ptsd My Ao Vet
I mentioned here about a month ago- this is a good friend of mine- He was so upset-the day before his wife and he went on a long awaited brief vacation he got a letter from VA for re-evaluation of his disability-they didnt say which one- He is 58 yrs old Army infantry Vietnam, 50% PTSD, 40% GSW, 10% another GSW, and AO cancer NHL, with colostomy (SMC)rated 100% under Section 1151 wth SMC. He was a wreck. His wife wrote a letter to the VARO telling them how much they upset him as he deals with enough already and what could they possibly want him to be re-evaluated for? In all the time I knew her this is first time she did something like this. I made the po…

ptsd Agoraphobia
Hi all: I am ptsd tdiu t&p. I think that I have agoraphobia but I am not sure. I stay in most of the time because I get real anxious just thinking about having to go out. I do go out sometimes, but I only last a short time before I begin to get anxious. When I am out, I get a little anious sometimes and sometimes I get a full blown anxiety attack. Over the past few years, I have told the VA docs about this. Am I agoraphobic. How would I file for agoraphobia as secondary to ptsd (I think I can do that)???? Any thoughts?? Thank you, Mike

diabetes Eed
I have a question, I filed for a earlier effective date for my diabetes, and was denied, the VA reason is. (Your effective date would not change even if an earlier diagnosis of your diabetes had been made.) I think the VA is wrong is this ruling, but does anyone know for sure. then they say that Entitlement for compensation for a EED for compensation is denied because the evidence fails to establish that VA medical or educational services were the proximate cause of additional disability. I received a 20% rating for diabetes effective December 2002, but asked for a EED back to 1994, as it says in my medical forms, that I was diet-controlled with diabetes from 1994 unt…

Motion For Reconsideration And Cue
QA vet can file to the BVA for a motion of reconsideration and a Cue at the same time. You may file a motion for reconsideration with BVA at the same time your claim alleging clear and unmistakable error is being processed at the regional office. A motion for reconsideration of a BVA decision may be filed at any time. It must be sent to the following address: Director, Administrative Service (014) Board of Veterans’ Appeals 810 Vermont Avenue, NW Washington, DC 20420 If you send a motion for reconsideration to BVA, it must be in writing and must include the name of the veteran, the name of the claimant if other than the veteran, VA file number, and …

Threat From Poa
It is pretty bad when your own POA main office threatens to drop you yet they did not take proper steps to keep your claim out of the crapper. I threatened them too. This letter I just got from them is a beauty. My new vet rep did send a 21-4138 in to ask for a remand but Rods 5 volumes of stuff and my appeal were already on the way back to the RO. They assured me, even after threathening me , that I will now receive adequate representation from them. Question all---I have 3 IMOs that support my claim- none have been addressed by the VARO- Dr. Bash's most recent IMO totally knocked down the VA "expert" IMO. This letter from my POA indicates however that anothe…

tdiu "the Benefit Of The Doubt Belongs To The Claimant"
I was reading some "food for thought" that Berta suggested for me in my claim denied for TDIU. My last employer submitted 2 responses from the Form 21-4192 that I had completed. This made it look like I had two different jobs at the same time, and worked longer than I did without a break in employment like I had. They listed the apartments that I managed, and the parent company that owned them that I really didn't have anything to do with. Well, I am proud to my "smart...just like a woman" wife saved all of our tax records since we were married, so I have proof of what I'm saying. I also have statements from others as to this. Now to the "food for thought" in the…

ptsd Vets Spouse Not Allowed To Accompany During C&p
Hey all, I know about a year ago or more this same topic came up and I thought someone furnished the reg that allows the vets spouse to be with him during C&P evaluations and to sit in with him. My buddy went to StL VAMC to have a C&P by a psychologist yesterday. He had been awarded 30% last Nov for PTSD and they NOD'd that for an increase. This is why he was there, for the NOD as he has three PHs from Vietnam. Anyway the C&P psychologists told them the vet could not have his wife accompany him. My friend told the C&P lady that he desires his wife to be present as he has been married to her over 30 years. The examiner then referred him to Vetera…

tdiu Hearing Before Bva Member
Hi all I have a scheduled hearing in Washington, DC with a member of the BVA on a remand issues including and earlier effective date for IU. I got retoractive pay from 1/2004. My claim for TDIU was put in in 1994. My arguement is that my service connected diabilities prevented me from working gain-ful employment back in 1994 not 2004. I think if the VARO would have went by thier law under title 38 CFR my effective date should be 1994. My question is has anyone had one of these hearing in DC and if so what do i need to expect?

ptsd Vike's Advise Is
I apologise I was a little abrupt with him the other day as I misunderstood his post- He gives excellent advise here and the prior post shows what I mean. I wish he was here more often but is as overwhelmed as many of us are- I bet. He is right and I have been trying to say this too- A veteran does NOT have to even have a rating to be considered upon receipt of the TDIU form- for TDIU- If the veteran has medical records and/or a SSA award that support the fact that he/she is unemployable due to service connection with a nexus to service-the vet should send them the TDIU form. In my experience the VA-even if they see a veteran who should be considered for…

ptsd Kkp Needs Advice
I havn't posted for a while, but read daily. There has been some topics I would like to comment on ,but don't really feel qulified, but I am learning, as like most of you I read every thing I can get my hands on. As some of you might remember I am 50% ptsd. I have a claim for right knee injury (sc) I recieved a decision on 9/15/06 Of course it was denied. It was stacked from the start as some of you advise it could be,For example it's in my smr that the right knee was still swollen a year after the accident. This was not mentioned in their decision. However they made note that it was not mentioned my final physical, (da) I didn't have a final physical. I had a Doctor…
