Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. Tva Must Read
This is a must read of a few Judicial Decisions that hold precedents relating to claim issues involving, service connections, the duty to assist; impact of lay evidence, evaluation of disability. This link is a by-yearly issue, written by TVA (NVLSP). This is a short read but very educational for us Vets that aren't VA Law savy. In my opinion, from what I've read, I'm having serious doubt's on the credibility of these new DBQ>"Disability Benefits Questionnaires". and SNLs>"Simplified Notification Letters". Lower Back Disability C&p Examination/ Individual Unemployedability
I recently received the answer for the claim I filed in Dec, 2011. I was awarded 20% for my Degenerative Disc Disease with radiculopathy left and right extremities secondary to my service connected disability for 20%. They also granted me entitlement to individual unemployedability and determined my conditions to be permanent and total in nature. I thank God first of all, the Disable American Veterans for their representation in my case, and the Department of Veterans Affairs. Anyone Receive A "fair" Decision The First Time?
I know everyone's ideas for what they feel they should be rated vary. I am just wondering if anyone has had to wait, but in the end received a fair rating? I am in the St. Pete RO, and am waiting. I tried to seach this topic, but couldn't find one. (Might be an ominous sign) Has everyone had to appeal their initial decision? Did you get a lower rating, but find that the justification was fair, and did not appeal? Just wondering....Thanks!!

Gerd For Sw Asia Veterans
A fellow Veteran was denied SC for GERD under the new presumptive law for SW Asia Veterans. The VA states in it's decision that GERD is not a functional gastrointestinal disorder, but s structural disorder, therefore the claim is denied. Does he have any recourse or is there an error here by the VA?

Question For The Married P&t 100%
Well here goes. I cannot beleive I am dealing with this I just got great news 1st of the month I got 100% P&T Here is todays crisis going on way too much drama my wife who has insurance through here work she is able to continue working full time but wants to know if she happened to up and quit her job how long would it take to get her insurance. I told her that I was told she could nolt be carried by both insurance companies at the same time. Thanks just trying to get an answer to anyone else who had ran into this. Can someone give me any info or help with your opinions? I filed my claim for pulmonary artery insuffiency in 1984 stemming from a NAVAL hospital stay in a cardiact ward for over a month in 1966. i dropped the claims proceedure out of frustration and three denials the VA claiming that my heart disease was congenital. JULY 2010 i asked the VA to reopen the case, and provided them with a HEART DOPPLER ECHO EXAM as new evidence along with the Heart specialist statement that my heart was 100% normal and i have a tricuspid valve (which is normal} and not a bicuspid [bicuspid valve which would be congenital] as the NAVY and the VA claimed,this test proved along with the…

ptsd Claim Going Backwards.......what Does This Mean?
I checked ebenefits today and found out that my claim for PTSD compensation had moved from "Preparation for Decision" back to "Review of Evidence". What does this mean? Also, does this mean I wait another 8 months before something happens again. Will contacting a VSO help? Sorry so many questions...............thanks.

Does Va Take Dx From Mil. Medical Records?maybe Tmi For Men..
Or do they go by what is done at C&P? I had a pelvic at my C&P, but in order to see my cyctocele the dr. would have had to turn the speculum sideways. (Otherwise it is pushing against the rectal wall, and bladder holding it up) She did not do this. However, I was sent to a specialist at UNC while in the military who did a lot of testing and measuring, and I sent a copy of that report in with copies of other medical records with my claim. I am just wondering if the VA goes off of diagnosis' given while in service, as they are in your medical records, and treatment of them is in there as well? Thank you!

Va Retro Pay Calc Question
80% to 90% Married w/1 child + 3 dependants Granted 17OCT Retro amount-926 Amt direct deposited this AM (Memo) for 1APR - 1875.00 Shouldn't it have been at the new rate (2109.00) and not the old rate? Retro would have covered Dec, Jan, Feb (Oct doesn't count, Nov, Dec, Jan pay) and 1APR would be the start of the new rate, right?

I Checked Box 18
Prior to retirement, I filled out a Quick start claim with a VA representative that worked at my base. When it came to box 18 "do you want retirement in lieu of VA compensation" or something like that, I asked him what it meant? He said that by the number of things I was claiming, check it, it doesn't matter. He also added that if you were 50% or more, CDRP is automatic. I trusted him and now I think it is biting me in the can. I retired 1 Sep 10, I had my compensation exams in Jan '11 and got my decision letter July '11 saying I was 60%. It had that line in there that I elected to receive retirement in lieu of VA comp., but didn't specify what the ramifications …
