Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Just Received My Final Determination
All, I just received my "final" determination and it states "We assigned a permanent 100% disability evaluation for your service connected disabilities effective March 1, 2009." My question is, since they used the word "permanent" does that mean I don't have to worry about them trying to call me in for follow up physicals over the next few years and trying to reduce me back down below the 100% level? Thanks i advance for your help, Renegade81

Considerable Impairment Of Health?
Hi, I have a SC for hiatal hernia with gastroesphageal reflux. The SC was established about three years ago. At that time it was rated at 10%--due to "symptoms of reflux, regurgitation and heartburn, dysphagia, epigastric pain, hematemesis, regurgitation of stomach contents, nausea, and vomiting, which occur constantly." In addition, "EGD revealed a small hiatal hernia, nonobstructive Schatzki's ring. Diagnosis is hiatal hernia with GERD." The rating schedule says that "a higher evaluation of 30 percent is not warranted unless there are symptoms of persistently recurrent epigastric distress with dysphagia, pyrosis, and regurgitation, accompanied by substernal or…

100% Tempoary Unemployabiltity For Sc Surgery
Hello I am SC for Back problems Nerve damage and recnetly had surgery (implant of nerve stimulator) I was wondering if I did it on a outpatient status I was under no lifting for 3 weeks anything larger than 1 gallon of milk and about 6 more weeks of guarded restrictions. I had this done at a civillian hospital. I also had this done not to go through the 6 hour surgery that the VA Nuero advised me I could try this instead of having 3 disc replaced and bars, screws and fusion. Well it did not work out like we had planned now I am scheduled for surgery at Charleston in May of this year unless my other civillian Nuero surgeon says it is not wise. Anyone got any ideas if t…

Thoracic Strain...chronic Back Pain
Thanks, my friends, for all your advice. For several years I have had documented back pain due to MVA in Afghanistan. I finally got a CT scan which revealed scoliosis. This back pain has limited my function and mobility and made me depend on medications in order to manage it. Do you have ANY advice for me as I prepare to make a claim later this month? How can I maximize the chance for just compensation? I just want to be able to make a powerful claim that justly represents my chronic situation. Thanks OEF

Tinnitus Conceded ?
I have heard both sides to this question from a couple of vets at the VA. I was told by one that if you have verifiable combat service ,then they will award an automatic 10 % sc .The other side was of course , c&p and medical evidence then rate or deny. Anybody have the right skinny on this. Thanks

Hypertensive Vascular Disease
Hello I have a rating for my HBP claim which the VA gave me 0 percent for service connected. it was a long fight to get this far say about 3 years. it has been more than a year now so what is the best approch to file for an increase for this condiction? I have been on medication for this condition since 2004 and received my rating in 2007. I noticed that the VA rating for 7101 Hypertensive Vascular Disease does not have a 0 percent listed this is what I was placed under for service connected. Thank for any help
