  1. Here is a PDF file of the Case. http://www.veteransptsdclassaction.org/2011-05-10_9th_Circuit_decision.pdf
  2. Check out PTSD topic here on HADIT, under "Specialized Claims"
  3. So, you have already filed for PTSD, 'Armyvet1987'??? Hang in there, keep breathing. My most positive thoughts are with you.
  4. In his decision, Judge Conti found that many veterans are suffering, and that the VA is the cause of much of that suffering. http://www.veteransptsdclassaction.org/
  5. I must admit your story unfolded over several posts through out this thread, I thought your questions were already answered. Sorry, I was using the remainder of this thread to comment on other Chapter 35 issues raised here, and for any future vets / families with new Chapter 35 benefit issues, who may come across this. I hope you find the answers you are seeking. Best wishes for a successful outcome, CB
  6. One can only imagine how many old disabled soldiers went to their graves with unfinished VA business. We can take consolation in knowing that they will "Rest in Peace". Bob
  7. I agree pr... Also, sometimes, right after High School, the vet's dependent children jump right in to CH#35 and then drop out for a while, and get hit with a month or three of "overpayment"... That adds salt to a wound, especially after all the Vet has gone through to get the benefit for the kid.
  8. We all need to hang in there and keep breathing while we wait. Good Luck to all, CB
  9. I feel your pain, 'COOL BREEZE', on many levels. Of course I mean that figuratively, since I only have one foot, and since the neuropathy kicked in after chemo, I can't really feel the pain in that one anymore either. However, you know what I mean. You are not alone in your suffering. My most positive thoughts are with you. Also, Don't you hate it when you get a ridiculous letter from the VA on a Saturday (Holiday weekend). Now you have to wait and fume until the next business day~
  10. Thanks for your inspiring post, 'Sapper'. Best Wishes, CB
  11. Sorry about the misquote, 'COOL BREEZE'. 'GuaymasJim' did the research on the ebay book. I stand corrected, and good luck with your future appointments.
  12. Your burden has been somewhat lifted. The dark days you experienced are over. I celebrate your relief. Congratulations, 'VetsLady' Warm regards, CB
  13. Let's do some math... COOL BREEZE posts that you can pick up a copy of the book at ebay for $6.95 ea. http://cgi.ebay.com/...=item43a709ed70 . Using the VA's numbers, http://www.va.gov/vetdata/Veteran_Population.asp , there are 22.7 million veterans as of 9/30/2010. If we all get a new copy of the book, under this cost cutting VA program...??? That equals a lot of money that could be used for the care of veterans...
  14. Your perseverance is an inspiration to many disabled vets, Troy. Hope your feeling better more every day and on the mend.
  15. Good Morning Pete53, In your post you said the 800 number is not working. What happened? Did you get caught up in a never ending recorded loop or were you getting a busy signal? As coincidence would have it, I got a call yesterday from a representative of "Davis Research", claiming to be doing a survey contracted by the VA to see how the quality of the 800 Call Center was doing. Asked me questions like, how long did I have to wait to speak to a rep. and how was the quality of the information I received, etc... I wonder how much $$$ that cost the VA? Good luck on June 8th & Thanks for keeping us posted...
  16. I hope you feel better soon. It is certainly a good feeling and great therapy to help a fellow veteran. Thinking positive thoughts for your speedy recover. Thanks for your service. CB
  17. I believe you posted that you asked for a "reconsideration" and was informed today, that you were denied... JMHO... If so, then you should have your vet rep submit a NOD "Notice of Disagreement" asap. Is the resident psychologist a new PhD? Google the name and see if this person has a bio. You can claim that there is conflicting evidence in your record and that the "novice psychologist" conducted an incompetent exam and request another exam with a different doctor. Have you ever filed a NOD? My most positive thoughts are with you. CB
  18. PTSD diagnostic code #, for CRSC reasons... CB
  19. Long story / short... postponed hearing and had a new C&P exam ordered. I just got the call from the VAMC C&P dept. setting the exam date for June 3rd. Realistically, the most I could hope to have accomplished at the hearing would be to have a new C&P exam ordered. All things considered, I feel like a winner, and ready for round 2... The advice and support I received from you all, helped more than I can put into words here. CB
  20. So I phone the VA 800 number and they tell me that the DRO hearing is not tomorrow, it's Wednesday,Thursday, the 26th of May. They can't even get the hearing date and time straight... It smells more like fraud than VA incompetence... I'll have to wait and get the story right tomorrow morning. I'll attempt to get it in writing so I don't get denied for missing the show. It's going to be a long night.
  21. I just received a phone call from my vet rep advising me that the VA DRO set up my DRO hearing for tomorrow at 10 am. However they sent my notification letter to the wrong address by mistake.... LOL They asked me if I wanted to reset the hearing date. I have been waiting over 2 years for the DRO hearing, and they can't even get my address right. Makes me wonder if it was just VA incompetence, or were they hoping that I would not show up???? LOL Has this ever happened to anyone else????
  22. It still amazes me that we can get copies of C & P reports. Or any copies of any VAMC reports. I remember the little locked green bag days. Even though it appears to be difficult at times, I am glad that we are now able to get copies.
