Records Question Again?
After waiting three months we got my husbands records from NPRC. There was not one medical record in the envelope. His entire records package was 6 sheets of paper and two of them were certified copies of his DD-214. They said we need to contact the local vet office nearest us and request the medical records from them. Now should we request the medical records from the RO or should we wait until we can submit everything and then request a copy of the c-file or should we drive the four hours and go in person to get a copy of the c-file? what's up with the medical records originals being sent, not copies? I'm not sure we getting the straight stuff here. Anyone have a…

tinnitus Figuring Out The %
This is off the top of my head> I'm trying to understand how the percentage actuall works If some one could figure my example out for me PTDD=50% of 100% = 50% DMLL= 30% of 50% = 35% PN= 30% of 35% =24.5 % HL= 10% of 24.5% =22.05% Tinnitus=10& of 22.05% =19.845 % So would I add 50+35+24.5+22.05+19.845 together to get a precentage rate or would you add 50,30,30,10,10 together The 19.845 would mean that is whats left of your body precentage wise

I wish I new about this site 2 years ago. I have been very much on my own trying to gather records, etc, without any guidence. I apealed a decision about 4 months ago and finally got a CP exam. I recieved a letter from the DAV, National Service Office stating: This letter is not intended to serve as your official notification from the Department of Veterans Affairs(VA). You will receive an official decision from the VA upon completion of neccessary administrative procedures. etc etc. Further down the letter it states, The Disabled American Veterans(DAV) has reviewed the most recent VA decision concerning you claim for benefits. We are pleased to inform you t…

hypertension Need Some Advice Another Denial
actually a lot of denials lol, even though they were supposed to only be looking at hypertension and heart disease, they re-denied and continued the denial of 2004. This was in reaction to my letter to Admiral Cooper after the VARO in Columbia attempted to use the same distortion with him that they had used in Sept 2005 with renee Szybala, that yes I was at Edgewood for the tests but I got sick and was sent home before the chemical weapons and drug etsts began. I sent him three documents that proved that either the VARO was misunderstanding my C File or flat lying about my Edgewood experience. Within 2 weeks of that evidence being sent to Admiral Cooper the C&P e…

New Claim Question
Hello all, I having been visiting this forum for the past few months, but this is the first time I have posted. I received this email today in response to an inquiry that I made, and would like to know what you all think. Your case was rated on 6/29/2006. It is in the area that inputs the rating results into the computer. The rating decision has not been posted in the computer yet. Once the computer is updated with the rating decision, the case goes to another person that reviews the case and authorizes it. Then, you will be mailed a letter advising you of the decision. [CRAVEY, DANIEL, VBAATLD] I do have a VSO, but I never hear from him unless I call h…

Need Help Finding Missing Service Medical Records
I sent an Freedom of Imformation request to receive a copy of my sons SMR. Finally received them after about 5 months. Some of the records are missing!!! He had a head injury and back injury at the same time onboard a ship, The USS HAWES which is normally stationed out of Norfolk, VA This record is missing!! [ he was never in Norfolk, But was stationed in Mayport, FL] He also was in the Hospital for surgery At the Naval Air Station in Jacksonville Fl. The only thing in the records about this is that he went to surgery and was returned to the recovery room in good condition. I really needed all that record that contained all his pre-surgical testing like labs and the …

Barrett- Tolling On The 120 Day Cavc Limit
http://www.veteranslaw.com/Law%20Update.htm "4. Barrett v. Principi, 363 F.3d 1316 (Fed.Cir. 2004) (The Federal Circuit held that mental incapacity could be a basis to toll the 120-day time period for filing a Notice of Appeal at the CAVC following an adverse BVA decision. The Court stated that the veteran must establish that his psychological disability made him incapable of rational thought or deliberate decision making, or rendered him unable to function in society.). Practice Note: Barrett is a very important case. Barrett stands for the broad proposition that any time period for filing a written submission (e.g. one-year period for filing a Not…

Discitis
I had a lumbar puncture a couple months ago and now I'm suffering from discitis. A infection of the discs in my lower back. The lumbar puncture was to diagnose non service connected MS. Can I claim service connection for the discitis or should I file a 1151 claim? With me suffering from discitis can I undergo another lumbar puncture or will I have to wait for the infection to resolve?

Got An Update On My Claim
Within about 4 days after sending my complaint to Chairman Craig- Senate Committe on Vets Affairs- regarding what I consider to be a scam( but I called it a growing two fold practice in ROs to deny vets their basic rights as claimants)- and I laid out my claim situation as evidence to support my charge- the VARO has gotten notice of this as a Congressional Inquiry and the temp folder has been with either the RO Congressional liason or the Director since July 25th. This was a very strong letter. I am fed up. Those VCAA remands at the BVA web site are getting me very angry-they mean -in many cases- that fed employees at GS 12 or higher do not do their jobs. Sure…
