Question

I saw the moderator response so the Rating team subject and its closing and I had had it with this site. I am very disappointed by the lack of knowledge I see and the willingness to overlook the circumstances of some veterans in preference to others, rather than supporting all.....

I read the Maine VARO letter you posted. Did you ever consider that the letter is just the RO covering their asses. You believe everything the VA tells you? You are going to have a very hard road to travel. If the VA decides to halt work on every claim, but Nehmer claims that is wrong and is unfair. That is the VA's fault. That is the fault of congress. No Nehmer vets demanded that all work on other claims stop until their claims are decided. This is the VA trying to cover their asses due to years and years of neglect of the AO class of vets. They must be facing sanctions in order to do what you say they are doing. You would do better to post your IMO's and SSD award here so we could look at them for problems. If your claim has been on appeal for 4-5 years there may be something missing that we can fix. Allan had his claim stuck in VA hell for ten years and is just now getting some action. Many vets here have been in appeals for years. I have been in appeals for five years with no end in sight. It is not due to Nehmer, but due to the VA's reluctance to pay retro.

It's true that in a number of Regional Offices the Nehmer cases are #1priority. However, remanded cases are also priority. Both are ordered by acourt/judge that each will be adjudicated asap.

I don't know the reality of how that is being addressed. Now that you've raisedthe issue I will ask. I hadn't thought of it before.

The only good news I may have for you is that I don't believe any of the VARegional Offices involved in processing Nehmer see it as a task lasting untilOctober.

Dean-I might have found your CAVC case.

Does Bethesda or names beginning with B or M means anything to you from the Docket sheet?

But I could be all wrong.

It looks to me from the case I found that the VA disregarded the veteran's SSA records completely !!!! and thus the remand.

Again I might be wrong and will not post any links to this as CAVC cases contain names etc.

If this might be your case- have the records from "Dr. McM..... " showed up?

If it is your case - your case is a little unusual but it is not far fetched by any means and strong medical opinions could warrant an award.

Did the VA ever give you any C & P at all for this claim? For the secondary issue you are claiming?

Hello Dean, I have tried to figure out just what really it is thats got you frustrated, but taking on Mrs. B is has got the Andy of Mayberry in me coming out. Berta is one of my heroes and she has helped me with my claim and now the FTCA and Section 1151. You have never offered to help me or any other of the Vets that I can see but Berta has. I am thinking like Stillhere said......you may be a troll just trying to get some strife going on here and that is not going to work. We here at hadit have had that happen too and it was dealt with accordingly.

I am having to deal with 0 SERVICE CONNECTION and a fight with the VARO for the last 4 plus years. I have been in the hospital twice in the last 4 yrs and nearly died both times. The VARO has irrefutable evidence , but because my claim is so large and Fort Greely is involved it means a PRECEDENCE setting case and they are doing everything short of a hit man to end my life. I too am Agent Orange OUTSIDE OF VIETNAM, Nuclear, Asbestos and am just trying to stay alive. When I read something like you wrote, it showed me you are not trying to HELP the problems most Vets as myself are having but attacking the very ones here that have tried to help me and others who are short for this earth. I and some others can't fight the VARO forever. By the way Bertas husband died from one of the same things I have and I nearly died also from it less than a year ago. I almost did not post to this but it made me angry and I am questioning your sincerety and motive for this post. Why can't you post something that will help me or another vet? If it was not for this site and the dedication from people like Berta who give so much and don't receive any payments, I would have given up. I owe people here at this site so much , Berta especially, and I could never repay it. Sometimes I get my facts or numbers mixed up and sometimes I might not agree with all that I read or what is posted , but at least someones trying to help and not tear down or try to discourage me like you are doing.

I really appreciate your service , but its not fair to me or the others when you can do what you did and could have done it in a Personal Message to Berta instead of the way you posted it. I wish Berta had not replied because she could have been helping me or another Veteran instead of replying to someone that is just plain being manipulating. If you need to leave to find another site then so be it but attacking the ones that are helping is just wrong. Or maybe thats exactly what your trying to do. What good could come from your method or tactics?

Ok ,,,, I hope you understand now the way I feel. I hope you also check and see if you have that one bullet in your pocket. John pointed out the VARO and they cover their hindends and I can promise you that the VA has never, NEVER , not one time been forthcoming with me or told me the truth about anything. They have hidden or destroyed records, kept them from me, lied to, malpracticed on me, so I already have been bit or as jbasser says frenchkissed by an alligator. I will never trust them or anything they tell me because they have not proven me wrong yet. If you choose to believe what they tell you , then so be it. I don't want another Veteran attacking another or hurting one thats trying to help a Veteran. It just is plain counter productive and serves nothing good but only to divide those who want to help. Now I said really too much but thats how it is. I wish you well with your claim and hope you find what your looking for . I will try at any time to help you when I know that is what you really want but all I can say to you is......NEVER GIVE UP. God Bless, C.C.

Bill -my anger subsided quickly and I spent hours looking instead for Dean's claim.

We aren't angry with each other-we are really angry because we deal with a system that is broken and hasn't been fixed yet.

And the tax payers fund it all!

Hell I am pissed now at the CAVC decision for a vet whose claim I found that may or may not be Dean's.

It looked to me like the CAVC vet's rights were walked on.

Then again any case prior to the enactment of the VCAA got us the "not well grounded " brush off.

Hello Berta,

There just needs to be less attacking and trying to help others . Deans post really discourages me and there wasn't much in it to help me or another veteran. Maybe Dean is sincere but I am still not convinced especially with the way it was done. I can see him writing that to the VARO , but not to a member that is trying to help. It just doesn't make any sense. That would make the VA real happy to see you and some others go from Hadit and it would accomplish their goal by keeping knowledge from the Veteran and the proper way to respond to them. Any way I know I am not the only Veteran that saw the post as being harmful and not helping ,,,,,as I said ....just the Andy coming out because he was going after Aunt B. NEVER GIVE UP.       This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
