Separation Pay / VA Compensation Pay Question
Hi All, I received the results of the PEB and was discharged 9/27/16 after 5 years of honorable service as an E-5. The Informal Board Disposition: sep w/sev.; w/o benefits, and Rating of 0%. The Findings of the PEB said TDRL, 100% rating. Am I going to receive separation pay, retirement pay, VA 100% pay, or a some combination of these pays? How does this work?

Got an award but now VA want to recoup funds!
I recently received a letter in the mail awarding me with a 50% rating. The very next day, I received another letter saying the VA would recoup all of the award money to pay the $30,000 severance pay I received upon separation from the service. There seems to be no way around this. Now , this is my question. I received $30,000 and was taxed probably around $6000, so I only received $24,000. The VA wants $30,000 and my DAV rep says it is unchangeable due to the timeframe. Is there a way I can file with the IRS to have the $6000 returned to me?

Does depression meds affect rating
Hello, I am rated 70% for mental and after a year of treatment, and seeing it go nowhere, they are recommending meds. I've been on them for a month now and still don't see any results but I have a question. What if they start kicking in and I am cured, would I still keep the rating? I did some reading and I'm still confused. I read one thing that says that the VA can't change my rating if the medication improves my condition unless it's stated in the rating. They used irritable bowel syndrome as the example. The person had severe but the meds made it moderate. The VA rated him as moderate but since there are no provisions in the rating for meds, he appealed and …

hearing loss Melodicmom
Hello everyone, I filed a claim back on November 30th 2015 for Tinnitus, Hearing loss, Vertigo, facial fracture, TMJ and migraine. A month ago, I received a rating of 80 percent and had 4 contentions deferred. Today I received an additional 10 percent for Migraines, rated at (50%) which brought me up to 90 percent. I was denied service connection for hearing, tinnitus and Vertigo. What I did not expect is they inferred a claim of Traumatic Brain injury, (From a motor vehicle accident and domestic violence) for me and awarded me 40 percent for that and 30 percent for a etopic emergency surgery I had forgotten about and 40 percent for TMJ. In the award for TBI they include…

CHOICE program
Can anybody tell me if this qualifies a Veteran to be able to use the VA's CHOICE program... The VA has refused Cervical Spine surgery on me THREE TIMES. So I decided to finally get away from the VA and go see an orthopedic surgeon in my area. I just recently had a new MRI and the results are now showing I have Cervical Myelopathy at TWO levels. I go this Wednesday (Tomorrow) for the follow up MRI to see what the treatment plan is. I hope its surgery because I am tired of all this pain and not having a life. Since the VA Neurosurgeon has refused me three times for surgery and with the NEW MRI evidence and maybe the Orthopedic Surgeon will say surgery is the only…

What to do now Filling for increase, DBQ help
Hello all, I'm having a hard time finding a Dr willing to fill out VA DBQ forms. Va docs will not fill out I've seen two private orthopedic Dr's. They are to busy to fill out they say. I'm rated 10% each R/L hip bilateral coxa vara, 10% osteoarthritis right knee, 10% osteoarthritis of lumbar spine. My conditions have worsened docs recommend PT, I do twice a week have received shots for pain no relief. My other question the coxa vara was documented prior to enlistment, fit for duty, aggrevated and documented throughout enlistment also at ETS physical. According to AR 40-501 coxa vara is a condition listed. I've been asked by VA Dr how I was even able to join the ARMY. Wai…

Yes, Sleep Apnea Question
I know people post all the time about sleep apnea, but I think my situation is different than all the others. I complained on my demobilization physical in June 2011 that I snored a lot and had trouble staying asleep because I was snoring so loud and falling asleep during the day, to the doctor and that my wife told me my snoring has gotten worse and that it was waking her up now (then). The doctor wrote a note that said "insomnia?" and that there wouldn't be a sleep study or follow up in service and that I had to follow up with the VA. So I filed a claim for "trouble sleeping", which the VA termed as "sleep disturbance" and was denied because I thought the meeting with t…
