  1. The VARO's routinely asks questions, of the C&P examiners, that will give them a reason to deny the claim. You could certainly have a CUE. jmo pr
  2. Generally, if the current VARO finds you have moved, they will dump your appeal, on the new VARO, thereby improving their numbers by "one." It's all about the numbers, not about the claims, themselves. When I notified the VA of my new address in Idaho, they transferred my appeal to Idaho. I contacted them and advised them I didn't want my appeal moved, and they returned it to my VT VARO. pr
  3. Fat - you can't file a CUE until the one year appeal period has run out. The decision must be final, meaning the one year appeal period has expired. Any CUE filed before that one year, will lose, based on the decision not being final. The VA's definition of a CUE and an reasonable & prudent person's definition of a CUE are greatly different. pr
  4. No offense meant but I couldn't stop laughing when I read your post. It's been just over a month, since you filed it. I would guess it'll be well over a year before you hear anything but I'm just going by how they've handled claims up until today. Are you sure you have a CUE?? pr
  5. Yes, they accept copies but they don't like to because they consider us veterans to be liars and cheats. They feel we would alter the documents and while there are a few vets that would, most wouldn't. They'd get caught in the end. jmo pr
  6. A lotta vets use weed & most counselors consider it okay and it actually does less damage than alcohol does. pr
  7. I would keep any originals and send only copies. They would need to pry the originals from my cold dead hands, as I would never allow them out of my sight. I would not weed out anything from your 201 file. I would only send copies of pertinent civilian treatment records(ie; MRI's, EMG's & surgery reports). jmo pr

  9. SGT P - No offense meant but are you sure you're at 100%?? 70% + 50% = 85%, which is rounded up to 90%, using the VA's math (the Combined Ratings Table). Sorry but it can take a little time for VA to pay, also. Nice fish!! Welcome to hadit.com. pr

  11. IMO: the DAV is full of sh*t, as they tell you what you want to hear and rarely do much at all! It is best you do your own claim. If you rely of someone else then you'll get what you deserve, in the end. Again, jmo! You need to be extremely active in prosecuting your claim. Good luck!! pr
  12. My feeling is that: "if the claimant is concerned about facing another C&P exam, then they should not apply for an increase. The VA rarely orders another exam, unless it's a re-examination of a temporary award, where the claimants condition could improve, in a year or more." jmo pr

  14. I would. I emailed her about 10-11 days ago and got a response that she was sending it to someone to check on, the same day. Haven't heard anything since. Gonna email her again tomorrow and see what's going on. pr
  15. Kate - I'm surprised you can even get thru to your VSO! The VSO's, housed at the VA get free space/rent, phone, electric, etc., and are, in most cases, in the back pocket of the VA. jmo pr

  18. I will explain this one last time. They don't owe you for March. Your award effective date was 20150220. Payment starts on 20150301 meaning you start earning that payment but it doesn't actually get paid until 20150401. And that's how it works. When you receive a payment on the 1st, it's for the previous month. VA doesn't pay benefits in advance. pr

  22. Hi Ted - Welcome to Hadit.com. If you have strong evidence, you should win, easily, but it does take time. Just wondering how it feels to have thrown away about $335,000+/- over what you thought about the "stigma" of having PTSD?? Too bad. Did the VA diagnosis your PTSD in 1983?? If so, you might have a claim dating back to '83 but it would be a real long shot. jmo pr
  23. I believe, once you reach 50%, the VA needs to take care of all your conditions, SC or NSC, but they are allowed to recover anything they can, from any insurance you may carry. Someone will correct me if I'm wrong. You need to fight the discontinuation, of SC, for hypertension, and you have a very short time to appeal, something like 21 or 30 days. You need to request a hearing, now. jmo pr
