    I had a reputable attorney and in a way felt attacked by the person for continuing my journey to 100% P and T and not excepting being tdiu 100% P and T after an appeam they got me, they can be wrong as well. I got to 100% scheduler P and T with doing my own research from hadit and sharing my stories on the way to that it. Thank you Hadit for being here

    SDVI (The "free" or "waiver of premium" life insurance for disabled Vets) plan has ended Dec. 31, 2022.  
    If you have the plan, you may keep it, and if you had waiver of premiums, they should continue to pay those.  
    My advice:  NEVER EVER cancel the SDVI.  Never.  Its like throwing money away.  If you need more life insurance, well, go ahead and get it, but dont give up your existing no cost (premium waived) SDVI.  I guarantee you wont get a better deal.  VA wants to "Convert" some of those plans to VA life.  Dont do it.  
    Its a conversion that costs YOU money.  Again, get additional insurance if you need it, but dont surrender your SDVI, as they will continue to pay those premiums until the policy matures, and then you can get the $10,000 whether you are alive or not, but only if you keep the policy.  
    If you are desperate for money, you can borrow from the cash value.  Your heirs will get the face amount
    minus the loan.  So, if you borrow 4000 and the policy is 10,000, then your heirs would get $6000, minus some interest.

    If I was you I would reach out to your state representative or congressman to inquire what they could do. Their VA member on his or her staff will speak with you with what they can do in my case they flagged my file for a congressional inquiry never hurts to ask

    Agree my claim was actually a CUE claim filed in 2014 and decided 2016 but they lowballed me but I didnt care I was happy with 90% retro for 6 years but after the next year I went to 100% PT made me think why now its always been P and T should have been 2010 when I got out not 2016 when my appeal was granted

    This mostly applies to new members.     WE want you to ask questions, and volunteers try to give good, helpful advice.  Dozens and dozens of Veterans have benefitted by hadit advice, including me.  
    ASK YOUR QUESTION in a NEW topic.   To do this, go to top right where it says, "Create" and select "New Topic".  
    Asking your question in someone else's topic is unlikely to get you the advice you want because many people just wont read those old posts..other's wont even see your question because its buried deep in an old post.  
    Creating a new topic should put your question "right on the top", where it can easily be seen by those people who have knowledge of your issue.  
    Asking your question in someone else's post (hijacking their post) creates confusion because its often difficult to know which question is being answered:  Yours, or the original poster's.  
    I will also reiterate:  Give your new topic a relevant name, such as "How do I appeal a BVA decision?"
    But not, a general "need help".  Be specific.   Yes, we know you need help.  But "How do I appeal a BVA decision" will often get better answers, because maybe they just got done appealing their's, so they say, "gee, I can answer that one".

    I’m no expert on appeals but id say you may have a shot at a CUE claim and get it backdated to the original claim. I in my case my claim originally in  2010, found this site asked questions but waited to finally appeal after I went to a DRO hearing in 2016 spoke to the judge in person with my attorney. And she flat out said do not file a reconsider for right to the BVA and it has to be granted there... I an idiot opened my mouth of my attorney’s objection. She pulled me aside and politely said I’m going to save you years just trust me and she went on to explain anything involving anything over 25k of retro possible alittle less cannot be granted here at the Philly RO, but what I will do and we discussed it with my attorney is certify your appeal to the board as soon as he sends it to me I’ll send it to the BVA. This was in May 2016  and 2 months later because she had expedited it as a hardship it was approved money in account two months later..... I’m no fairy tale story but if you ask for help at the VA the right people do show up and if not I’ve fought my way through everything I’ve had to earn with the VA system. Unfortunately they have closed the few secrets I had used of course because they worked..... “but the only way to win an appeal that far back is CUE, but hire an attorney” just my advice sucks like for me I was entitled for 125k and had to pay a chunk for the fees but if i didn’t the VA likes to pretend that vets can’t learn VA law on the side and will deny everything they can if it’s just you

    Now I need to get my spouse all fixed up for her neck and Back surgery  which she will be in a body cast a long time  6 months to a Year 
    anyway SHE HAS HER SURGERY MAY 18TH AND HOPEFULLY WILL COME HOME IN A FEW DAYS FROM THE HOSPITAL AND i WELL CARE FOR HER UNTIL i CAN GO SCHEDULED MY SURGERY...AND HOPEFULLY WE BOTH CAN LIVE A SOME WHAT BETTER LIFE WITH OUT ALL THE PAIN AND PROBLEMS THAT HAVE BECOME A HARD PROBLEM IN OUR LIFESAS WE HAVE AGED AS FAITH WOULD BE.

