  1. Just wanted to say I appreciate all the work you have done on the site and your desire to improve things. I feel as though the recent changes are a step in the wrong direction though. The site was easy to navigate and once logged in you could easily review new content. The recent changes have me very confused and seem to be counter-intuitive. It is your site site so you can make the changes you want but I'd suggest you go back to the previous format if possible. Green
  2. The mobile site has been down now for a week and a half. I'm guessing the VA took it down as it was providing details not available on the regular Ebennies site.
  3. I'm still in gathering evidence, been in that status for well over a month now. I really don't understand how a FDC can reach notification of decision, stay there for 3 weeks, they go back to gathering evidence for a month+. When I last spoke with Peggy I was told the records they requested had been submitted, he submitted a form stating that point. And it has just sat there for over 3 weeks now. I'm thinking maybe everyone at the VA RO is on use-or-lose leave and as such nothing is being worked this month. My C&P exams were completed in September and were favorable for my secondary claims of peripheral neuropathy (all four limbs), autonomic neuropathy of my bowels, and a few other minor contentions. The records I submitted were complete and clearly validate my claims.

  6. Given what you said, I don't think they are rating the same illness. 2011 was for your feet and legs, the current rating appears to be for your arms/hands.

I would appreciate your opinions given the following information Processed out of the military in 1983 and given a 20% ratingRequested a reevaluation of disability in 1993 and given a 60% ratingRequested consideration for 9 secondary conditions December 2014, used Fully Developed Claim format, my claim was in preparation for notification for about 2 weeks but went backwards... the claim is currently "gathering evidence"I called Peggy today to get a status update and was told that the RO had requested records from three different Regional Offices. I haven't lived in one State since 2002 and the other two were prior to 1993. This is interesting as I had a call from the RO working my current claim back in September and asked if I would give them permission to not go to any RO for information I hadn't submitted and I gave them permission. Does anyone have an idea of what might be going on?

I'm also confused as the radicular group rating is applied to the shoulder/arm/hand when more than one nerve is damaged, on the other hand legs are rated for each leg nerve damaged (not to exceed the loss or loss of use rating percentage of the lower limb). A 40%/30% rating would indicate moderate rating and the higher rating should be for your dominant arm.
  9. I was curious if the VA is supposed to notify a Vet who submits a Fully Developed Claim if they make a determination/decision to treat it like a regular claim? As I submitted a FDC, and it is back in gathering of evidence (and has been for quite some time) but nowhere does it show additional evidence being requested. Thanks
  10. When I did the VA math I came up with a scheduler rating of 87 which would be averaged to 90%. My guess is that since you don't reach 100% through the scheduler computation they must have awarded TDIU due to unemployability? Green

  12. The VA prescribed Lyrica and Cymbalta for me after several other meds were ineffective. I couldn't tolerate either so now I'm back on tramadol.
  13. All very interesting, one question I have is related to the effective date of secondary conditions. As they are related to the primary should the rating official look back one year prior to determine if is ascertainable that the secondary existed prior to the date you submitted your claim? "However, in a Rating Increase Claim, the law requires that the VA look back up to one year prior to the date of the claim filing to see if “it is ascertainable that an increase in disability had occurred.” If you can show that you had more than a marginal increase in the severity of your condition in the year prior to filing the Claim for Increase, your Effective Date will be the date where there is first evidence of an increase in severity."
  14. I would log onto myhealthevet and send a secure message stating the error in the notes directly to your new PCP, even ask that he amend his notes. Reason I suggest this is it will become part of your myhealthevet blue button notes. Someone recently posted the process for submitting a formal complaint/appeal for incorrect notes on this site. I'd do a search to see if you can find it.
  15. The reason I was tracking it so closely was that it jumped around from pending decision approval to pending notification for a period of time and then was in pending notification for 11 days. Now it is back to gathering evidence but eBenefits doesn't show that they have requested any additional information. My claim was fully developed for secondary conditions with all associated records, had favorable C&P exams (the doctor opined in my favor), and no movement since. I would never expect the VA to move quickly but I do expect a meaningful explanation (but apparently I need to lower my expectations).

  18. I tried it and cymbalta too, both prescribed by the VA. Pregabalin made me incredibly tired (was sleepy all day long) and cymbalta made me vomit.

  20. I completely understand how people can become so angry watching their claims in eBenefits. I filed a FDC (secondary conditions including peripheral neuropathy, autonomic neuropathy, diabetic retinopathy) starting last December. My claim included all my VA medical records that pertain to the secondary conditions, I also supplied a EMG exam that did prove I have PN in hands and feet. I finished my C&P exams in August (all very favorable and in agreement with my claims) and have watched the status ping-pong for the last few months. The claim was in Prep for Notification for 11 days and then went back to Preparation for Decision for 8 days and today it is in Gathering of Evidence. I guess I just don't understand the process. If you submit a Fully Developed Claim, why would it need to go back to Gathering of Evidence (outside of the C&P exam)? I know there are many of you that have been waiting longer than I have to have your claims resolved, I don't know how you do it and maintain any measure of sanity or sense of perspective.
