  2. If you could set up an appointment to see the doctor I am pretty sure you could get a good IMO. He has to see you in person. You would bring your SMR's and any other records you want him to consider. His name is Gary Arthur and he is in Tampa. I know it is a four hour drive to Tampa, but if you saw him one day and stayed over it would probably be worth it. I know this doctor from personal experience. You tell him I referred you. I can send more details.
  3. That is a good letter from your doctor about the Apnea being SC'ed. Damn good letter for a claim for Chronic Pain Disorder as well.
  4. Yes, you can hire a lawyer. We need more facts regarding your claim. What is it you are claiming and what evidence do you have for service connection? Have you had a C&P exam? Did you file with the BVA or VARO?
  5. Reconsideration would be a good idea. Just remember the NOD clock is running. Don't wait until one week before time runs out to file the NOD. As I understand it you must have new evidence for a reconsideration. I have done reconsiderations and regular NOD appeals. I don't know if one is any better than the other. If you want a face-to-face you need to file a NOD and ask for a DRO Hearing. Reconsiderations can be faster than NOD/Appeal route.
  6. If you use the VA you may be able to sue them one day when they screw up. This is an added advantage.
  7. You know all these drugs are addictive to one extent or another. The SSRI's are the least addictive if you can wait 5 weeks for the anti-anxiety effects to kick in, otherwise it is the valium type drugs. All the drugs in the valium family are highly addictive. If you stop taking them suddenly you will have some awful symptoms.
  8. You were given some very bad advice about not appealing the 50% rating. I would ditch whoever is advising you. If you don't file the NOD you will lose your effective date. You can file the NOD and ask for a DRO Hearing. By the time you get the hearing all your other things like SSDI and Voc Rehab could be resolved. What you really need is medical evidence that your husband cannot work.
  9. Can a spouse pick up on a remanded claim if the vet dies before the decision, and could she/he appeal a decision? If my CUE which in on remand takes another 11 years I may not be around to read the final decision, but my wife and lawyer will be probably.
  10. Where do you live in Florida. I know some doctors in the Tampa bay area. They will do an IMO for you and not charge you $2000 bucks.
  11. I am going for sleep study in December. I wake up about five times a night and wife says I snore (she does too). I do know that clonazepam and valium will make apnea worse. If you want to gain weight take elavil. Opiates and all these anti-depressants cause people to gain weight. You are being sedated. The drugs like neurontin also cause weight gain.
  12. I am confused about where you are at in the claims process. Are you reopening your claim after a final decision? Are you going to appeal a decision within one year?
  13. Have you ever considered getting an IMO? All I know is you will get another C&P. It may not be any better than the last one. Mainly, you will have to wait for the DRO to make a new decision. That will take as long as it takes.
  14. Why not get a VA lawyer to help you? It won't cost you except as part of your retro.
  15. The only thing I don't like about medicare advantage is the gatekeeper concept. The VA is like a HMO. If I want to see a foot doctor I don't want to wait for a referral.

  17. You know my father got a 10% disability check. I think it was $12 a month. He was a WWII vet. I got $28 for 10% like you back in 1971. I think 100% in those days was around $700 bucks a month.
  18. I am not sure in this case but if you TDIU claim was on appeal then it should be granted back to 2010.

  21. MST seems endemic to military life for females. It is a scandal much like Jim Crow.
  22. If a claim has been open since 1994 then the effective date when it is decided should be 1994. One of our vets here won a big award because the VA had never adjudicated his claim since the 1970's. It was not a cue because it was never final.
  23. If the altered report in Cushman had said "veteran is unable to work at any job" and the VA had altered that to read "veteran is unable to work at present job" I think that would have been a CUE.
