hearing loss Assistance with Statement of the Case (SOC)
Good afternoon everyone, I have a question about a current appeal, and the subsequent SOC I received from the RO. When retiring from the Army in 2010, I participated in the benefits delivered at discharge (BDD) offered by the Fort Sill, Oklahoma transitioning processing center. I received an evaluation for PTSD/with Major Depression at 30% disabling, tinnitus at 10%, and hearing loss at 0%. Once out of the Army and working in the civilian world I continued treatment for PTSD with local psychologists and psychiatrists, and struggled with transitioning. In September of 2012 I applied for an increase for PTSD with major depres…

situation with the VA
This is my problem. I was injured in an accident while in the Army. I messed up my neck and back and never received proper treatment. I needed to get medical care, so I went to the VA and they VA informed me that I can't get medical treatment until my disability rating was approved. I applied for disability and waited a year just for them to deny it and state the LOD was signed wrong. I checked with the VA hospital and they stated that it was correct. I had to file an appeal. In the meantime, I have to fly to Russia and Ukraine to get affordable medical care as my health insurance here costs too much to use. My injuries also caused me to be unable to work in a physical fi…

ptsd Missed Appeal - No letter sent
I served in the military in 1996. During basic training I was injured. 1. I applied for disability due to the injury in 2000 and was denied then again in 2002. In 2002 I never received a letter stating the denial. I called several times and was told that I was denied. In 2016 I went back to apply because the back & neck injury that I received in the service is really server now. When I went to reapply the lady at the VA Hospital told me that I was NEVER denied. That I was just rated at 0%. She said that I should have been told whenever my condition got worse to apply for an increase. Since I never received a letter and I was told verbally by 2 different p…

tdiu Missed my one year NOD timeline now what?
Hi everyone been awhile since I have been on here. First of all thank you all for how much knowledge that you guys (and gals) contribute about VA issues for veterans like me. I fancy myself to be pretty sharp most of the time but this process (va disability) is more overwhelming than anything I have ever tried to do in my life! Like most I suppose I lurk much more than I post but this site has been tremensously helpful for me especially in the really complicated areas like CRSC. So thanks again really, I truly appreciate it. My question has to do with what to do when you have passed your one year window to file an NOD. I was on the ball with all of this for almost t…

Cancelling a Appeal
Hello I filled and appeal back in 2011 for back, tmj, sinuses/ allergies. Etc To make a long story short, back in 2012 they cancelled it due to failure to respond with a form 9. Which was a lie and I have proof. Didn't find out that it was closed until 2014. I ended up going to my local congressman and submitting all the proof that I had indeed responded on time. In 2015 my appeal was reopened and I received a apology from the regional appeals coach. With 6th year of waiting approaching, with still no response or progress . I think it's best that I just cancel the appeal and resubmit as a regular claim. My questions to you guys is , …

on my on now,and i know my claim better than any one.
i have been up and down through all the va courts, and i;ve had lawyers help me ,the va made so many mistakes that the lawyers easilly gets me a remand, which pays them but not me ? i think i;am the only one on this forum thats still not sc. i plan to go back to where it all begin my first denial , and cue that decision in 1985,they denied because the x-ray showed a defect , and not chronic condition in service.so now i am gona ask them to reconsider useing the correct law they should have used during the time from then to now. which would be 67-90 and 8290 pres.opinions, which are retroactive to that claim, i dont think i need to get it re-opened .…

E-ben stat help please
So my lawyer and I both received, Statement of the Case, and have been waiting for my case to be moved to the BVA. I logged onto E-ben today to see if there is anything new. Here is what it says now under claim stat. Current Progress: Appeal pending - Notice of Disagreement Location: Originating VA Officef A little backstory... Not to long ago it basically said that a decision has been made and is waiting to be transfered to the BVA. The only action my lawyer took after getting the SOC was to have my VA doctor fill out a form stating I couldn't hold gainful employment. Basically the document my va doc filled out countered the VSO's reason to deny me 10…

Appeal for EED 2009
VLJ judge made decision already..Wondering why it's taking so long to get decision in mail. VSO in St, Pete regional office hasn't received anything either. I did request a waiver at my BVA hearing in April of this year. I also put in a FOIA request to get my vocation rehabilitation records. For some strange reason the request is showing as a claim, The current status is gathering evidence. In addition to EED I have IU on appeal. This is what E-benefits is showing for the appeal, 07/13/2016 Pending Case Dispatch This indicates that a Veterans Law Judge has made a decision on your appeal, and that final administrative steps are being taken b…

BVA order
Can someone tell me what this means. ORDER The appeal for an evaluation in excess of 10 percent for right ankle limitation of motion prior to September 10, 2008, is denied, but a separate, compensable, 10 percent evaluation for right ankle instability prior to September 10, 2008 is granted, subject to law and regulations governing the effective date of an award of compensation. The appeal for an initial evaluation in excess of 10 percent for left ankle limitation of motion prior to September 10, 2008, is denied, but a separate, compensable, 10 percent evaluation for left ankle instability is granted, subject to law and regulations governing the effective date of an award …
