ptsd Got My Ptsd Bva Decision?
Called my local DAV office to find out the status of my appeal. They checked in their system and they said BVA granted my PTSD claim but no %. Then I called BVA contact and the person there said the case was fwd to our local RO and that she didn't know the decision was. Can this be true? Why would our local DAV know the granted status and the BVA contact person not? The said it will take appx 45 days for any monetary award. Pls advise, thanks. Can this actually happen?

Radium Inserted In Veteran's Nose
I'm trying to help a vet, requested by his wife. We just talked, and she mentioned something about her husband unknowingly having had radium inserted up his nose while he was in the military in Texas to treat a nasal condition. He retired in the early 60's. I've told her what records I'd need to review. Also, he had his knees operated on in the service, and evidently one gave out on him recently. He fell and broke his hip. His total rating right now is 20%, don't know for what but I'll find out. I'd like to help him get more if I can. Anyway, has anyone out there heard of the radium treatments before? Was this experimental or standard procedure back then? Th…

ptsd The Left Handed Shake
Hi! Thanks for the nice comments about my successful 100% PTSD you all contributed to. Yep, I have a VA document saying 100% schedular rating granted for service connnected compensation Dated July 10, 2006. Today I get a C&P Exam notice dated July 13, 2006, as a request from the VA Regional office. Exam date July 25, 2006. I thought once they awarded you 100% comp., that finallized it, and they don't bug you with anymore exams?????????????? I also received another VA notice letter dated July 11th that they received my application for benefits and deciding if they want additional evidence. ps. Maybe they are just trying to give me a heart attack so they don…

So What Do You All Think?
Hi, I have been out of the military for approx. 5 years and since then I have seen a "shrink" for depression/anxiety. Well he told me that I have "Post Traumatic Stress" and I needed to file this with VA. So I took his advice and did so. Also claiming the broken foot I got while doing some training and knee problems I still am battling with. I have all my medical records that state feet, knees and mental illness in there. I went to a VA Commision to help file my claim. Well he didn't put "Post Traumatic Stress" he put depression and anxiety (not sure if it matters). Few months after that I was scheduled to see VA Dr. for my feet. Nothing for mental health or knees. Then …

Prejudicial Error /remandable Error
I have been reading remands of widow's claims at the BVA- Some widows received a letter like I did for more evidence but the letter did not comply with the VCAA nor was it a real VCAA letter. I think a real VCAA letter has check boxes and they send pamphlets- The BVA stated this to be a remandable error-and in some cases, a prejudicial error-and remanded on that basis. One BVA case states clearly that a general letter asking for more evidence yet which is not specific to the claim is "unacceptable." The VA could have told me to get an IMO-I did anyhow- but I realise now that they were not in compliance with the VCAA at all. This might help someone: from…

Greetings After a long wait (since 30 Nov 2004), I received a 10% rating for each leg/foot numbness problem but denied for my arms/hands...here are the results (short version): "Lower Extremity: Service connection for right and left lower extremity neuropathy with decreased sensation as secondary to the service-connected disability of low back pain with mild degenerative changes. The decision is based on information obtained from my VA examination in which examiner opined the neuropathy of the feet and legs is due to degenerative joint disease, foraminal stenosis with secondary radiculopathy. An evaluation of 10 percent is assigned for incomplete paralysys below the…

tinnitus Secretary Nicholson Declared Winner In Tinnitus Claims
The Veterans Court had ruled that Bilateral Tinnitus was possible under the VA rating system. This ruling was appealed to the Federal Appeals Court, and overturned. If you are trying to get a separate rating for Both ears (bilateral tinnitus)? then forget it, and withdraw that portion of your appeal as it will only slow down whatever else you have going. Your Editor, Ray B Davis, jr. --Federal Court Ruling --- United States Court of Appeals for the Federal Circuit 05-7168 ELLIS C. SMITH, Claimant-Appellee, v. R. New Evidence
If I had a reopened claim on appeal continuously for a period of five years and then based on new evidence I get a much earlier effective date. I had a claim that was continously on appeal since 1996 and then based on new evidence, according to the VA, I was granted an increase in 2002. My effective date was 2002 based on when I sent in the new evidence. Did I get screwed?

ptsd Back Problems-been Denied
Hello All; In 2003 I filed my claim and in that claim I filed for lower back problems. The VA denied lower back stating; “Your treatment records subsequent to service show sporadic complaints of back pain over the past few years. There is no evidence to show that you have a chronic back disability associated with your Coast Guard service, therefore service connection is denied” I have a buddy statement that I chipped and scrapped lead paint on my hands and knees, stooping and bending over to do this work. What they have acknowledge in the 50 % MDD (claimed as PTSD, night sweats and sleep disorder) A buddy statement that I slipped and fell on my back striking my he…