    This decision says it all regarding CUE, Re-opens, 38 CFR 3.156, and having Persistence.
    It as shows how erroneous the VA can be in their decisions- with errors that can deprive the veteran of their proper SC awards.
    That goes for widows as well- as every initial decision I ever got from VA was completely incorrect. And no vet rep  I had helped me at all. 
    The only person who ever helped me was my daughter,a veteran, -whose initial DEA claim contained a BIG CUE and Mommy got that fixed in 3 weeks.
    She asked me many times when reading my decisions, can't they (VA)read?
    I answered' No they cant read or they simply don't want to read the evidence.'
    The VA claims process was bad 20 year ago but now it is worse than ever,  in my opinion.
    I am glad that the above PTSD Vietnam veteran lived long enough to see his proper SC award....
    35 YEARS after filing his initial VA claim.

    It’s also fine and your lawyer can negotiate with your lawsuit winnings as was in my case with Tricare. They got 118k could have gotten 200k at least of my 300k but since my pro take you’re money got 100k they took 100k I was left with 100k in service so I was happy To be alive and back on active duty to complain. I never even heard of the VA until my separation in 2010. And took a lot of research to know what and how they work always changing always learning.... thank you hadit.com

    I went through the same hoops but of course I was 0 percent for 8 years before they made me 50% by going to my LHI appointment and not getting my appointment together with my TbI residuals. At least they ordered a second one that was my good sign....

    If any Hadit members have an ongoing in Process IMO/IME from Dr Craig Bash should call Skip at 925 381 7571. When you call have your information with you.  Dr Bash's west coast operation was burned to the ground during the California wild fires and a lot of records were destroyed.

    So A trick I learned back in 2016 when your claim has closed and no updates visible and checked everywhere but your positive it will be positive results. Two options I have tried this in a couple years, people may hate this but file a new claim for an increase there when it shows you what your ratings are currently it will either show your increase or new disability or it will look funny And show unable to process it. And then instead of going through with the claim delete the application as if you changed your mind....

    VA and Marijuana – What Veterans need to know
    Several states in the U.S. have approved the use of marijuana for medical and/or recreational use. Veterans should know that federal law classifies marijuana as a Schedule One Controlled Substance. This makes it illegal in the eyes of the federal government.
    The U.S. Department of Veterans Affairs is required to follow all federal laws including those regarding marijuana. As long as the Food and Drug Administration classifies marijuana as Schedule I VA health care providers may not recommend it or assist Veterans to obtain it.
    Veteran participation in state marijuana programs does not affect eligibility for VA care and services. VA providers can and do discuss marijuana use with Veterans as part of comprehensive care planning, and adjust treatment plans as necessary.
    Some things Veteran need to know about marijuana and the VA:
    Veterans will not be denied VA benefits because of marijuana use. Veterans are encouraged to discuss marijuana use with their VA providers. VA health care providers will record marijuana use in the Veteran's VA medical record in order to have the information available in treatment planning. As with all clinical information, this is part of the confidential medical record and protected under patient privacy and confidentiality laws and regulations. VA clinicians may not recommend medical marijuana. VA clinicians may only prescribe medications that have been approved by the U.S. Food and Drug Administration (FDA) for medical use. At present most products containing tetrahydrocannabinol (THC), cannabidiol (CBD), or other cannabinoids are not approved for this purpose by the FDA. VA clinicians may not complete paperwork/forms required for Veteran patients to participate in state-approved marijuana programs. VA pharmacies may not fill prescriptions for medical marijuana. VA will not pay for medical marijuana prescriptions from any source. VA scientists may conduct research on marijuana benefits and risks, and potential for abuse, under regulatory approval. The use or possession of marijuana is prohibited at all VA medical centers, locations and grounds. When you are on VA grounds it is federal law that is in force, not the laws of the state. Veterans who are VA employees are subject to drug testing under the terms of employment.     So apparently the VA has said it was Psoriasis Vulgaris but that doesn’t explain why I had to buy medical tape and arm compression soaks for when the pain in my wrists and elbows become so bad I can’t do anything unless I have them on. But I don’t understand it I keep them on for a month or two and tape my wrists so I can pick my 3 year old and it feels good for like a month or two and then it’s back to compression soaks and taping wrists and sometimes my ankles. I don’t know how my knees are the only pain free joint on my body ugly red knees but pain free....
