Hereditary Angioedema In The Usmc?
Hello all! I will start off by saying that i do no have issues with the VA as of right now, but moreso some questions. I am still currently in the USMC. I've been in for sometime and have served in OIF and have just under two years remaining on my contract. I enjoy the Corps. and people I've come across along the way. Before my deployment, my mother was diagnosed with Hereditary Angioedema (HAE). I was informed about what it was, symptoms, and that i too could possibly have it. However it is roughly 2 and a half years later and still have not been tested for it. Reason being, i didn't wan't to miss my deployment, and leave my brothers, and most of all, leave the Corps. I …

Va Exam/dr Id
I had a recent neurology exam at my VAMC. I was not happy with the diagnosis and they are going to do a second exam. But my concern is this. the Dr. that examined me (a male) gave no indication he was anything other than a VA doctor. When I got the notes from the exam it was signed by a female neurologist, who is VA staff, and never saw ,me that day, like she had performed the exam. It turns out the person that saw me is a resident at the local university hospital. I have had a resident do an initial exam before but the VA doctor always did the finish in person and the resident represented himself as such. I have complained to the case worker at the VAMC and the Patien…

C-File Received Opened
Well, it's been a while since I last posted. I finally received a copy of my C-File today at my PO Box. It was sent from the Phoenix RO and the box it was mailed in had the end open. (See photo) There was no Postal notice addressing the opened mail. Of course, I will file a complaint with the Post Office tomorrow. The C-File contains many of my VA Medical Records, which I am sure have been compromised. I am sharing this for two reasons- 1. So the members will be aware this type of problem exists, and 2- To determine if there are any further actions I should take (such as VA IG Complaint?).

Claim Denied Increase / Iu, Questions On Personal Hearing,
I requested an increase / IU to my valvular heart disease due to an aorta aneurysm after having my aorta valve replaced. The request was written up wrong, by not mentioning the aorta aneurysm on the VA Form 21-4138. Only the aorta valve was re-evaluated and was found to have some improvement, request for increase denied , service-connected disabilities will drop from old combined 60% to 30%. Just received my denial letter went to my DAV rep and we requested a Personal Hearing, and re-submitted a claim for aorta aneurysm, I Live in the Dallas-Ft Worth area. My question is; do these types of hearings take place in 30 days, or are they backlogged like the rest of the system …

Status Of Bva
I recently requested the status of my BVA claim. I was told that my claim was received in Aug 2007 and sent to the American Legion representative for review on Feb. 5, 2010 and they are waiting on them to finish their review so that it can be placed back on the docket to be heard. The bad part of it is that I had requested not to be represented by the American Legion in 2006 yet they are still representing me. Can anyone tell me how I can get my claim back on the docket and moving forward to a decision?

Divorce And Non-Service Connected Disability Benefits
I have been married for 15 years and 3 years ago we seperated when my wife went to work. I just received a notification from the VA that my income for 2009 was $19,000 over the acceptable limit for my disability pension, and I will loose my check. During this time my wife had a seperate bank account and lived elsewhere. We both wrote statements to that effect but the process is starting within 60 days. My problem is that I have 100% disability (heart and lungs) and can not work. I want to stay married and possibly live with my wife but her income would not support the both of us and I'm barely getting by on my pension. I served in Korea during 1968-1971 did not see …

Va Must Consider Beneficiary Competency In Every Case Involving
*** Competency Determinations : VA must consider beneficiary competency in every case involving a mental health condition that is totally disabling or when evidence raises questions as to a beneficiary’s mental capacity to manage his or her affairs. The Fiduciary Unit supports implementation of competency determinations by appointing a fiduciary, a third party who assists in managing funds for an incompetent beneficiary. We reviewed competency determinations made at the VARO to ensure staff completed them accurately and timely. Delays in making these determinations ultimately affect the Fiduciary Unit’s ability to appoint fiduciaries timely. VBA po…

Temporary 100 Percent Disability Evaluations
*** Temporary 100 percent disability evaluations : At the end of a mandated period of convalescence or treatment, VARO staff must request a follow-up medical examination to help determine whether to continue the veteran’s 100 percent disability evaluation. For temporary 100 percent disability evaluations, including confirmed and continued evaluations where rating decisions do not change veterans’ payment amounts, VSC staff must input suspense diaries in VBA’s electronic system. A suspense diary is a processing command that establishes a date when VSC staff must schedule a reexamination. As a suspense diary matures, the electronic system generates a …
