Question

I am new to this VA chess game and unfortunately I have been learning as I go. Bad move on my part, however, I am trying to get some advice,maybe some direction as where I need to go from here, I filed a claim and did a poor job in telling the VA what exactly was wrong. I used a local veterans organization and failed to do my homework. I filed a claim for tinnitus and a back injury, just as stated. As I know now I should have been more specific as to injuries incurred and what I was claiming. I have other illness that are related to my tour in Iraqui Freedom but never mentioned them to VA as I was very unhappy with a treatement that I received from a VA clinic at one appointment. My question is whether to revise my claim and submitt a new statement, with all my supporting documents and go back to the initial process of a claim or wait until the VA decides my contentions. Any help or suggestions would be greatly appreciated.

Welcome.

I split your post off from the OP's topic.

How about posting what issues have been claimed and denied so far

and the Reason and Bases Section from the decision that denied.

Leave out personal info like name, address, claim #, etc. . .

Carlie passed away in November 2015 she is missed.

The issues I have claimed are just the two. Tinnitus and Back Injury. The claim hasn't been denied yet. I filed back in Aug of 2012 so fairly new in the claims process. Last time I was able to check VONAPP it was in the preparation for notification phase of the process. Im being optimistic, however, from reading the forums, this process can go on for a long period of time if you don't precisely tell the VA what your specific illness and injuries are.

2. A current diagnosis of the injury

3. A Nexus, or connection between the injury and the current diagnosis.

It seems simple, but it is not. You may need and Independent Medical Evaluation/Opinion. It took me almost 40 years to get my back service connected because I did not know this and did not know that I must document it.

Your notification will be there soon, I think, and you will know which way to go from there. You have to be pro-active in your claims.

I commented in your other post regards records. And basically it boils down to records. The VA needs hard evidence from paper records, etc.

Then you need to get you issue Service Connected. Don't worry about the percentage up front, just get it connected.

Then you start the chess game............

I am starting to realize that now from the posts that I have been reading up on. I have the two and the correlation is there on the third but not from an IMO, only from the medical treatments i have had and the diagnostic imaging tests and results. Yes you are absolutely right on the pro-active part. I believe I have been lacking in that regard, however, I mean to change that. Thanks for the information my fellow vets.

Medical evidence is what wins VA claims. You connect the medical evidence with your service and get a DX. You file your claims and be ready to start waiting and then appealing. You will probably be low balled on your first claim. So it is normal to be outraged when they say your back injury is only 10% and you have a hard time walking.

      Frost v. Shulkin (2017)

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
