She has shown great interest, but she told me that she can't say, either way, until she has gone through my C-file and VA denial letters and stuff.  She is my third lawyer/law firm that I have approached. The two non-NOVA lawfirms, which are known on here, both turned me down due to various reasons.  So neither of them partook in the receiving of their fees from my recent EED award...which would have netted them a shallow 5 figure fee.

    Guess time will tell...

  2. Ok, NOVA lawyer is reviewing my C-file and several VA denial letters that post date the c-file.  Hope to find out sooner, rather than later, she can and will help. 

    My VA therapist tells me that I should look at it like this...if I gain nothing, but also lose nothing, then, I am where I was before.  Yup...heading down river towards the waterfall feeding the bottomless pit Charybdis. 

    Funny how I can't wrap my head around the idea that I will have lost nothing, if I gain nothing....Sure seems more like if I gain nothing, I'm screwed yet again.  He doesn't understand how I feel, and I don't seem to be able to explain it in a way that he can understand.

    If your EED is valid, and granted, then that will become your official start date of your compensation.  You will get the amount of retro due to you.  If you were already receiving comp at that point, and the EED increases the rate, you would get the difference between the initial amount and the increased amount.  However....if your 2015 comp was your initial comp, then you would get the full amount of what rate your EED awards you.

    For example, if you were rated at 30% from '09, and then increased to 70% in '15, and your EED grants you retroactive bump to 70% back to '09, you would get the difference between the 30 and 70% rates. On the other hand if your EED grants you 70% as your initial rate from '15 back to '09, your retro $ would be the 70% from '09 to '15.

    I hope this didn't cloud your mind too much.

    I learned last week that my EED was approved, then on Saturday, the 30th, I got my letter in the mail.  Retro hit on Monday, which just so happened to be Aug. 1st, so got my regular monthly and the fat retro $ bomb at the same time.  My previous biggest retro before that was only around $1,500.00.  My EED retro was slightly better than that....9yrs 2 months better.

    Just can't help to think that during that same time period I had to refinance my mortgage 2X, just to keep ahead of the bills, especially when I was laid off/unemployed for a 9 month stretch!  It really gets my blood pressure up! :angry:

    Well, since this lawyer is a NOVA lawyer, I'm sure she will at least have her own $ interest in this.  I already gave the DAV a long year to give it a try, and all that happened was denials everywhere, and no help from them.

  6. The best cure for the VA is a top down sterilization. When the CIC decides to make the VA their pet project, to make it right, the POTUS can apply downward pressure on Congress and Senate, and cabinet appointees alike, to get this done.  Any one of them who isn't jumping at the chance to help should be removed/voted from office.  Best way would be mandatory Military Service to be elected to any national office or position.  Then they, as Veteran's themselves would have their own personal vested interest in fixing the VA.

    Vync, they use that as their official tag line, but the end result is deny till they die.

    John999, they would sing a whole different tune, Congress and Senate, if they and theirs were all Vets too. 

    They should be treating us like heroes, holding us in high esteem, and everyone should be taught in kindergarten on up, that they should aspire to be Veterans.  "Starship Trooper" had the right idea, citizenship automatically accorded to Veterans.  Bet then the U.S. would be a whole different and better place.

    Thanks, man, I appreciate it very much.  I know that one was easy, just took time, but still, is a big win for me.

    I&D, I just heard back from the NOVA lawyer's office, one of his team members will be working with me.  And they are about 10-12 miles from my house.  But I do appreciate your contact info offer.

    Don't ever shut up....just take a breather.  Some of us, or maybe just me, don't talk much, but when I do, get told I'm a fool(ok, ripped off song lyrics)but is basically what my boss at home tells me...that's not true either, it just sounder better than saying that I'm not supposed to talk about my own thoughts, opinions, feelings, life experiences....cuz she really isn't interested and really doesn't care or want to hear from me.  And that is the truth, that is what my boss told me.

    I'm glad you got a laugh from me...I know I don't have much to offer in the way of anything, but I am quite good at finding the lighter side of anything.  Misery loves company, just look around(figuratively) here we all are! What place is in greater need of a few good laughs?

    Grrrr!!!!  I'm being mad with you!  :biggrin:

    This may be a case where it was never mentioned, at 50%, mostly because it wasn't. Not unlike don't ask don't tell, you didn't know, they didn't inform you, so you then, didn't ask, and they then, didn't tell you. 

    So..if you haven't already, get that target plotted, align that gun tube, load your shell and powder charges and fire that IU claim down range, asap!

    But do be aware, fiasco2g, the VA can, and will try to lowball you no matter how well prepared you are.  Now, that doesn't not mean they will, 1 out of 5, or maybe 1 out of 7 do get their true and just ratings, and you may be the 1.  Most of us are either the 4 or 6 others that get denied or lowballed.

    Personally I just had an EED granted back to 03/2006, got a hair over 9 years retro...so I do know something of which I speak.

    And one more thing, if anyone says "Don't rock the boat', tell them to put their PFDs on, cuz you 'bout to make some big waves!

Most likely depends on how they got to 100%...extra schedular(multiple SCDs added up to 100%) or if they have one or two SCDs that did it.  If you are 100% for MH issues or PTSD it would seem kinda hinky that you can work for more than a few hours at a time. But if you have a basket full of SCDs and they combined together to get you there, it should be no problem at all.  Others here will chime in with better info, tho.

Got my letter in Saturday's mail, with the breakdown of it all...and the deposit hit on Monday along with my regular monthly.  It's about equal to 2 years of my current take home paycheck.  Kinda angers me to think that this, over the past 9+ years would have prevented so much of the debt I have incurred. I am, however, so grateful to God, that I did get what I was due.

    The letter basically said what I said in my claim for EED, upon review, we find the claim for EED valid due to evidence of no judgement on claim dated 03/06.  And the evidence used for my successful claim last year, was all older than the claim from '06.

    Now onto my appeals/NODs for my MDD and SA.
