Poll : When You Were Rated Unemployable Iu

Was there a clear statement on your c&p exam declaring your unemployability? And did that statement appear on the rating decision?

Did the examiner or rating decision say "I feel, I believe, I declare .vet is unemployable? totally unemployable?'

a.unemployable due to service connected health condtions? or b.unemployable by reason of service-connected disabilities" or

c.unemployable because of service connected conditions"

For my children, my God sent husband and my Hadit family of veterans, I carry on.

Cowgirl, neither of of those for me. It was just straight out that I was totally disabled due to my SC issues.

I didn't have what you would consider a C&P for my TDIU.

I had a C&P for my MDD (rated at 70%).

I turned in my claim for TDIU and was "denied" via the Regional Office "Rubber Stampers" (sometimes erroneously referred to as "raters").

I took this denial to my VA psych and PA......both of which got on the 'phone with the VARO and explained to them that the raters are not doctors (somehow the rater decided that, although I was at 70% for my MDD and 20% for my ankle, 20% for my foot, was on medication that would make it illegal for me to drive, etc, that I was "not qualified at this time for TDIU due to my medical condition"), that I cannot work at this time, nor did they believe that I would ever be able to re-join the workforce, all due to my service-connected MDD, etc., etc., and two weeks later I had my TDIU. But, never had a C&P (except for my original service connected conditions).

No, I got IU via a DRO Hearing. My C&P exam did not address IU. I got a 70% rating via a reconsideration,but was denied IU. I went to a DRO Hearing and got IU. Then I went to another DRO and got P&T. I tell I had to fight for everything. The IU was retro to 2001. August 30, 2011 I will have ten years being IU. Two more years for DIC for the wife.

I think that all you need is a MD Doctor to state that due to your Service Connected Disability you can't work for now or ever.

The VA is a bit of a nit picker and anything less than that could be a problem.

If you have SSD than you should be sure and include that

Veterans deserve real choice for their health care.

I received all of my ratings in one little envelope. I was stopped at 70% for 2005.

I turned in my second TDIU Form and waited and waited. I called the toll

free number to see if the faxed copy from one Regional Office to another

had been received.

They told me they would have somone call me from the R.O where my

file remains.

The Social Worker called, rather a smart jerk, anyways said he had

received the paper, but did I really expect the VA to pay me more

money with the money my husband brought home.

I screamed out at him, I want a C&P and if the Doctor states I am

unemployable, then you will pay me or I will seek an Attorney.

Sure enought two weeks later a C&P.

Doctor stated " I was unemployable, but competent to manage my affairs.

I was then paid from 2005- August 2008 TDIU

After the C&P August 20th 2008 I received 100% Schedular and no

more exams.

When I received my C- File I did read what that guy had written.

PLEASE NOTE: EXTREME CAUTION WHEN CALLING THIS VETERAN FOR

SHE IS EXTREMELY UNSTABLE.

Thank you each for your feedback. I think we're fortunate unemployability is there to apply for. Myself, probably woulda been dumbfounded if presented benefits without asking for it based on all my records, years of unemployment and SSDI.

My poll interests are the exam and the rating decision MATCH. I know theres supporting info, just bottom line 'unemployable'.

So, if the exam says 'doc feels the vet is unemployable' that makes the rating decision 'veteran unemployable.' Or is there wriggle room?

Learned the hard way not to take things for granted. (er, not late for dinner either!)

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
