  1. Thanks, yes the decision letter described only one mh condition. Just checkin in, don't want to miss details - will keep well read ~ !
  2. The decision statement uses a short list of what the doctor summarized as what 'veteran is service connected for' but doesn't add a disorder that is in Axis 1: (of which I have 2 items under). Although mh issues are rated under one umbrella - I am interested if the second should show also. Thank you!
  3. Does SSDI ever backdate due to IU reciept? Still researching how this could be. Thank you Cg'up2009!
  4. In a quick review of this post, it looks like recorded evidence was key factor to success. Hence my apolgies to tree's, paper records are not a thing of the past yet and these archives have value. Future data files on disk only? hm....school photographer said best way to preserve photos and documents without minimal air or exposure to elements, archival plastic sleeves (I use document protectors and cardboard boxes).
  5. Thank you for the post. Can anyone here explain please? Say a service connected disability was awarded today but 'effective' - say 10 years back? Is that condition protected? Another day another question ~! just Cg here!

How about this, look at the Appendices (my goof for not listing that) it does show your numbers, but I suggest you double check your information just in case, 5237 does show lumbosacrial strain... but 5299 isn't listed. In my experence, sometimes the last two numbers '99' may indicate that a condition is in that code family but 'uspecified' or more generally within that family code range.   13. Do you have a current copy of your VA medical treatment records? your C-claims file? Reading and rereading help to see what is 'recorded' versus what is 'mentioned'. Would be good to see 'mention' of IU. Have you filled out the VA form 28-1902 Counseling Record form? If not, take your time and describe Disability Limitations and support your statements. Remember its 'your' request for help from 'them'. (I felt my counselor rushed me to complete the form. For a redo, I'd take it with me and return it soonest.) Glad to see you at Hadit, looks like your're proactive for yourself, family to get available benefits result of your military health conditions. If I had redo vocrehab, I'd claim my depression right in front of my pain, honestly. My personal experience was time consuming and not helpful. Sometimes vocrehab gives a vet a denial, which isnt necessarily bad and maybe help with ssdi or iu. Some denials I've read say something to the effect of "we've determined the veteran 'cannot succeed in a program of training or education, and get a job occupation that matchs their skills, talents and interests.' The evidence used shows vet was unable to pursue higher education because 'inability' to work with other people (individually or a group of people). Or unable to physically attend a regularly scheduled program of courses due to debilitating SC health issues." Hope your vocational rehabilitation process goes smoothly and they offer you direct help, expect good things! <_< Second Yes, on Carlie's note, point the VA in the right direction - to the strongest evidence in your records/file to support your claim. A thought, if you are on those meds, ask or even tell your PCP or specialist directly - to validate that you have chronic pain disorder or have them explain why or why not. Also pain management class is good fodder as well as helpful to many. All the best to ya, Cowgirl'up2009!
  14. Berta thank you for the post, the subject and dates and decisions sure dumbfounded me. This widow and her family have endured the battle for untold numbers of possibly affected veterans and their families. Four vietnam vets are in our family.
  15. Good Luck Angelo and Navydoc2 sure hope you each get what you need. SSA didnt give me new exams, due to the current VA and private doctor records I submitted. On one of their forms I was given a point of contact on my form and unlike the VA, I called after my adult functional report was in nearing completition of my claim - actually talked the person listed, nice and helpful.   18. Chuck an you elaborate on this 'SSA application law that 'can' establish the claim date please? Berta does SSDI come into effect at all in your case? As far as the duplication of SSOC - maybe I read somewhere and sure don't know where - that whenever new evidence is submitted a new SSOC is released. Releasing a new cycle from that automated paperwork dinosaur? Anythings possible, but in re-reading all the paperwork from a decade ago, thanks to Hadit, THANK YOU, I've recieved a new lease on life. I am concerned enough that I re-read everything for a week or so with pauses between. Because time flies especially for the claimant to file an appeal if its either 60 days for a SOC or a year for SSOC!! A'yup, I read and RE-read these posts - found parts of it may just apply to me.   19. Berta, you, or any veteran, spouse or family member do not deserve the disrespect or idignity you described. I am sorry for your experience. I suspect that a few clerks are working hard at the 1-800 # 'give me a clue' office and others are simply there between jobs or really working thier retirement plans. (probably like many companies with good benefits). Learned the hard way myself, complained to a 'freindly' clerk once about an exam, (supposedly a veteran themself!) who input a 'veterans complaint' and when the decision came suggesting I accused the examiner of doing something incorrect! Now, I vary my inquiries and efforts between 1-800 and IRIS, gotta have the paper copies. The VA needs many things fixed, figure I do my part by using it so we don't lose it. {{Berta, rock on! }} Humbly indebted to your wonderful stubborness ~! Hadit Cowgirl and family

Thank you I did look at VA Pamphlet 29-9 - the total on the right column is PER $1,000.00 of insurance is er, steep.(maybe thats what ya meant?up :)). Think I'll apply for waivered 10,000 - but can't afford payments for the other $20,000. Hey, thats right, I still look 38. Still young, when I was in sixth grade (11-12yrs) hubby was a sophomore wit a car!

  22. Not sure if this is 'benefit of the doubt'. What'dya think? One paragraph shows examiners' opinions 'con / pro' for unemployable due to sc conditions. The other said "all reasonable doubt has been resolved in your favor and entitlement to iu is granted because...". This was a NOD. Hope this helps~!
