Preperation for decision -> Review of Evidence

Yesterday my claim moved to Prep for decision, this was a week after my latest C&P, I was feeling optimistic that the estimated completion date of 9/4 was reasonable.  Today it moved back to review of evidence and my date oushed to 9/14.  This is a claim with 1 increase, 2 new, 2 secondary.  I filed my claim 9/24/18 it seems like a long time for a claim.

 

Anyway, my question is: have any of you had the claim move from "prep for Decision" only to regress to review of evidence?  If so, what was the timeline like?

Shrek is right on target. These things take a longer time than we think they should. Always. And you have multiple decisions to review. Don't be alarmed that your claim seems to be going back and forth either. It happens all the time. Be patient. As Shrek said, check it once a week: it's not going to move quickly right now. I am under pain management for 12 years.  It helps a lot and I take some other medications that assist with the pain.  Yes it limits you but it seems that you are now on a way to a career.  That is a good thing.  Find something to do like shrek suggested.  I help out here and teach Tai Chi at a church and work at a food ministry.  Nothing too physical and it does not require smarts.

Again, I really like Shrek's message. Be true to yourself, and then you can be true to your family. You have problems; EVERYBODY has problems. Sometimes they don't show, but they got them too. Count you blessings; hell you got a lot going for you. Nice wife, nice family. Going to graduate college. Not bad brother. OK, so it ain't ideal. Work on it. Find a little something that you really can enjoy. Maybe it's blogging on Hadit, trying to help out your brothers and sisters where you can. Maybe it Church, maybe helping out cub scouts (you kids are going to grow a lot faster than you realize.) Be positive. A stupid story: I went to the VA and my foot was bothering me, but I had to walk because no parking slots. So I catch up to this Korean War vet and he is using a cane and working hard on doing it. We are talking as we go to the building and my ankle didn't seem to hurt as much. I noticed with me walking with him, his walk was less labored. My day was better because I chatted with him, and I'd like to think I may have made his day better also. The moral of this tidbit is "look around." You can always see there are people way worse off than you are. Make every day positive.

I certainly know how you feel. Mine has been going on for over 35 years. Hopefully you can learn to deal with it- cope with it.

Deep tissue massage therapy has been helping me. There are lots of various options. You may have to keep looking and trying different things. Keep looking. Don't give up. Something should help.

Just an update for posterity, it went from PFD -> RoE -> PFD -> RoE -> PFD -> RoE -> GoE currently.  In addition, my estimated date of completion has moved to a range of November-January 13.

I think that I will have to go for ANOTHER C &P I guess.  I had 3 in November 18', 1 in July 19' so who knows.  Maybe the examiner didn't fill the DBQ correctly, who knows?

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
