Appeals on CD-ROM Digitized C-File >Ms berta
Ms berta & other hadit members I Notice on the New CD-ROM Digitized C-FILE..At the introduction of the first part of the CD it says if you disagree or want to Appeal the information in this C-File CD you have 60 days to Appeal from the date it's received. sure don't give you much time do they.

Should I file NOD or submit new claim?
Hello, My back story: resigned my active duty commission in 1999 and submitted disability packet for bi-lateral shoulder condition (separated left shoulder, bursitis right shoulder), left knee (x2 surgeries), right ankle blow out, anemia, sinusitis, tinnitus, hearing loss, vertigo, right wrist tenosynovitis, Bell's Palsey, headaches, viral syndrome, low back pain, hemorrhoids, and bilateral hand and finger numbness due to mild ulnar entrapment. In late 2000, they came back with a20% rating- 10% for left knee, 10% for right ankle. I was also awarded 0% for sinusitis, right wrist, Bell's Palsey, hemorrhoids, and right shoulder. Help.VA Lost all Documents on my AO claim filed in 1996
I filed a claim in 1996 for IHD, Lucky for me I MISFILED my own claim in with House purchase documents(OK, no suggestions that I go to work for the VA) 20 years later I find it and knowing what little I know, I filed a claim for Retro back to 1996. In less than a month, I got the denial letter..VA Denial states they have no documents or records that a claim was initiated or denied prior to my claim filed in 2010. Like a dummy, when I got the denial letter in 1996 (LA, CA VARO), I threw it away. Why keep a dead horse... So now, 20 yrs later.............I need some suggestions how to refute this? Case cites from a similar situation?

Appeals and Remands
Anytime you get either appeals or remands from the CAVC or BVA DONT wait for your attorney or vso to move the case faster its nothing they can do until you make Attorneys or VSO file paper work on the VA asking what's wrong or where the claim is at and then treating too hire another attorney. I had to do all of this plus another email to Bob twice just because the RO don't follow the remand order. MY medical records suppose to be sent electronic from RO 5 months ago to Director for extra-scheduler now they will be sending in the records only after contacting Bob now another three weeks. Retro Pay effective date on Appeal
OK I've been searching and just getting a headache. I filed my original claim in Jun 2012 In Nov 2013 I was awarded 70%SC Major Depressive disorder, 0%SC Thyroid, My physical claims were denied, I appealed right away since I had copies of my Military medical records and could show they were SC. I used a VSO. While waiting on my appeal I relocated from SC to Fla, so I was assigned a new VSO for my case, the new VSO advised that we should add a request for PTIU this was done Nov 2015, In May 2016 I was awarded the PTIU SC rate stayed at 70% stated there was no change in the condition being paid at 100% rate PTIU. Certification and Docket Number
My Form 9 was submitted about 19 months ago. I spoke with Charlie (1-800-827-1000) and he indicated my appeal is awaiting for certification before going to the BVA. However; he indicated the appeal has a docket number. Is this uncommon to have a docket number before the appeal is certified? Also, what is the length of time for an appeal to be certified?

Contention kicked out of NOD
Going to try to keep this long saga short. Filed initial claim July 10 and received decision Oct 11. Virtually everything denied since SMR's magically disappeared sometime after Nov 10. Overnighted my copy of SMRs about a week before decision but they just sat in VARO mailroom. I requested a reconsideration of all contentions due to being rated without records that, were in fact, in VA's possession. Reconsideration granted for all and got improved ratings for most. This was in Apr 2012. After scouring the decision letter I noticed that one of the contentions wasn't addressed It was just left out of decision all together. Service Connection
I recently had a C&P on a condition that I have a NOD. My original claim requested service connection and they did no ROM back on original C&P. Would they send me to a C&P exam and take range of motion (ROM) measurements on a condition they intended not to service connect? This has been going on for over three years, I was granted 10 percent.

BVA Hearing Aug 30, 2016 - any advice
Hello, I finally received my hearing date with the BVA in DC. I want to be as prepared as possible. I'm currently rated 10% (Total 50% for other issues) for my bilateral feet, calcaneal bursitis. I contacted the Maryland of Veteran Affairs representative that is going to meet me at the hearing, he stated that I do not need to bring anything and that he will brief me an hour before my hearing... I'm a planner and liked to be prepared for anything. I plan on getting a copy of all my related medical records from the VA and bring them with me.
