C&p Results Question
i was reading a part of my C&P results under "Functional Loss" re; my right total knee replacement claim. The examiner checked positive for each function loss, which I believe were 14 different ones. Then I ran across this in the 38 CFR 4.40...Functional Loss. My Question is, concerning the last underlined sentence. would I fall under this? would this be considered as unemployable? The functional loss may be due to absence of part, or all, of the necessary bones, joints and muscles, or associated structures, or to deformity, adhesions, defective innervation, or other pathology, or it may be due to pain, supported by adequate pathology and evidenced by t…

tdiu Problem With Unemployability
Hello to all, this is my first post, I am sorry that it is long, but I need any help I can get. I am service connected for my bilateral shoulders 30%, 0% for my right ankle, 0% for my left hand. Following my service I became a Critical Care Paramedic and an instructor. My right shoulder has been surgically repaired 3 times now, after the last one in June of 2011. The surgeon stated that I can not lift anything over 30lbs, and that if I did my shoulder would then be non repairable this has ended my career of 13 years. He also stated that my shoulder needs to be replaced but my private insurance and the VA would not approve it until I am closer to 50 years of age. I have…

E-Benefits Pulled The Link To C&p Exam Request And Appointments
Greetings all: Looks like the C&P exam request and appointments link on Ebenefits has disappeared. I wonder if they are fixing something that is wrong with it or have the decided that that information is not appropriate for us veterans. I have also noticed the only letter left in the letter generator is service verification, does anyone know if the letter generator section populates on the veterans status or does everyone get access to the same types of letters? Just curious -- glad im not a cat!

What Does Awaiting Second Signature On Vba Case Mean?
Hi Folks, hope everyone is doing fine. I've been off the radar for sometime. I have been trying to enjoy myself while going to my various VA appointments. When it comes to paperwork, there is one case still pending in my situation. In fact, it has been pending for the last 4 year. The issue is on an effective date for one of my granted disability. It should have been an earlier date. After the local RO denied my NOD, I'd appealed it to the Board of Veterans Appeal in Washington. They have been handling that for the past 3 years, sending over thoses same ole forms for medical evidence over and over again. When I called the VA the other day, they said that the appeal …

ptsd Claim Issue Disappears In Denial...
Hello To All, I have a question regarding a denial...wondering if anybody on the site has an idea of what this may be? My original claim for benefits was for PTSD, depression, and skin disorder. In a past denial, the skin disorder simply disappeared from the claim with no further mention of it. When I went to a hearing years ago and questioned it, it was put back as a claim. So, again there were the three noted. Now, in looking at a denial, I notice this time the depression claim has disappeared. There is no mention of it, not deferred, not anything, just not even mentioned, simply disappeared from VARO verbage. So, is it safe to presume they are deeming it denied, wi…

Osa As A Secondary To ?
Ok. Went for my epidurail this AM and when I awoke from the sedation, The RN that was assisting the my pain management doc said I need to get checked out for it. Wife says I display some of the symptoms of it while at home as well. My question is can this be claimed as a secondary to IHD, DMII, or Gerd. I am not SC'd for the DMII and IHD as it is part of a claim for AO presumptives that I have working now. The gerd is from a hieatal hernia from the middle 70's while in service.

Imo Vs C & P
I have been reading a lot of posts on the site and have noticed that some people get IMO's while others are advised to get them and still others just get a C & P. I understand that there are a lot of vets that don't have private med ins and can't afford to pay to go to a private doc and have to hope the VA does right by them. My question is if a person were to file a claim for say 3 issues and had an IMO to support them all and submitted them with the claim would the VA even do a C & P? I just think that the VA uses the C & P to set up the denial (especially in borderline claims where it could go either way) JMO. I would like to know what the feelings of other…
