Remanded Appeal back at the BVA! Phew!
Hi everyone, Last year, my appeal was partially granted and the rest (EMD) was remanded to the AMC. My DAV rep wrote the arguement to the remanded portion and it was assigned to one of the BVA attorneys on June 2, 2016. Yesterday I checked ebenefits and saw that the status had changed to "With VLJ". I know from the last time on the original appeal, it was with VLJ for about a month and a half. Any thoughts on this time around? Also, my appeal is from 2009 ?

RO Hearing question
I sent in my NOD application asking for a DRO HEARING but attached no new evidence (have plenty). My question is will RO ask me to send in my new evidence at some time prior to my actual scheduled-to-be DRO HEARING? I have read you should send new evidence immediately, then some say wait and show it to them in person. Do I even have either of these options, or not? Hope someone can offer their experiences ........(1) sent new evidence with NOD form.....and (2) anyone who waited till the Hearing to provide all new evidence. Wayne

Not sure what is best plan
So, I’m not totally sure what my best plan of action is. I will lay out a time line and then a few questions 2001-2005 Active duty USAF Honorable discharges 2009/ entered VA system and filed a SC claim for tinnitus and tendonitis of the right shoulder Approved 10% tinnitus Approved 10% tendonitis of the right shoulder 2011/ diagnosed with Ehlors-Danlose syndrome, a genetic connective disorder 2011/ filed for NSCD and SSID for the EDS, got NSCD first and then got and switched to SSID 2013/ filed SC for EDS, not a new claim but under the shoulder claiming that the tendinitis was a misdiagnose. ptsd Appeal or no?
I just got my proposed VA ratings back. I was originally referred for an MEB due to Migraines. I have a host of other issues (Meniere's disease and PTSD) that the Army claimed "meets retention standards." The PEB only found me unfit for Migraines even tho I have been inpatient 5 TIMES in 1 YEAR due to severe PTSD. ptsd VA Admits in service treatment but denies connection?
Hey guys. Thanks in advance for reading this! So this is what I received today for my sleep apnea claim (See Attached) So they acknowledge I had sleep apnea in service. Then deny my current sleep apnea is associated with me having sleep apnea in the past? For the record, the words "sleep apnea" were never used with me while in-service. They just told me I must not be getting sufficient sleep. It wasn't even clear to me until my current doctor submitted me for a sleep study that that is what they were talking about back in 2004-2005. So like, two totally different sleep apneas? VBMS Appeals in E-bennies
I received the dreaded denial letter earlier this month for Left knee condition secondary to Right knee S/C condition. I have been trying to get the left knee covered due to overuse and severe limp, due to 6 Right knee surgeries, one of which was a TKR. My Primary doc at the VA wrote an awesome Nexus letter and I gave it to my VSO at the DAV...she submitted it with a reconsideration request, stating new material. Appeals and Decisions Question
Question about the rating and decision process on remands, and my apologies for any inconvenience trying to understand the remand process. When the remand is sent from the BVA to the RO with specific instructions, can the RO make a favorable decision and give a rating on a previously denied claim (remand) if they see fit upon review of the case and file?

HMMM, Not the way I expected it!!!!!
Well got My BBE for my claim Intent Date 04/30/2015, Filed 01/24/2016, they granted me 100% SC for BiPolar disorder secondary to m,y back issue. I have not heard from anyone since February about my appeal, but i can take it a little easier now knowing that I am 100% Also granted SMS S (Housebound)

Need Advice--Can a Vet file a New Claim While an NOD is submitted
Vets: I submitted and am processing an NOD for my first claim. Also, can I file a new claim for a new contention while I have an NOD Pending or does everything stop while the NOD is being processed for the DRO that I asked for ? I know that the DRO review is going to take one to two years? Also. If I file multiple NODs, for multiple claims will the VA consolidate the NODs into one single NOD? Thanks in Advance, Rootbeer22

What a Mess!
Had requests for BVA hearing going back to 2009, in another state. I Moved. I started new claims and requests, the latest an 1151, denied, then BVA hearing requested. Had BVA hearing for 1151 (Necrotizing pancreatitis,. failed operations,) too many health problems to list (plus it is a fatal disease, time is not on my side), we asked judge to put all appeals in one.
