Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Taxes
Yet another negative impact on the servicemenber caused by the VA incompetence. So my retirement year (2011) I could best benefit from a tax break, but it will not happen. The year I will not need the tax reducuction, I will get it? This will cost me close to 2,000 in taxes How does the tax situation work out when the of VA's average 200 day disablity review roll from one year to another. Do I have to refile or just claim the benefit in the year payment is received. I am already losing state and federal employment benefits, home loan benefits and other benefits because of this "too busy" delay. The VA is an embarrassment and must he over hauled. I just learned t…

hypertension Chronic Fatigue
As I am taking Atenolol (100mg) a day to treat my service connected high blood pressure. what possible rating could I get by submitting a claim for chronic fatigue secondary to hypertension. This was found in my c-file a few years noted that veteran has not filed a claim for this. Hint, Hint!!. Therefore, it is time to put this in and see how this winds up!! I am always tired, spend most of the day taking catnips till time to work. And a recent driving trip to California took much longer as I can only drive about 2 hrs till it is time for another nap. I'm not sure if they give you 10 or 20% if anything if this is filed as a secondary issue. With a new year upon us, it is…

Question On Separation And Severance Recoupment For 2 Seperate Periods
My question is I was in the USMC from 1995-1999 and received a medical discharge and a 0% rating from the USMC for depression but was awarded a little over $10,000 in disability severance pay. Later on in 2004 I joined the Army National Guard with a medical waiver and later transitioned to AGR (Active Guard and Reserve) and was discharged form AGR with aprox $27,000 in Separation pay after 5 years of AGR duty. I am aware that I will have to repay this separation pay in full before my VA disability payment kicks in. However will the initial $10,000 in disability severance pay be required to be repaid as well even if I was granted a waiver and returned to service and…

Administrative Review
My initial Claim was opened June 05, 2010 and closed without a complete resolution. The claim has re-opened and went through the development phase again. I had two additional C & P exams, one in July and the other in august of this year. eBenefits shows that my claim is in the gathering evidence phase, but back in September I was told the VA had all the evidence it needed and was waiting to go to a rater. I called the other day and was told the same thing, that they have all the need and my file was waiting to go to a rater. I know the VA is backed up (my VRO is Waco), but I am begining to think that administrative review means my file is sitting on an administrator's…

I'm Lost! What Can I Do?
Hi everyone! I'm new to the forum and I have found it very useful so far. I have a few questions and I hope that they can be answered. I was MEB from the Army in 11/2006 for undiagnosed consistent abdominal pain and nausea. I was awarded 0% from the Army with severance pay. Well this year, I had severe abdominal pain and was admitted into the VA hospital and I was diagnosed with Crohn's disease. I was admitted a second time 2 months later for severe ulceration and inflammation in my ileum and was prescribed many meds to treat my condition. Here is my question.....In the Army I went through many test to find out what was going on. I requested my medical records fro…

Thought I Had A Success!
I have been watching ebenefits and saw that my appeal finally after almost 4 years landed with the VLJ. Checked it a week later and it said a decision was made and it was mailed out to me. I was happy and decided to call my VSO and check. They said that it was remanded (they think) and gave me another number to call. Called that one and they said they have no idea on what's going on with my claim. Damn it!

Next Steps Seeking Advice Help
GM, I have had a 10% rating on my wrist since 2008, I had 2 surguries on the same wrist before I got out. DR told me that if doesn't get better then a 3rd surery would be needed that was in 2006, I told my Dr at the VA clinic this info and have been foghting for them to look into it, they never did. Because of them waiting so long I developed arthritis in my wrist I filed for an increase denied, well I started having trouble in my left knee once again fought with my Dr at the clinic to look into it she stated that it was impossible for me to have arthritis in my knee because of my wrist, needless to say she is gone but new Dr states that it is possible and after 2 yrs …

Va C&p Pay Increase
I'm hearing Rumors of a 3.6 - 3.7 % Pay Increase... Social Security's website shows a 3.6% on the COLA, effective Jan 1, 2012. It's been 2 years since we've seen a pay increase, and VA Pay usually falls in line with SSI. Are we getting a Pay Increase on our monthly pay?

tdiu Individual Unemployability
I had a 10 percent VA disability, then the VA awarded me a 60 percent disability, which interprets to a total 60 percent disability. I had another claim, which has not yet received a determination. Along with that I have a dependent's claim which has not yet been awarded because the VA lost the paperwork and I had to refile for dependents in August. The VA has urged me to file a IU claim, and later, they advised that I file a Social Security disability claim. I am 60, have not worked a full time job since 2001, but I have worked some temporary or limited time jobs -- I just can't stay on a job for eight hours a day and definitely not a 40 hour work week. I filed the IU la…

Upcoming Review Of All Disability Claims?
Post #27 at the URL below on the NYTimes web site is by a vet who says his VA doctor told him there is a planned upcoming review soon of all disability claims with an aim to cutting benefits wherever possible. Has anyone heard anything about this ? I was expecting such a thing but didn't think it would happen until after the 2012 election. http://community.nytimes.com/comments/www.nytimes.com/2011/11/14/opinion/krugman-vouchers-for-veterans-and-other-bad-ideas.html?sort=oldest&offset=2
