Hello folks- Hoping all is well.

RE: TDIU PT.

I recently filed a 21-8940 in request of a TDIU PT rating (against my VSO'S advice) to get an

early efective date and maybe approval. I also applied for AA for my disabled wife. long story

short- I was approved for AA for my wife and denied TDIU PT. YEA!!!! Reason ( their words verbatum) IU award was denied. reason being

a review of your file shows that you were granted and awarded IU effective 12/01/08. therefore, the request you submitted on VA form21-8940

Veteran's application for increased compensation based on unemployability reieved on 08/20/10 is not considered a valid claim.

You are being paid at the 100% rate for IU. your overall or combined rating is 70%. We do not add individual percentages of each condition

to determine your combined rating. We use a combined rating table that considers the effect from most serious to the least serious condistions.

DID they only concider IU and not my reqest for TDIU PT??? (sounds like they did)

My question is now that I have a date to anchor my claim. what is my next move once I file a NOD????? the only new information I have is my treatment notes

from my vet center counseler.

There may be some confusion here, TDIU and IU are the same thing and they pay a veteran the 100% rate of compensation. Now if you were not awarded P & T all you would need is a statement (progress report) from your doctor saying that your service connected conditions are static or will most likely not improve and you should be awarded P & T but you are already getting the TDIU/IU. If I am off others will chime in.

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

I do not give my consent for anyone to view my personal VA records.

Did you get chapter 35 benefits when you got IU back in 2008? That would mean you are P&T. If not do as Pete992 has said and just submit evidence to the VA that your disability is static. This should be evidence from a doctor.

If yall dont mind I have one more question. Will my treatment records from my counselor at my vet center aid in my claim?

They have reference to my disabilitis saying that my disabilities prevet me from gaining emploment. It also states that

I should apply for P&T Chapter 35.

As long as your counselor is a certified psychiatrist or psychologist it should work. It may work with a social worker but I am not to sure. It would greatly help your case if you can get a VA psychiatrist to put it in your treatment records or if the Vet Center has a psychiatrist that could make this statement.

As long as your counselor is a certified psychiatrist or psychologist it should work. It may work with a social worker but I am not to sure. It would greatly help your case if you can get a VA psychiatrist to put it in your treatment records or if the Vet Center has a psychiatrist that could make this statement.

If the VET Center counselor is a certified psychologist then that word is as good as one from the vamac. You can bank on that. They work for the VA but have a little more freedom of what to write for you. Trust me, I have a great VET Center psychologist that I go to every week in ST. Louis and she has helped me in more ways then one with the VA.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
