  1. I wonder if their is any nexus between diabetes, high blood and sleep apnea? Most of these aliments are related in some way to weight gain. Heart disease, High blood and diabetes form a deadly trio. Weight gain seems related to OSA and they all interact together. I know VA tends to bury their heads in the sand and say" Oh, No there is no connection between these things...duh". It is just about the money with the VA.
  2. 500,00 claims backlogged! What a disgrace. Government says "Thanks to Vets" on Memorial Day and yet they treat vets like crap. What a country. I think about those grunts in Vietnam getting paid $250 a month for risking their lives. My God, they did not even get a Thank You when they got home if they got home.
  3. The VA has all sorts of benefits but they won't tell the vets about them unless they ask. I wonder if this is VA policy?
  4. Hey, she could just keep her money and you could tell the VA that she has bills etc. and she is broke. You could make a list of her so-called expenses against her income. This is what people who get VA pensions do. They may get SSI or SSA but if they have to spend all their money just to live then I think they would become eligible for pensions etc. You could charge her in theory rent, food, etc. Would they check her bank account?
  5. I think if you are supporting her then you should be able to claim her as a dependent. If she is living with you and you provide for her she is a dependent.
  6. Yeah, I won't get any backpay either way. VA is dragging their feet on HBP. I may not live to file. Most of us Vietnam vets are in our 70's.
  7. The IMO is a very important tool for vets. Without my multiple IMO's I would still be at 30% probably. My IMO was quoted word for word in my VA decision that gave me P&T. Now way back in the dim days of the VA they often did not even list evidence like an IMO. The VA is supposed to list all the evidence. If they did not list it then you can probably assume they did not read it. I got "S" by having an extra 60% above and beyond my TDIU. If you have a good private doctor he/she should be able to write a letter saying you are housebound. That said many docs don't want to stick their necks out one inch for a vet. They are frightened of the government.
  8. I also think they are probably trying to figure out which symptoms are from your TBI an which for PTSD. Are you getting TDIU now? You have 70% so if you cannot work these days you should be able to claim TDIU and get 100% benefits. I did this when I had 70% and got TDIU. I had a similar problem as yours.
  9. Where is benefit of doubt regarding Vietnam vets and AO? I have three AO conditions as well. I also have high blood. If the heart condition and diabetes does not kill me I can look forward to a stroke. Would it be wise to file for high blood and wait for denial and then file again when and if it becomes presumptive? I really feel for those who were exposed but not stationed in-country. It has been 50+ years for many of us. Time is running out for most of us. I think the VA is just waiting for us to die to save a buck. The bean counters at the VA and treasury value dollars more than lives.
  10. I filed for TDIU and it took me a couple of shots to get it. I was awarded 70% but denied TDIU. I got me a couple of IMO's and I got my TDIU, but was denied P&T. This pissed me off so I appealed that denial and asked for an EED. I got both of those things. It took me about 18 months to get it all. This was way back in 2001 and I got all the bennies in 2002.
  11. Our situations are an example of the VA falling short. Do they expect us to abandon our loved ones. Why can she not get someone from the VA to come in every day and help out? The VA should take care of the vet's family because that is part and parcel of a vet's life. The VA does not have to support the whole family but they should kick in a helping hand when a disabled vet is trying to care for a loved one without help. If my wife went down next week and was really in need of 24 hour care I have some insurance for that but by the time I got it all cranked up I probably would not need it anymore.
  12. I read latest VFW magazine and they were saying there was a bill to make HBP presumptive. Since I won't make any more more money from HBP claim I may just file and take the denial. Then if HBP become presumptive file again and include Niemer. I think getting an IMO that says AO is cause of HBP might be hard or expensive. I am going to think about it.
  13. I am AO vet and I have HBP. Is HBP presumptive for AO yet? If it is I will file a claim ASAP.
  14. Buck...my wife is not in such great shape herself, but better than me I think. We try to help each other. She has a bad leg from an accident. I have a bad back and neuropathy in my hands and feet. We are quite a couple. We both have arthritis now. When we get up or down you can hear the cracks and pops.
  15. I applied on my own behalf to make my wife my caretaker. I know I am eligible. I am waiting on a social worker to come by and see the shape I am in. I need help from my wife to keep track of my meds.
  16. Yes, try to be nice when you talk the stupid bastards.
  17. Rogus The VA are a bunch of sons of bitches. Get the money they owe you. They made a mistake and you paid for it.
  18. Do you work as a trustee full time? Who are you a trustee for? I think you should definitely go for it. I am 100% and I am a small investor. I manage my own money. Does that mean I am able to work full time.....hell no.
  19. You might want to get a lawyer to help you with this. There might be a lot of retro and this will interest the lawyers. I think they owe you for the years between the time they severed you and the time they gave you 70% and TDIU. What was the error they said was made when they severed your SC for PTSD.
  20. Now I got a very beneficial report from LHI on my neuropathy. The report they wrote was used to radically increase my ratings. However, to tell the truth I thought the examiner was incompetent. Hey, you get lucky sometimes. The examiner added two new conditions to service connect. That is a first. I would not expect them to stick their necks out in the future. They are probably not going to go the step further and make logical connections between conditions.
  21. I filed a CUE asking for 30 years of backpay at the 100% rate. The VA made me wait 7 years to finally be denied at the CAVC level and at the federal court level. They are not about to grant a big time retro claim without employing every trick in the book to discourage you and deny you. My lawyer and I thought we had a great case but they found a flaw and I was down the drain.
  22. The VA has a duty to review all claims. What if the VA claims they did review the inferred claim but it did not meet the requirements to be awarded. In a CUE any judgement calls result in a loser. Of course, the only way to find out is to file the claim. What do you have to lose? You did a hell of a lot of good research on your claim. I hope you win it.
  23. We can all get pretty low sometimes. Now I am pretty disabled I wonder what I have to live for, but I have a wife who needs me. I have a brother who needs me. I want my survivors to have something besides bad memories of me.
