Viewing C-file
I have an appointment to go see my C-File in a week. I bet my recent "lost" claim is in there among the other paperwork. I am going to pull it out and see what I can do to make them use that date as an effective date. I hand carried the same claim over to the VARO yesterday after much pondering and asking if it was worth it. I will probably regret even filing in a week or two when the VA pisses me off and tells me they lost it again. But I have proof now!!!!

tinnitus Dingess/hartman V. Nicholson (2006)
Greetings, Did anyone else receive this letter? it's in regards to the US Court of Appeals for Veterans Claims that a decision has been made that requires the VA to provide addtional information about the edivence VA needs to make a decison. I have bi-lateral tinnitus currently rated at 10% .Dingess/Hartman V. Nicholson (2006) had to due with veterans receiving 20% 10% for each ear rather then 10% for both. I applied for increase when I found out there could be a reversal of this decison. Does anyone know what in the world this letter means?? Thank you all. God bless you all.

A & A, Smc, Sche Of Ratings -1996
The new VBM I got just paid for itself in many ways- For those of you who have it-The Aid And Attendance sample letter on pages 428-429 is excellent, the revisions of VA regs snce 1996 on pages 432-435 show how few of these regs have changed since 1996 and this is good info if one files a CUE claim claiming the improper schedule was used to rate them and give them improper diagnostic code. SMC- this sure seems new to me -the SMC point system Pages 436 -437. I never knew that these ratings were based on points of disability. This formula might well be an invention by NVLSP and not the VA- does anyone know- in any event their SMC information and this point cri…

My 51 Day Bva Remand
As you all know I wrote to the Chairman of the Senate Committee of Veterans Affairs who is involved in the Backlog sub committee. I was furious that I was now part of the BVA remand backlog and that RO had violated my rights to get me there. Five days after he received my letter the Senator sent a letter to the Buffalo VARO. They gave it to the Congressional Liason person who appeared not to know what to do as to answering it. The RO had transferred my claim to the BVA on July 18th in direct violation of established VA case law and since I am willing to fight for my rights, I got it remanded already and it is in "active appeals process" and for the first time in…
