reports & logs of the day I was wounded, with my PTSD claim. Like you, I tried to run through a mine field, but I only made it about half way. It also sounds like you were bounced around in that tank like a ball in a pin ball machine. TBI carries some of the same symptoms as PTSD. You can read about the different ratings for the different %s for PTSD. At the 100% level that you mentioned, would require you to be unemployable. Just look around Hadit for other PTSD postings, you will find the list. Again, Knowledge is power. Power & knoweldge is your ticket to freedom.

An apology is a great thing, especially when it is heart felt and true. When the huge dam full of "stress" builds up and the dam wall cracks, it will result in an uncontrolled leak from the dam. An apology forms cement which is used to patch the crack in the dam--which is full of stress. *The dam will now hold. What you need to do is to find a way to release this stress--gradual, timely, peaceful, using patience, friends and family. Sure, it will not be easy. The people that have posted before me are letting you know they understand and want to help. I think you now understand you will find a lot of family in "Hadit", and some cement when needed.

i have done same thing and i would feel guilty for days you know sometimes

we go overboard ,but it is to be understood we are not quite right to start

with . if we were not having problems we would not be here talking about it.

these people at hadit have forgiven me also and i have appreciated it i havent

been able to contribute much in advice for people ,cause i am kinda new at the

game even though i have been fighting since 1971. i did not know how to fight

or what was going on til i got on hadit and started learning. you will be o.k.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
