  1. Since you're a person who knows, or can ask someone who does, maybe you can explain what we can expect from this "new way" the VA is doing their decisions?? I believe, some yrs back, the court started requiring the VA to explain their "reasons and bases" for their decision(s) and the failure to do so left the decision up to a remand or perhaps reversal. From what I see, this "new way" violates that requirement, doesn't appear to follow that rule, and as such, won't that leave all these new decisions up for appeal??? It seems, to me, like the VA has just found another way to delay the claim and screw the vet, one more time! pr

  3. Your c-file and medical records have nothing to do w/each other. You need to transfer your medrecs to your new state. It should have no bearing on your claim. pr
  4. If it's just a simple error like that, you can write a letter stating what the error is to the Veterans Service Center Manager and they can correct it, usually within 30 days. Be sure to list the "reply to number/initials" in your letter. pr
  5. Rich - sorry to hear of your problems! The VA will release copies of your C&P exam results, if you request them and sign a release to get them but won't just send them to you because they feel like being "nice." As for how long it takes, it can be a week to a couple of months but usually within a few wks. Also, you can contact your local Veteran Service Orgs (DAV, VFW, VVA, AL, etc) for one time cash assistance. They all have programs to help vets and their families when they're down. pr
  6. They don't rate a knee brace, anymore than they rate a wheelchair, prosthetic extremity, or hearing aid. They rate the current condition or the effects of the disease. pr
  7. You could probably win if you appealed, as I don't think they can put that kind of restriction(s) on it. I believe there is case law to support this also. jmo pr

  9. Depending on what your percentages are, to get you to your current 70% as posted, 10% of 30% is 3% and added to 70% is 73%, rounded down to 70%. Just sayin . . . pr
  10. To my knowledge there's no need for an SSOC if you won the case. They usually issue those when the case has been denied. jmo pr

  12. Need more info before I comment. As to his PTSD, I'd put in for an increase, if he's past the NOD deadline. The VA usually lowballs those ratings so he could get 70%, or 100%, if it's gotten worse or if they lowballed him. As to his BS w/"V" device . . . don't know what that has to do w/anything. Kinda like combat vets saying they should have a higher rating, for PTSD, when in fact it has nothing to do with how bad they had it then, but is about how bad you/they have it now and tomorrow. Not saying this to piss you off but I just didn't understand the BS comment, that's all, unless it was to point out his great character, then. jmo pr

  15. I agree w/Carlie, tho, that the main thing to work on is service connection (sc), as w/o it you have nothing. While aiming at the SC, don't fail to keep the original effective date, by missing a deadline or by allowing at any point for the VA to call it a "reopened claim" requiring new and material evidence. jmo pr
  16. Here's the way I see it: Any time the VA receives additional evidence, they are required to re-decide the claim, either for or against. Failure to do that is an error in procedure. Once they decide a new year begins. pr

  18. I think your safe, especially if you're considered legally blind. Being able to successfully attend classes, even online, doesn't equate to being able to work. I'd say go for it. pr

  20. Yup, it's best to quit now. No sense trying to win something if your not ready to fight it all the way!!! What I can tell you is if you can get rid of that attitude you can win!!!!!!!!!!! It'll take a while but in the long run, it can be done. Took me 10.5 yrs to win mine but I won. I still have another that's been going on for 23 yrs and been to the court twice and I know I can win, "if I don't give up." The choice is yours. jmo pr
  21. Could you please explain N/P, as I can't decipher it (brain cramp)??? Also can you post your age, as I'm not understanding the quarters issue. SS often tells claimants they lack needed quarters based on their disability onset date, when in fact they do have enough quarters if they use their "actual" disability onset date and not their date of claim. pr
  22. vet2010 - I would file for P&T, now, while securing your medical records for delivery to the VA on a subsequent date. Once you submit the P&T claim you can send any additional evidence needed. Same goes for the SSDI decision. jmo pr
  23. About 20yrs ago, i read in one of those veteran claims help books something that I believe is still true. At that time, the BVA had about 468 attorneys who's sole purpose is to deny your claim. Think about it!!! They work for the VA, not for the vet. Why do you think they make so many errors??? jmo pr
