My intent on posting this is to provide my experience as I go through this process. I will attempt to post updates and if something I have done helps even one other vet, then it will have been worthwhile. Sorry for the length. Thanks for your service to all of those that have gone before, those currently serving, and those that will serve in the future, for no greater love....

My status is currently on active duty in transition with a retirement date of 1 February 2013. I filed a Benefits Delivery at Discharge claim on 14 August 2012 or 171 days prior to my retirement. My eBenefits status changed on 12 September 2012 and the followng is what was posted as my status:

I would expect with your claimed conditions you have chronic pain! However, I wouldn't claim depression unless you have been diagnosed with it. Has your primary care physician screened you for depression? Do you or anyone close to you have concerns about your mood or how you are relating to your health issues?

71M10, as the wife so eloquently told me this morning, "Yes, dumb*ss, you have chronic but intermittent pain." No signs/symptoms of depression. About the only thing folks have noticed moodwise is that I apparently have a much shorter fuse after the third and final(so far) concussive incident (TBI). I think it is more my fault because I get frustrated when I can't remember common everyday words and it really bothers me when I see someone I served in hard times with, yet I can't remember their names.

And what the hell is up with the super-sensitivity? Anybody else tear up at the drop up of a hat? Seriously, I think I might need to have a testosterone check or something!

Yup... All the fn time. Can't go to games, can't stand tall like a man in front of our colors, can't watch my boys teams win or lose, can't watch even simple kids movies. With all due respect to your wife, I think she may have missed something. This evening alone I have spent most of it in tears, with no damn good justifyalble reason. This post alone has done its job.Thanks for your service. I see you are moving along and I'm glad to you are. If my sig line is still up... It is accurate. Additionally, I just fund out that the contractor group, MAP, lost thier contract with VA. Not sure where I stand now. Havent had a single c&P, havent been contacted at all by VA other than their monthly letter tht they have my claim. Started a congressional... Thats how I found out the group lost their contract. They (VA) didn't give the congressman ofc any further details other than they would follow up in 30 days. Bestof luck

C&P Update: PSC in VA parlance apparently means Psychology/Mental and that was my initial foray into the C&P arena. My 0930 appointment with a 1030 follow up and a FAM, or General Medical, was sandwiched in for 1000. What really happened was the brain doc got inside my head and spun it around pretty good. Two hours later, ostensibly while discussing TBI, Insomnia, and depression, but having discussed how happy I was as a toddler all the way through how my head injuries may be affecting me in other ways. I think I may have even confessed to some things beyond the scope of reality. Anyway, she made a lot of notes and had some recommendations. After that, they drew some blood, did an ECG, a PFT, and took vitals. At about 1140, I went into General where the Dr. did all of the checks requested by VA including measuring range of motion in my wrist, back, and shoulder three times each. Luckily, he only measured the depth of my butt once, but I am pretty sure he hit the bottom. He also confirmed that the orchiectomy did in fact leave a scar and no left testicle. Would have gotten x-rays today but hit a time limit and they told me to come back tomorrow. Hopefully I can get a copy of todays exams. Tomorrow I have Audiology and x-rays, also have my final out appointment tomorrow afternoon to finalize my DD214.

Received letters in the mail on Thursday, 4 Oct 12 for appointments on 5 Oct 12 and 17 Oct 12. Had an Upper GI X-Ray with Contrast on Friday, 5 Oct 12, 0830 appointment, was done by 0915. Examiner was polite and effecient. Have an Echo Cardiogram on 17 Oct 12 and still waiting on my rescheduled audiology appointment.

Update: Received a letter via USPS on Saturday, 13 October. Unfortunately, it was for my Upper GI appointment on 5 October.....luckily I also received a letter prior to that appointment and made it, which brings me to today. This morning, I got a phone call from an ENT/Audiology clinic in Raleigh with a friendly appointment "reminder". I told her I didn't know about any appointment with them and she told me it is on Wednesday, 17 October at 1545. Lucky for me that gives me time to get the kiddos from school and drive the hour and a half up there. Also lucky for me, this afternoon, FedEx shows up with the letter informing me of this particular appointment. Next update should come Wednesday night. Stay tuned for an exciting, nail biting, edge of your seat ride on the VA roller coaster!!

My C&P is complete...I think. Had an EchoCardiogram yesterday morning and an audiology/tinnitus/balance appointment yesterday afternoon. The ECG went well, took about 15 minutes. The audiology was done up in Raleigh, about an hour and a half away, I got there about 45 minutes early and was actually done about the time my original appointment was scheduled for. The Dr was retired Air Force, but I won't hold that against him smile.png . Why do they always ask me where my hearing aids are? Maybe I should try and get a set before I get out. Anyway, I called the QTC office this morning and asked if I got a copy of all of the proceedings, they responded that they sent them to the VA and I would be able to request a copy from them. I won't do any more updates until something changes in ebenfits or I get another letter.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
