Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Pes planus denied
So I'm new to this forum, but I have really enjoyed reading all the great information you all post. Thanks in advance for that! I am currently in a three year battle with the VA for pes planus, plantar fasciitis. On my entry exam, the doctor noted " Pes planus, mild: asymptomatic." Shortly after I got out, maybe 18 months, I went to the doctor because my feet were bothering me, and had been bothering me for quite some time. The podiatrist diagnosed the following: Forefoot adducted to the refract, high arched feet, hammertoe, decreased ankle dorsiflexion, decreased sty eversion, both feet and he also noted that both feet shoed pain to palpation of plantar-media…

tdiu Individual Unemployability
Hello, I am 60% service-connected with my largest percentage being in the mental health area. I applied for IU and had a few questions about the process and my chances of approval. I was recently approved for Social Security Disability retroacted from my onset date of April 2011. There findings were solely based of my VA medical records. I was also recently deemed unfit to continue with vocational rehabilitation, because of the problems with my illnesses and learning disabilities. My vocational rehabilitation counselor has written a letter of insolvency that was sent to the VA. Given the fact I was approved for SSD based off my VA records and can't complete vocati…

Certificate of Eligibility (COE)
Hi guys, I am hoping you can help me out. I am in the process of buying a home, getting a V.A. loan. The department that gives the COE, has notice my SSN number is off by one. I indicated that several years ago I did bring that up to the V.A., and I received several different answers how to proceed. I was told not to worry because the V.A. uses your file number more then your SSN. (big mistake on my part), and I forgot about it. I have gone thru my C-file, and the only thing that has the wrong social security number is my DD214, and a medical piece of paper as well. My Veteran Identification Data bank has my correct social security number. My loan officer h…

Has Anyone Ever had their 100% VA P&T Taken Away?
Good Evening, Most of you have helped or followed my VA process over the last few years. I recently was Reviewed for 2 SC conditions even though I am 100% P&T. I actually had the Exam only for my 40% Condition, and it was continued. Well when I received the Big White Envelope, it states on there that the VA actually Reviewed my 30% for Scars, which I did not see a Doc or even get asked a question about. Well it was Reduced from the Current 30% to 10%, which is bull crap, but it did not affect my total % So I am still 100% P&T. I know that I am only 34, but I did not ask to be sick, hurt or Medically Retired at age 31. I am tired of looking over my shou…

Proposed Reduction of Benefits
Lead [-] Proposal to reduce combined rating from 70% to 60% Wanted to see if anyone has ever heard of the VA "proposing to discontinue the separate compensable evaluation for radiculopathy, left lower extremity currently evaluated as 20 percent disabling and combine the radiculopathy, left lower extremity with the disability of degenerative disc disease of the lumbar spine under diagnostic code 5243 and assign a single evaluation" A brief summary is as follows. Sleep apnea denied
I was denied sleep apnea because i had no proof it occurred in service ( i was diagnosed with OSA 23 days after i ets'd thats not suffice time to develop sleep apnea) and the case was closed a year later since i didn't submit a appeal ( i was oblivious as to how appeals and everything worked). I tried once more and was denied because i had new evidence but nothing saying or showing it was in service. I was told a year after ets date is considered in service but vso's tell me that not true. Im researching cases online and iv'e seen people get sleep apnea four years after getting out and i also have buddy statements to send because i am appealing it. Any help i can get on t…

Initiating VA Claim After PEB Referral
I went through a Fit For Duty evaluation in the National Guard last month, referred to PEB, still waiting on unit to submit packet. Decided to start VA claim for percentage since the PEB ...process will be drawn out. Talked to the local VA claims office today, they are telling me anything I claim has to be linked to active duty service....I'm thinking that not exactly true. If the illness/injury is related to military service, regardless of status, it should be compensable (we can receive LODs on drill status). I have 4-5 years of active duty, including deployment. Can someone give me the straight story?

Temporary 100% post surgery/convalescense pay
Whats up guys, hopefully someone out there can help me out here. Ok I had surgery on my right knee (service connected) on 4-13-16 at the VA hospital in Phoenix. I applied for convalescense pay the day before which was 4-12-16. My surgeon wrote a statemwnt saying I would be out of commission for 8-10 weeks or more if "desired strength in leg is not met" how long does the VA take to process something like this? And my understanding is the VA doesnt pro-rate meaning my convalescent start date is 5-1-16 and for 8 weeks will that be from 5-1-16 until 7-31-16? I currently am at 40% so i get $699.36/month. With convalescense do they pay 100% per month (in my case its $3187) or w…
